SMWIA SUPPORTS THE RAIL COALITION

Best Freight Rail Contract In A Generation Ratified
Six of the seven rail unions that make up the Rail Labor Bargaining Coalition (RLBC) have ratified their contracts with the National Carrier’s Conference Committee (NCCC).
The RLBC represents seven rail labor unions whose contracts cover more than 85,000 rail workers or more than 50 percent of the carriers’ employees. The seven unions in the RLBC are the American Train Dispatchers Association, the Brotherhood of Locomotive Engineers and Trainmen, the Brotherhood of Maintenance of Way Employes Division, the Brotherhood of Railroad Signalmen, the International Brotherhood of Boilermakers, the National Conference of Firemen and Oilers/SEIU, and the Sheet Metal Workers’ International Association.
The NCCC is the carriers’ bargaining coalition representing the nation’s major railroads in national negotiations, including Union Pacific, Burlington Northern Santa Fe, Norfolk Southern, CSX, and Kansas City Southern.
The agreement includes general wage increases totaling 17 percent (18.2 percent compound­ed over the life of the agreement), which will remain effective until December 31, 2009. Negotiations concluded in May after two and a half years of bargaining, after which the unions submitted the tentative agreement to their members for ratification.
The final results were received today. Of the seven RLBC member unions, just the American Train Dispatchers Association failed to ratify the agreement.
“For the first time in a generation, a major portion of rail labor negotiated in solidarity,” said Fred Simpson, President of the Brotherhood of Maintenance of Way Employes Division (BMWED), “This agreement represents a historic achievement for rail labor. By standing together, we demonstrated to the carriers that their ‘divide and conquer’ strategy, in which they would pit one union against another to achieve the lowest common denominator, would no longer work.”
"These were difficult negotiations," stated Brotherhood of Railroad Signalmen International President W. Dan Pickett. "The carriers were on the offensive throughout this entire process. The RLBC’s solidarity derailed the carriers’ all-out assault upon the wages, benefits, and work rules, and achieved the best contract we’ve gotten in decades."
“The rail carriers have woken-up to the fact that there’s a new sheriff in town,” said John Murphy, Teamsters International Vice President and Director of the Teamsters Rail Conference with which the BLET and BMWED are affiliated. “The carriers are no longer dealing with a divided and splintered rail labor force. The rail unions stuck together through an extraordinarily difficult, multi-year process. We stopped the carriers from singling out the union with the most to lose and then forcing other unions to accept a so-called pattern agreement. When negotiations open up again in 2010, rail labor will be stronger and more united, and we will be positioned to achieve even greater gains for our members.”
"This agreement proves the old adage that in unity there is strength," said RLBC Chair and President of the National Conference of Firemen and Oilers (SEIU) George J. Francisco, Jr. "Coalition bargaining led to a better contract and we were able to work with rail unions out­side of the RLBC as well."
“From the legal counsel to the consultants we retained, the coalition demonstrated extraor­dinary value of solidarity,” Alan M. Scheer, Director of the Railroad Division of the International Brotherhood of Boilermakers. “Together we achieved far more than we could have separately. That is the power of the RLBC.”
“By sticking together and holding firm through a very difficult and trying process, we were able to secure our best contract in a generation,” Dewey B. Garland, Director of the Railroad and Shipyard Department of the Sheet Metal Workers International Association. “This is the power of rail solidarity.”
The contract gives up no work rules, raises net wages over 16 percent after cost sharing for Health & Welfare (H&W), caps employee H&W contributions, expands access to in-network medical benefits for most of the 25 percent of rail employees previously denied them, and provides no concessions on contracting out or the carriers’ work exit demands.

FACTS ABOUT THE SMART MERGER in a nutshell

by THIS MERGER IS NOT GOOD, VOTE NO

UTU proposes to merge with the Sheet Metal International Workers Association.
To create an Organization to be named SMART:

There is a document on the UTU web site that is the proposed merger agreement to establish SMART and to eliminate the UTU and establish us as the Transportation Division of SMART. I would encourage you all to review this proposal as it will have a huge impact on the future representation you will be receiving from your labor organization.

As of now, I feel that there are too few facts and details lacking in this proposal to be able to make an informed decision and would certainly prefer to have an opportunity to ask questions in a public forum where the answers can be documented and heard by all and memorialized for future reference. Until that time I would have to say NO to the merger proposal and ask that the International of the UTU hold an open debate on the merits of this endeavor at the UTU Convention which is to be held on August 13, 2007. It seems very unusual that there is almost frenzy at the International to shove this through prior to the delegates meeting and having an opportunity to ask the important questions.


In the (15) page merger agreement the (6) senior International Officers of the UTU would go over to SMART as General Vice Presidents, while the remaining Officers would be transformed into International Representatives and Organizers. We don’t know the mechanism for future filling of those positions as the details are lacking. There would also be an attrition of the Assistant President and GS&T of the UTU and when that happens, the next two senior Vice Presidents would be moved to General Vice Presidents of SMART.

If a member is looking for details regarding the duties of office, disposition of locals, whether certain union officials are elected or appointed; your guess is as good as mine. It seems that the merger document presents a vehicle for the merger to take place, but doesn’t really say what is going to happen once it does take place. We do know that in 2011 that General Executive Council action has to be taken by them in order to negate the merger agreements termination in accordance with article XIII. So what does it all mean, are we voting for a merger or just an association with another union that will eventually just fold us into their organization as a sub-part known as section 21(b)?

There is also a great disparity in the salaries of current Vice Presidents of both organizations as SMWIA pays theirs $43,000 while the UTU pays $137,000. Question is how much are these newly created General Vice Presidents going to be paid? These are the top (6) officers coming over from UTU to be named to those positions and are they different positions then the existing Vice Presidents in SMWIA? It looks as though the officers plan on using the UTUIA finances to make up the disparity in the salaries which could be a sizable amount of money for each position.

There are also some changes in the eligibility for office which seem to conflict with the current UTU Constitution and numerous previous UTU Board of Directors decisions. Seems like (40) years of precedent are being washed away with a (15) page proposal. Apparently it solves someone’s political problems. There are also proposed changes in the manner in which locals send delegates to the convention regarding both payment from the local and introduction of the weighted ballot. Both of these items were rejected at several UTU Conventions when they were brought to the floor as proposed amendments. Not many locals could afford to pay a delegate to attend a national convention and if there were more than one, the cost would be prohibitive and would force local union dues to be increased to cover the costs.

These are just a few of the issues that you may have to consider so please think and read before you make your decision and cast your vote.

Jim Williams ex-VP of Bus Dept

Maybe we can find someone who can remember when Mr. Williams was moved up to VP of the Bus Department and then all of a sudden he left that position and went back to California and once again became the General Chairman of his former GCA. It was during the miraculous Dubose years when the UTU Constitution really didn;t mean much. Of course Dubose had three of them just to confuse the issues and the members. How does that happen in an organization that is supposed to report to the DOL on elections, resignations and reappointments to former positions??? Mr. Williams should just keep his big fat ignorant mouth shut and let someone who actually can run the Bus Department do his job.

Teamsters Fire People, too!

So everyone’s upset because our “duly elected leaders” have been fired by the President of the organization. How callous! How heavy-handed! Things will be much better with the Teamsters, right? They wouldn’t do such a thing, would they? Well, yes they would, and they do. A great site called Teamsters For a Democratic Union candidly bears all in a effort to expose goings-on in the Teamsters executive ranks. Here you can find all kinds of information regarding Finances, and who’s “in” and who’s “out”. The site features one article on Hoffa’s childhood friend and long time supporter, who was fired to the surprise of insiders. According to the site, Hoffa has fired another, supposedly for retaliation because he ran as an independent candidate for Eastern Vice President. Recently, two “top associates of James Hoffa” were charged with criminal contempt. So think again if you think joining the Teamsters will protect you from corruption and cronyism. Out of the frying pan and into the fire! Happy surfing.

The TCRC have their own axes to grind. After the former president fell out of favour, he is targeted as being responsible for the VIA fiasco. Charges stem from “improper collaboration with the employer”. The Cult accuses (unsubstantiated) that our President is in bed with the employer, and the TCRC does the same thing with theirs, in writing, in a document that runs thirty four pages. Changing to the TCRC doesn’t sound like much of an upgrade to me.

Speaking of firing, did you know that our “duly elected leaders” fired our VP? How can that happen? Not sure, but it did. VP John was summarily removed from the CROA and DR committee by the GCs, thank you very much. Interesting, considering VP John was the President’s appointee and the International pays the bill for CROA.

So is the grass is greener on the other side of the fence? Maybe it looks greener, but I bet the water bill is higher!

· 36 rooms X $300. per night = $10, 800. (Don’t believe their fib about the discount. What hotel/motel/resort in their right mind would allow anyone to have 36 rooms at $100. per night the week before the 4th of July?


· Estimated 324 X $20. per catered meal for staff and guests = $ 6,480. (Does not include gratuities to resort staff and resort activities director)



· Estimated cost of “special duty” managers used to “fill in” for real managers during this “retreat.” 17 special duty X average $240. per day X three days = $12, 240. Some special duty trainmasters/service managers receiving their LOST WAGES from regular assignments!

I present myself to you as the Main Man for the office of Vice-President, Director of the Bus Department, of the United Transportation Union.

I have been a member of this great Union since 1974 and became directly active in Union affairs when elected Legislative Representative of Local 1565; subsequently being elected Chairman of the State Legislative Board in 1992. In 1987 I was elected Vice Chairman of Local 1608 and then elected Local Chairman in 1994, a position I still hold. I have been stuck in this damn position because I want James Williams position but that man will never retire. He gets all the perks and I get shit!!

Since 1987, I have had an active personal involvement, now please understand that involve means just that. I sit in a chair in the corner and listen while our great attorney's do all of the work, but anyway our attorneys were able to achieved contract compliance and protection of the rights of our members. I have, once again, my chair in the corner, been involved in hundreds of discipline hearings, investigations, pre-arbitration settlements and arbitrations. I greatly appreciate our attorney's great work for the members of MTA.

I have been a member of the Negotiating Team for labor contracts on the Los Angeles County Metropolitan Transportation Authority property in 1997, 2000, 2003 and 2006 and I am currently Vice General Chairman of the General Committee. I have not actually been chief spokesman but I can learn something. I learnt you never disagree with your bosses always do what you are told, don't make waves.

In addition to my duties as Vice General Chairman and California State Legislative Board Chairman, I serve as a Trustee on Los Angeles County Metropolitan Transportation Authority Pension Investment and Executive Boards and the Health Insurance Trust, overseeing benefits for approximately 5,000 members. Remember, this job does not really entail much but looking over a piece of paper every quarter and putting my initials at the bottom. In the past I have attended Department of Motor Vehicle conferences, working on safety provisions for Public Transit Vehicles, overseeing accident investigation procedures and attending hearings involving light and heavy rail and dedicated busways and getting my driver's license renewed.

This position was really not that important, but I thought I would mention anyway in order to take up some space. Recently I was appointed to represent the UTU in Washington, D.C. by Mary E. Peters, Secretary of Transportation, on a Committee making recommendations to Congress regarding Commercial Drivers Licenses. This job is imporant to me because my buddy David Hakey, said that I could easily be elected if I was on this committee. David Hakey has made some promises to me and wants to move the entire bus department to LA so that the small Bus locals can directly report to me, their future BOSS. He even gave me a little black bag at our last meeting. Anyway, I and James Williams will run this Bus Department with very little regard for other Bus locals. We want to control everything, right Brother Hakey and Williams?

I take great pride in the manner in which I have been able to represent the members of this Union, individually and collectively, and with the support of Brother Hakey and James Williams, who basicly tells me what to do. If he said I can lead THEN, by damn I can lead!!! He is the man!! Yes, I can do this, right Brother Williams??

I ask for your support and your vote. I am the part of the problem with the Bus Department and this great Union. Together, my local, will control the Bus Department and strength to my local as a whole. The Bus membership deserves the best representation, which they are currently receiving, but I have to run anyway since I was told to do so. I want to express my appreciation to Brother Hakey and Williams for their support and assistance for my election as Vice President and Director of the Bus Department.

Let''s all hear it for the administrations story on the STUPID merger agreement. I have never seen a document of such reported importance with so few details. I wonder if anyone alive from the UTU merger would like to sompare this drecht with the Unification Agreement. What a difference. Apparently there isn''t anyone left at the International who can actually write an agreement and dot all the I''s and cross all the T''s. Instead this crap is pushed out to us telling us what a great deal it is. Look at the amount of money that the sheetmetal workers pay their VP''s as opposed to what the UTU pays theirs. 43,000 to 137,000 no wonder they still have a treasury. Then look at the amount of money they pay their International Reps. They get 108,000 and there are a bunch of them and now they want to turn the rest of our VP''s into these International Reps and Organizers. Looks like another windfall for the administration. What about UTUIA?? That stays separate but pays salaries for the top 6 officers going over to SMART......sure sounds stupid to me. VOTE NO for STUPID!!

Once the transfer of work is completed in August 2009, the Jacksonville operation will employ about 54 train dispatchers.

Jacksonville-based CSX has four dispatch centers, located in the Midwest and East Coast, responsible for routing trains along its tracks. Most dispatchers have been concentrated in Jacksonville since 1988, when the company established a centralized operating facility that oversees the entire network.

The relocation will improve the productivity and efficiency of train dispatching operations, CSX spokesman Gary Sease said Friday.

"We're taking these dispatching functions out of headquarters," Sease said, "and putting them into field offices, closer to where the train operations occur."

The realignment will result in more effective and efficient decision-making, improved system reliability and improved train performance, CSX said in a notice to train dispatchers.

While train dispatchers - who, on average, make nearly $35 an hour, or almost $73,000 annually - will be mostly affected by the relocation of work, about 25 local signalmen would also see their jobs moved. Signalmen, among other things, maintain the dispatching equipment and respond to problems with railroad crossing signals and gates. About 10 percent of the affected workers are in management.

Workers will be offered jobs in the new locations, Sease said.

Now I get it! I knew it wouldn't take me long to figure out why Thompson really wanted the SMART merger. I also understand why the Board of Directors came on-board so quick.

The following quote is Section 10 of the SMWIA Constitution:

SECTION 10--RESPONSIBILITY

"SEC. 10. It is the obligation and responsibility of every officer, member, local union and council of this Association, to comply with the provisions of this Constitution and the valid decisions of the officers of this Association in conformity therewith and they shall refrain from any conduct which interferes with the performance by the Association or its subordinate units of their obligations under law or contract or from any conduct which defeats or is designed to defeat or subvert the lawfully declared and established policies and objectives of this Association, or which may defame it or any of its officers, members or subordinate units." (Emphasis Mine)

From the above it appears that the SMWIA have adopted a military codes of conduct that requires every member to march in lockstep as order by their superior officers. The problem with an army, by definition, there is no democracy. There is no legitimate reason to move from a union that permits free speech and the organized efforts of officers and members to dissent to a union that specifically prohibits it.

The UTU Constitution once had a similar restriction against speaking out, however it was removed from our Constitution. Obvisouly, we now have a very important conflict between our UTU Constitution and the SMWIA Constitution. If for no other reason than to protect their right to speak out, the Members should vote "NO" to the merger..

If the merger passes, MAC (Members of Corruption) would have to fold-up shop and go home. I would have to take down MAC's web site, my Reformit2004 web site, and my campaign web site and learn how to bit my tongue like everyone else.

I happen to enjoy my right and my responsibility to defame certain officers, members, and subordinate units, when the need arises to do so. As a matter of fact and record, our officers enjoy this right as well.

"Refrain from any conduct"? Now I understand why the members of the Sheetmetal Workers were not allowed to vote on the merger. What good would it do for a member to have an opinion opposing the merger? If a member did disagree, they must "refrain from any conduct" that might allow them to protest or ask questions.

Note: At the 41st General Convention of the SWMIA (2004), President Sullivan, GS&T Kelly and 11 members of the General Executive Council were returned to office by the delegates for another five (5) year term (UTU has a four (4) year term). While the delegates could have nominated other candidates, none were nominated? Sweet deal for the officers - opposition permitted, but no dissention?

Under the SMART Constitution I would not be able to hand MAC booklets or my campaign literature, as both are full of defaming comments about the leadership of the UTU and how our leaders have failed to fulfill the objectives of our UTU. The delegates wouldn't be able to discuss Thompson's, Hakey's, Johnson's, or Futhey's involvement in the "UTU Enterprise", or speak to concerns about Babler's per diem. I just think that stinks. If the merger passes it's good thing the merger won't go into effect until January 1, 2008.

One small step (forward) for the officers of SMART, one big step (backwards) for the UTU Membership.

Under HR 676, Medicare would be extended and improved so that all individuals residing in the United States would receive high quality and affordable health care services. They would receive all medically necessary services by the physicians of their choice, with no restrictions on what providers they could visit. If implemented, the United States National Health Insurance Act would cover primary care, dental, mental health, prescription drugs, and long term care.
