Four men charged with causing the 2,500-acre Gap Fire last August might have acted negligently when they failed to put out a campfire but their actions didn't meet the necessary legal measure of recklessness for their case to proceed to trial, a Placer County judge ruled Tuesday.
Rose said that setting off fireworks or a pipe bomb would constitute the "reckless disregard" needed for the case to move forward. So would lighting a fire while smoking marijuana or crack, he said.
"But it's not reckless to light a fire because you're cold, scared and have other people to care about," Rose said.
