Mr. Thompson:
I am a member of the United Transportation Union. As a member I am entitled to cast a ballot regarding the proposed merger between the UTU and the SMWIA.
It is my understanding that both the UTU Constitution and the "Merger Agreement" (Section II) require the approval of the "Membership" before any plans for a merger of the UTU with another union can be finalized. It is also my understanding that Section II of the "Merger Agreement" requires the approval of both the "Merger Agreement" and the "SMART Constitution" (together the Merger Documents) by the UTU "membership".
The merger packet I received from the International contained only the "Merger Agreement" but did not contain the "SMART Constitution". Please provide this necessary document via Overnight Delivery whereby I cast my official ballot within the time limit established by your office.
Until such time as I receive the required "SMART Constitution" please understand that I must vote "NO" to the proposed merger. This "NO" vote is based on the lack of the necessary information required to make an informed decision. In the event you decide not to provide me with the required "SMART Constitution", please provide the authority of the UTU Constitution that permits the UTU President to circumvent the exact requirements of the proposed "Merger Agreement" for subsequent appeal to the UTU Board of Directors. This will also advise you that I protest the signing of any merger contract until such time as a final decision has been made, upon appeal, to the Board of Directors.
