Murder has a specific intent requirement

What you have just described is the general intent requirement for recklessness - undertaking an action with knowledge that it could hurt/kill somebody. That IS NOT murder. His RECKLESSNESS will be addressed during sentencing. Sentencing hasn't even happened yet, save your moral outrage until a) he is sentenced, and b) more FACTS come out.
