SEC. 3(b). Number and Qualifications of Delegates. Each local union shall be entitled to one (1) delegate to its District Council convention for the first fifty (50) good standing members or less and one (1) additional delegate for each additional fifty (50) members or majority fraction thereof. Local unions affiliated with more than one District Council shall be entitled to delegate representation at conventions of each District Council with which it is affiliated. The number of delegates shall be based upon the number of members in such local union over whom each District Council has jurisdiction. No member shall be eligible for nomination or election as a delegate unless he or she meets the qualifications described in Section 3 of Article Twelve (12) of this Constitution.

The UTU Constitution, which will become Article 21B of the SMART Constitution, provides that the salary and expenses of the local delegate will be paid by the international. The SMWIA constitution, the controlling document, grants the "authority" to each local to pay whatever salary they determine their delegate should receive for his/her service at the convention.

SEC. 9. Each local union shall have authority to pay such salaries as it may determine for services rendered by the local union officers, business manager, business representatives, delegates,representatives and members.

Remuneration or salary due officers, business manager, business representatives, delegates, representatives, or members for services or expenses shall be paid to them from the local union treasury by check.

Potential problem? Many of our UTU locals, large and small, do not have the local funds to finance the participation of a delegate at the convention. I guess this where we go back to the practice of having our DLC pay for the delegates they want to attend?

I don't see how many organization can represent a body of people until their delegates are present. This is unfair. I vote NO to the merger and if UTU needs to cut back on expenses then they need to get rid of the fat at the top and consider cutting the Regioanl Meetings and have just one conference in Cleveland for a couple of days and not spread over more than 3 days, including Sunday, max.

GARDEAU, Pa. — A year ago today, a Norfolk Southern engineer from Buffalo slowly took a freight train up Keating Summit, and then raced down into an environmental disaster, a derailment that caused millions of dollars in damages, killed thousands of fish, and endangered one of Pennsylvania’s finest trout streams.

On a descent so steep the track speed limit is only 15 mph, engineer Michael Seifert’s train never slowed as it cleared the summit, hitting a top speed of 77 mph on its wild, roller coaster trip to the bottom.

Seifert, 46, a Norfolk Southern engineer for eight years, failed a drug test after the derailment. He tested positive for opiate-based pain killers as well as the class of drug found in Valium.

He was fired by Norfolk Southern and is scheduled to go on criminal trial in July in Smethport, about 120 miles southeast of Buffalo. He is charged with two felony counts of causing a catastrophe, and a misdemeanor charge of reckless endangerment.

Thirty-two of the 44 cars in Seifert’s train jumped the tracks because of excessive speed and operator error, the Federal Railroad Administration said. The derailed cars included four tankers carrying sodium hydroxide, also known as caustic soda or lye, an ingredient found in drain cleaners.

A nearly $3 million environmental cleanup by Norfolk Southern is almost complete, and local officials are hopeful the trout streams here, a large part of the local economy, will not suffer any permanent damage. The railroad is appealing $8.9 million in penalties the state assessed.

The environmental damage was caused by 42,000 gallons of sodium hydroxide that was dumped into Big Fill Hollow and carried downstream to Sinnemahoning Portage Creek, a Class A trout stream in its upper reaches that attracts fishermen from throughout the Northeast.

The sodium hydroxide slowly made its way downstream, killing everything in its wake.

“Big fish were jumping out of the water, something they do when they’re distressed,” said Jim Zoschg, a local fisherman and Cameron County conservation official at the time. “I

found dead fish 35 miles downstream.”

Laura Haynes, the landowner nearest the derailment, said the smell from the chemical was so intense that her daughter Peggy had trouble breathing.

“He must have been flying,” she said of Seifert, as she surveyed the cleanup of her property on Thursday. “Because most of those trains just creak down that hill.”

Witnesses said the sodium hydroxide came downstream in a white foam, then turned the water a chocolate color as the chemical leeched out soils along stream banks, leaving thousands of dead trout, bass, and other fish along the way.

“They didn’t find any dead fish right at the scene of the spill,” said Todd Deluccia, a watershed specialist in nearby Cameron County. “The thinking was that the chemical was so concentrated there, the fish just disintegrated.”

The train’s conductor, Stev an Rogers of Buffalo, also was fired along with Seifert by Norfolk Southern, but was not charged criminally. Both men are appealing their dismissals.

Neither Seifert nor Rogers was injured, because the three locomotives and the first several rail cars made it safely to the bottom. Nor were any nearby residents injured, though more than 20 were evacuated because one of the derailed tank cars carried chlorine. It did not rupture.

Seifert could not explain what happened when he testified last July 16-17 at a Norfolk Southern disciplinary hearing on the derailment.

“My last recollection was cresting the hill, with the train out of control,” said Seifert, who as engineer sat behind the controls on the left side of the lead locomotive.

The next thing he knew, Seifert said, was that Rogers, the train conductor seated on the right side of the locomotive, was shouting his name, “Mike, Mike.”

“When you were cresting the summit, did you fall asleep?” a Norfolk Southern supervisor asked Seifert at the hearing.

“It’s possible,” he said. “I do believe I asked (Rogers) and he said my eyes were open, just staring straight. He just kept calling my name.”

“Did you fear for your life?” the supervisor asked.

“I feared for both of our lives, sir,” Seifert responded.

Seifert testified that when he came to his senses, he decided the best course was to try to ride it out, as he said he had done once before when he was a trainee and part of a Norfolk Southern program making test runs on Keating Summit in 2000. That time, he said, the train hit 70 mph without incident.

Seifert’s urine and blood tests, according to the court file, showed that shortly after the derailment, he tested positive for opiates, the class of drugs found in prescription painkillers, and diazepam, a type of benzodiazepine and the drug found in Valium.

McKean County District Attorney John Pavlock accused Seifert of being “under the influence of controlled substances.” A Federal Railroad Administration report said Seifert’s “recent or chronic use of unauthorized opiates and benzodiazepine may have contributed to the cause of the accident.”

Seifert testified at his railroad hearing that he had been under a lot of stress because of a divorce and had been sleep deprived and depressed prior to the accident. He said he had seen a psychotherapist afterward, but had not yet been prescribed any drugs.

Seifert has recently moved, disconnected his phone, and could not be reached to comment. His attorney, Paul Malizia, of Emporium, did not return telephone calls and was unavailable Thursday when a reporter stopped at his office.

Norfolk Southern estimated the derailment caused $934,000 in equipment damage and $1.2 million in loss of cargo. Wall board, lumber and aluminum were scattered in the crash.

The railroad said it has removed and replaced 4,600 cubic yards of contaminated soil, restored sections of Big Fill Hollow and Sinnemahoning Portage Creek, planted thousands of trees and wetland grasses, installed ground water monitoring wells, and tested more than 100 residential water sources.

Zoschg, the former watershed specialist, and his replacement, Deluccia, took a News reporter on a tour of the derailment site Thursday, pointing out the return of young trout, minnows and tadpoles to the cleaned-up stream. There were also bugs flying above the creek, a good sign to both.

“There wasn’t a single insect up here last year,” Deluccia said.

and publisher of the weekly Endeavor News in Emporium, said it was impossible to gauge the economic impact from the loss of fishing last summer after the derailment. But he said it turned out to be less a disaster than everyone thought at the time.

“To see how deadly it was, was simply amazing,” said Hooftallen, whose paper’s front page last week showed a young man holding a 25-inch brown trout he caught. “The rebound has been incredible.”

GARDEAU, Pa. — A year ago today, a Norfolk Southern engineer from Buffalo slowly took a freight train up Keating Summit, and then raced down into an environmental disaster, a derailment that caused millions of dollars in damages, killed thousands of fish, and endangered one of Pennsylvania’s finest trout streams.

On a descent so steep the track speed limit is only 15 mph, engineer Michael Seifert’s train never slowed as it cleared the summit, hitting a top speed of 77 mph on its wild, roller coaster trip to the bottom.

Seifert, 46, a Norfolk Southern engineer for eight years, failed a drug test after the derailment. He tested positive for opiate-based pain killers as well as the class of drug found in Valium.

He was fired by Norfolk Southern and is scheduled to go on criminal trial in July in Smethport, about 120 miles southeast of Buffalo. He is charged with two felony counts of causing a catastrophe, and a misdemeanor charge of reckless endangerment.

Thirty-two of the 44 cars in Seifert’s train jumped the tracks because of excessive speed and operator error, the Federal Railroad Administration said. The derailed cars included four tankers carrying sodium hydroxide, also known as caustic soda or lye, an ingredient found in drain cleaners.

A nearly $3 million environmental cleanup by Norfolk Southern is almost complete, and local officials are hopeful the trout streams here, a large part of the local economy, will not suffer any permanent damage. The railroad is appealing $8.9 million in penalties the state assessed.

The environmental damage was caused by 42,000 gallons of sodium hydroxide that was dumped into Big Fill Hollow and carried downstream to Sinnemahoning Portage Creek, a Class A trout stream in its upper reaches that attracts fishermen from throughout the Northeast.

The sodium hydroxide slowly made its way downstream, killing everything in its wake.

“Big fish were jumping out of the water, something they do when they’re distressed,” said Jim Zoschg, a local fisherman and Cameron County conservation official at the time. “I

found dead fish 35 miles downstream.”

Laura Haynes, the landowner nearest the derailment, said the smell from the chemical was so intense that her daughter Peggy had trouble breathing.

“He must have been flying,” she said of Seifert, as she surveyed the cleanup of her property on Thursday. “Because most of those trains just creak down that hill.”

Witnesses said the sodium hydroxide came downstream in a white foam, then turned the water a chocolate color as the chemical leeched out soils along stream banks, leaving thousands of dead trout, bass, and other fish along the way.

“They didn’t find any dead fish right at the scene of the spill,” said Todd Deluccia, a watershed specialist in nearby Cameron County. “The thinking was that the chemical was so concentrated there, the fish just disintegrated.”

The train’s conductor, Stev an Rogers of Buffalo, also was fired along with Seifert by Norfolk Southern, but was not charged criminally. Both men are appealing their dismissals.

Neither Seifert nor Rogers was injured, because the three locomotives and the first several rail cars made it safely to the bottom. Nor were any nearby residents injured, though more than 20 were evacuated because one of the derailed tank cars carried chlorine. It did not rupture.

Seifert could not explain what happened when he testified last July 16-17 at a Norfolk Southern disciplinary hearing on the derailment.

“My last recollection was cresting the hill, with the train out of control,” said Seifert, who as engineer sat behind the controls on the left side of the lead locomotive.

The next thing he knew, Seifert said, was that Rogers, the train conductor seated on the right side of the locomotive, was shouting his name, “Mike, Mike.”

“When you were cresting the summit, did you fall asleep?” a Norfolk Southern supervisor asked Seifert at the hearing.

“It’s possible,” he said. “I do believe I asked (Rogers) and he said my eyes were open, just staring straight. He just kept calling my name.”

“Did you fear for your life?” the supervisor asked.

“I feared for both of our lives, sir,” Seifert responded.

Seifert testified that when he came to his senses, he decided the best course was to try to ride it out, as he said he had done once before when he was a trainee and part of a Norfolk Southern program making test runs on Keating Summit in 2000. That time, he said, the train hit 70 mph without incident.

Seifert’s urine and blood tests, according to the court file, showed that shortly after the derailment, he tested positive for opiates, the class of drugs found in prescription painkillers, and diazepam, a type of benzodiazepine and the drug found in Valium.

McKean County District Attorney John Pavlock accused Seifert of being “under the influence of controlled substances.” A Federal Railroad Administration report said Seifert’s “recent or chronic use of unauthorized opiates and benzodiazepine may have contributed to the cause of the accident.”

Seifert testified at his railroad hearing that he had been under a lot of stress because of a divorce and had been sleep deprived and depressed prior to the accident. He said he had seen a psychotherapist afterward, but had not yet been prescribed any drugs.

Seifert has recently moved, disconnected his phone, and could not be reached to comment. His attorney, Paul Malizia, of Emporium, did not return telephone calls and was unavailable Thursday when a reporter stopped at his office.

Norfolk Southern estimated the derailment caused $934,000 in equipment damage and $1.2 million in loss of cargo. Wall board, lumber and aluminum were scattered in the crash.

The railroad said it has removed and replaced 4,600 cubic yards of contaminated soil, restored sections of Big Fill Hollow and Sinnemahoning Portage Creek, planted thousands of trees and wetland grasses, installed ground water monitoring wells, and tested more than 100 residential water sources.

Zoschg, the former watershed specialist, and his replacement, Deluccia, took a News reporter on a tour of the derailment site Thursday, pointing out the return of young trout, minnows and tadpoles to the cleaned-up stream. There were also bugs flying above the creek, a good sign to both.

“There wasn’t a single insect up here last year,” Deluccia said.

and publisher of the weekly Endeavor News in Emporium, said it was impossible to gauge the economic impact from the loss of fishing last summer after the derailment. But he said it turned out to be less a disaster than everyone thought at the time.

“To see how deadly it was, was simply amazing,” said Hooftallen, whose paper’s front page last week showed a young man holding a 25-inch brown trout he caught. “The rebound has been incredible.”

With huge amounts of money at stake it's entirely possible that the drug test results were manufactured. The railroads are desperate to keep this fatigue thing hidden and are notoriously unscrupulous in their dealings. They are also desperate to keep quiet the numbers of substandard individuals they have been forced to hire in recent years. And eveyone on the railroad knows that any drug use at any time-even on vacation- will subject them to instant dismissal and possible criminal charges if things go wrong. I cannot imagine any T or E taking such a terrible risk. But it is possible that there are some people in the ranks stupid enough to use illegal drugs and maybe Mr Siefert is such a case.

According to Heather Hollingsworth of the AP, Madden, an Iraq veteran, drew the accusations recently, after making what the Corps called

"disloyal statements" during a speech in February in New York in which he accused President Bush of betraying service members and called the fighting in Iraq a "war crime."

When push came to shove this week, the Marines had a choice to make: either charge one of their own for slamming the President, or let Madden slide, in essence giving the case a big shrug.

How to Get Rid of Mexicans

When it comes to getting rid of Mexicans, you may feel like it is all out war. Before we get into how to get rid of Mexicans, it will prove useful to understand your adversary. What causes Mexicans to choose your towns and cities to live it? What do they eat? How do you get them to leave?

You may think your home is clean, and indeed, it may be. However, if Mexicans smell beans in bags or tortilla chips , they will simply gnaw a hole in the bag or box and have dinner. They will also go after dog, making no distinction between domestic or wild.

So, now you know where they live and what they eat. Now comes the important part: how to get rid of Mexicans.

The first thing to keep in mind is to not invite them to your home in the first place. Simple steps will keep the Mexicans away. For instance, keep your grass cut short and flower beds weeded, be sure to keep tight fitting lids on trashcans. Simple!

If you don’t know you have a problem until you see signs of Mexicans, such as droppings, then you will have to go on the defense. The one thing to remember is that if you are getting rid of Mexicans, it is a Mexi-trap you need. This may sound obvious, but some people may think that a rattrap will do the job. It will not. Mexicans are much bigger and harder to catch and will require the beefed up spring that is in a Mexi-trap. You can buy the classic snap trap in hardware stores.

The first thing you need to do is bait the trap. Use a piece of produce such as open can of refried beans, also, salsa or tortilla chips will work. Then, put the trap in a secure place to prevent a caught Mexican from dragging it away. Finally, place the Mexi-trap were you have seen droppings; making sure non-target animals and children cannot get hurt.

Once you have found a Mexican in the trap, wrap it in newspaper and then put in a tightly covered immigration bin. Always use gloves when handling Mexicans.

A 2 ˝-hour JetBlue Airways flight bound from Fort Lauderdale to New York on Wednesday turned into a 25-hour odyssey that finally ended Thursday afternoon, as a chain of problems left 150 passengers staggered by the mind-boggling delay.

The cascade of problems occurred just four months after a disastrous five-day period in February when the airline canceled more than 1,000 flights in the New York area. And it again raises questions about how much of the blame should fall on airlines when flights encounter unexpected delays.

Flight 62's takeoff at 2:30 p.m. Wednesday was delayed for three hours. The jet departed, only to be diverted by bad weather to Atlantic City, N.J., where passengers stewed on the tarmac for four hours. At 12:30 a.m. Thursday, they were allowed off the plane. It would be another four hours until they finally were sent to a hotel for the night. The flight ultimately arrived at JFK International Airport at 3:21 p.m. Thursday.

"It's a nightmare here," said Boris Shuserman, 61, of Hallandale Beach, as he waited Thursday afternoon in the departure lounge of the Atlantic City International Airport.

JetBlue said it would issue a full refund to Flight 62 passengers and would also give them free round trip vouchers.

All airlines have unlucky flights, but JetBlue has been under the gun since February when an ice storm in New York led to thousands of passengers becoming stranded for days. The airline paid $20 million to $30 million in compensation under a "bill of rights" unveiled in March, but it wasn't enough to save founder David Neeleman from being replaced in May as chief executive officer. Since then, the airline's performance has been mixed. It had the second-lowest on-time arrival rate in April of 20 carriers tracked by the U.S. Department of Transportation. Only 64.8 percent of its flights were on time, compared with an industry average of 75.7 percent. But earlier this month, it was rated ahead of all other low-fare carriers in J.D. Power & Associates' annual customer satisfaction survey.

Flight 62 passengers said an already bad situation was made worse by the lack of customer service in Atlantic City.

Azim Khan, of Fort Lauderdale, said he felt abandoned by JetBlue's representatives there. Kahn said that upon landing around 8:30 p.m. passengers were told that buses would soon arrive to transfer them to JFK. The promised buses never came.

Passengers ultimately took taxis at their own expense to a nearby hotel where JetBlue had secured rooms for the night, he said. The taxi fares will be reimbursed.

For the remainder of the night, Khan and others went without food because nearby restaurants already had closed. Les Raye, 60, of Davie, said JetBlue should have made better provisions.

"I don't think I've ever gone through anything like this in my many years of flying," Raye said.

JetBlue has a "bill of rights" that entitles passengers to discounts on future flights for delays under certain conditions. Stories of marooned passengers on other carriers, including Northwest Airlines and American Airlines, have also prompted talk in Congress of legislation.

JetBlue spokesman Todd Burke said Thursday's situation was very unusual. Storms had caused multiple JetBlue delays on the East Coast and led several planes to divert to Atlantic City, where it normally does not fly.

With no ground crew or staff in Atlantic City, the airline's contracted representatives did their best to locate buses for the trip to JFK. But after calling several casinos and about 45 bus companies, they found none could do the job, Burke said.

Stuart Klaskin, an aviation consultant in Coral Gables, said landing where it had no operations was Jet Blue's key mistake.

"It might have been better to divert to a different airport where they could have better accommodated [passengers]," he said.

Klaskin said JetBlue actually is following the public's wishes by trying to fly even if the weather causes delays.

"People would rather go than be canceled," he said.

Other airlines take a different tack. On Thursday, Delta Air Lines canceled 200 flights, or about one-third of its flights from the Northeast, because of heavy storms and expected delays. Delta said it made an early call to cancel the flights in hopes of giving at least 12 hours' notice to passengers via e-mail and cell phone messages.

Police: Diabetic Man Missing After Being Kicked Off Train

PHOENIX - A 65-year-old St. Louis man went missing outside Williams, Ariz., after he was kicked off an Amtrak train in the middle of a national forest, Williams police said.

Police said Roosevelt Sims was headed to Los Angeles but was asked to leave the train shortly before 10 p.m. Sunday at a railroad crossing five miles outside Williams.

Police said there is no train station or running water at the crossing, which is about two miles from the nearest road.

Amtrak personnel told police dispatchers that Sims was drunk and unruly.

The Sims family said Sims is diabetic and was going into shock.

Sims' family said Sims tried to call them from his cell phone that night, but was incoherent.

When officers arrived at the crossing, police said, Sims ran into the woods, leaving his luggage and medication behind.

Cell phone records show that Sims' phone was last used in Litchfield Park, Ariz., 180 miles from Williams.

Williams police told CBS 5 that Amtrak has used the abandoned crossing as a drop-off site in the past. Lt. Mike Graham said that whether drunk or not, no one should be dropped off there.

Amtrak said the company is looking into the matter.

Sims' brother told CBS 5 that all his family wants is to find Sims.

"I'm not mad at anybody," Brian Mason said. "As long as he's OK, that's the most important thing right now."

WASHINGTON (AP) -- The Senate drove a stake Thursday through President Bush's plan to legalize millions of unlawful immigrants, likely postponing major action on immigration until after the 2008 elections.

After the stinging political setback, Bush sounded resigned to defeat.

"Legal immigration is one of the top concerns of the American people, and Congress' failure to act on it is a disappointment," he said after an appearance in Newport, R.I. "A lot of us worked hard to see if we couldn't find common ground. It didn't work."

The bill's Senate supporters fell 14 votes short of the 60 needed to limit debate and clear the way for final passage of the legislation, which critics assailed as offering amnesty to illegal immigrants. The vote was 46 to 53 in favor of limiting the debate.

Some senators in both parties said the issue is so volatile that Congress is unlikely to revisit it this fall or next year, when the presidential election will increasingly dominate American politics. t

Bush appeared glum as he spoke. His negotiators had expressed optimism the vote would go their way - or, at least be closer.

"Congress really needs to prove to the American people that it can come together on hard issues," Bush said. He turned attention to other his other goals in Congress this year, including energy, health care and balanced-budget initiatives.

Last year a similar immigration effort collapsed in Congress, and the House has not bothered with an immigration bill this year, awaiting Senate action.

The vote was a defeat for a bipartisan group of lawmakers who advocated the bill as an imperfect but necessary fix of current immigration practices in which many illegal immigrants use forged documents or lapsed visas to live and work in the United States.

It was a victory for Republican conservatives who strongly criticized the bill's provisions that would have established pathways to lawful status for many of the estimated 12 million illegal immigrants. They were aided by talk radio and TV hosts who repeatedly attacked the bill and urged listeners to flood Congress with calls, faxes and e-mails.

Voting to allow the bill to proceed by ending debate were 33 Democrats, 12 Republicans and independent Joe Lieberman, Conn. Voting to block the bill by not limiting debate were 37 Republicans, 15 Democrats and independent Bernard Sanders, Vt. Tim Johnson, D-S.D., did not vote.

The bill would have toughened border security and instituted a new system for weeding out illegal immigrants from workplaces. It would have created a new guest worker program and allowed millions of illegal immigrants to obtain legal status if they briefly returned home.

Bush, making a last-ditch bid to salvage the bill, called senators early Thursday morning to urge their support. Homeland Security Secretary Michael Chertoff and Commerce Secretary Carlos Gutierrez approached senators as they entered and left the chamber shortly before the vote.

But conservatives from Bush's own party led the opposition. They repeatedly said the government must secure the borders before allowing millions of illegal aliens a path to legal status.

Sen. Elizabeth H. Dole, R-N.C., said many Americans "don't have confidence" that borders, especially with Mexico, will be significantly tightened. "It's not just promises but proof that the American people want," Dole said.

But the bill's backers said border security and accommodations to illegal immigrants must go hand in hand.

"Year after year, we've had the broken borders," said Sen. Edward Kennedy, D-Mass. "Year after year, we've seen the exploitation of workers."

After the vote, he said: "It is now clear that we are not going to complete our work on immigration reform. That is enormously disappointing for Congress and for the country." Kennedy, a chief proponent of the bill, said, "we will be back. This issue is not going away."

But before the vote, Sen. Dianne Feinstein, D-Calif., told colleagues the political climate almost surely would not allow a serious reconsideration until 2009 or later. It would be highly unlikely, she said, "in the next few years to fix the existing system ... . We are so close."

From the beginning, the bill's most forceful opponents were southern Republicans. GOP Sens. David Vitter of Louisiana, Jim DeMint of South Carolina and Jeff Sessions of Alabama led the charge, often backed by Texan John Cornyn.

Two southern Republicans - Lindsey Graham, S.C., and Mel Martinez, Fla., who was born in Cuba - supported it.

Also crucial to the bill's demise was opposition from three Democrats recently elected from GOP-leaning states: Jon Tester of Montana, Claire McCaskill of Missouri and Jim Webb of Virginia.

All the Democratic presidential candidates in the Senate voted to end debate and advance the bill. Among the Republican candidates, only Sen. John McCain of Arizona voted to keep the measure alive. Sen. Sam Brownback, R-Kan., at first voted with McCain, but switched his vote when it was clear the bid to end debate would fail.

Sessions said on the Senate floor after the vote that Americans "are not mean-spirited, but they are concerned about a lawful system of immigration."

DeMint told reporters, "I think the only victory here is for the American people and, symbolically, a government of the people and for the people. The people responded to this issue in a very emotional and just a very engaged way, which changed the minds of many people here in the Senate."

DeMint said he hoped "we'll proceed with the security and enforcement aspects of this bill, and that will pave the way of how we solve some of the other problems."

WASHINGTON (AP) -- The Supreme Court on Thursday abandoned a 96-year-old ban on setting price floors in a case involving a labor union and railroads.

In a 5-4 decision, the court said that agreements on minimum prices are legal if they promote competition. The Brotherhood of Locomotive Engineers and Trainmen had brought the case to defend its right to establish lower wage rates in collaboration with railroad management.

The United Transportation Union opposed the agreement arguing it improper collusion between labor and management. But the conservative court sided with the BLET and management and said that if the railroads and its labor union of engineers want to collaborate to lower wage rates that it is lawful.

BLET President Don Hahs praised the decision as did BNSF Railway CEO Matt Rose.

Profiling White Collar Criminals

INTELLIGENCE ANALYSIS OF WHITE COLLAR CRIME

White collar crime is the illegal activities of people and organizations whose acknowledged purpose is profit through legitimate business enterprise. White collar crime involves illegal business practices (embezzlement, price-fixing, bribery) with merchandise that is ordinarily seen as a legitimate business product. Normally, the FTC investigates telemarketing fraud, and the SEC investigates securities fraud. Trust violations are jointly investigated by the FBI and FTC. In the late 1930s, criminologist Edwin Sutherland first coined the term "white collar crime" to describe the criminal activities of the rich and powerful. He defined it as "a crime committed by a person of respectability and high social status in the course of his occupation." As Sutherland saw it, the rich were engaged in a conspiracy to use their position for personal gain without regard to the law. Today, it is recognized that persons in all social classes can commit white collar crimes, but the notion of getting away with disregard for the law still exists in the justice system's tendency to treat these offenses as civil rather than criminal matters. It is the generally accepted wisdom in criminology that although Sutherland's definition fall short in some ways, the underlying constructs of what he meant -- deception and lack of physical force -- remain constant, even while forms of the crime evolve. The NW3C definition is considered a good 2005 update: "white collar crimes are defined as illegal or unethical acts that violate fiduciary responsibility or public trust for personal or organizational gain." The Edelhertz (1970) typology includes: (1) crimes against government by public officials; (2) crimes against government by private citizens; (3) crimes against businesses; (4) crimes against investors; (5) crimes against consumers; (6) crimes against employees; and (7) crimes affecting public health. The Green (1990) typology includes: (1) crimes for the benefit of one's employer; (2) crimes by government officials; (2) crimes by professionals in the course of doing business; and (4) crimes by individuals in the course of their occupation. Other typologies exist, such as the following:

Corporate crime -- Usually occurs when a strongly competitive business environment fosters corporate irregularities (antitrust violations, price-fixing, false advertising)

Government crime -- illegal and socially injurious cooperation between governments and corporate institutions (space shuttle disasters)

Occupational crime -- Usually occurs when employees come across an opportunity to make extra money by bending or breaking the rules (theft, pilfering)

Professional crime -- people or groups of people who systematically set out to look for opportunities to make money illegally (fraud, tax evasion, deceitful claims, phantom operations, false pretenses, forgery)

There have been numerous attempts to create typologies of white collar crime. One such typology is the following:

A typology of white collar crime:
1. Stings and Swindles -- pretending to run a business (or religion) in order to bilk people out of their money (e.g. Bank of Credit and Commerce International, or BCCI, in 1991 was believed to be the world's 7th largest bank, but it turned out to be a money laundering facility for Ferdinand Marcos, Saddam Hussein, and Columbian drug cartels)
2. Chiseling -- regularly cheating an organization, its customers, or both (e.g. padding the company expense account, charging for bogus auto repairs, securities fraud, insider trading)
3. Exploitation -- threatening to withhold a service unless an additional payment (bribe) is forthcoming (e.g. business license permits, fire safety inspections)
4. Influence peddling -- when people holding important positions sell power, influence, and information to outsiders who have an interest in the outcome of an activity (e.g. kickbacks, point shaving, election rigging, police corruption, ABSCAM, Operation Greylord, corporate payments to leaders of foreign nations)
5. Embezzlement -- use of a person's fiduciary position to appropriate company money or property for themselves (e.g. pilferage, checkout counter fraud, false raises and bonuses, phantom employees, concealing unacceptable information from stockholders)
6. Client Fraud -- cheating an organization with many individual clients that the organization supports (like welfare or disability assistance), reimburses (like health care providers or Medicare), covers losses of (like insurance companies), or extends credit to (like banks or finance companies)
7. Corporate Crime -- aka organizational crime, socially injurious acts designed to harm the public, the environment, or a company's workers; a corporation cannot be held criminally liable - the executives can if it can be proven they acted within the scope of their employment and had the authority to initiate the harmful activity (violations of the Sherman Antitrust Act, OSHA and Environmental Crimes)
8. Computer Crime -- includes Internet fraud, Internet pornography, use of computers for theft, destruction, or harassment

SECURITIES LAW VIOLATIONS

Part 15 U.S.C. Sections 77a-78kk contains the Securities Act (originally passed in 1933 and amended numerous times). It prohibits the use of "manipulative or deceptive devices, mail or wire fraud, making false statements in order to increase market share, conspiracy, and unfair market practices." Some common forms of securities fraud include: churning -- when brokers place repeated, excessive, unnecessary orders for the buying and selling of stock with a customer's money; bucketing -- skimming customer profits by falsifying trade information; front running -- placing orders ahead of a customer's order to profit from market effects of the trade; insider trading -- using confidential, market sensitive information of pending corporate actions to buy stock or give that information to a third party; and illegal arbitrage -- using insider information on such deals as merger negotiations to speculate on the difference between current stock prices and the price the acquiring company pays.

FORMS OF CLIENT FRAUD

Health care fraud includes: ping-ponging -- referring clients to other physicians in the same office; gang-banging -- billing for multiple services; and steering -- directing patients to certain pharmacies. The 1993 Stark laws (named after Congressman Pete Stark of California ) also prohibit any doctor from sending a patient to any service the doctor has invested in.

Basic bank fraud includes check kiting -- where a client with accounts in two or more banks takes advantage of the time required for checks to clear; e.g. you have $5000 in one bank and $50 in another bank; so the second bank (because you're a member) cashes a check for you for $3000 drawn on your account at the first bank, but before the check clears, you withdraw or write additional checks depleting the original $5000, so your "take" is $8000 or more. Check kiting works best when it involves banks in separate states or countries.

Tax evasion is either passive neglect (a misdemeanor) or affirmative (a felony). Signs of affirmative tax evasion include keeping double books, false entries, destruction of records, and covering up sources of income. Moonlighting workers who get paid "under the table" are determined on a case-by-case basis by the IRS if they are passive or affirmative.

THE SAVINGS AND LOAN SCANDAL

From 1980 to 1990, the savings and loan (S & L) scandal cost taxpayers over $500 billion, the largest single financial disaster in history. It will take about 40 years to recover from it. It started when the government decided to "deregulate" S & Ls, allowing them to do more than just home loans, allowing them to invest in speculative real estate transactions and high-risk commercial lending. In order to compete with the regular commercial banks, the S & Ls offered low-interest loans to just about anybody, and worse yet, restrictions were relaxed on who could own and operate an S & L. Given this green light, they made irresponsible loans to shady businesspeople and risky real estate developers. Sometimes kickbacks accompanied the loans. As most of the banks headed into bankruptcy, many executives, believing that FDIC would cover their customer's losses, "looted" the remaining funds to throw lavish Christmas parties, redecorate their homes, refurbish their offices, purchase airplane fleets, etc. The land bought by the banks was continuously "flipped", or regularly remortgaged, to drive up the assessed valuation, then sold in "reciprocal lending" to another S & L in an illegal industry profit-sharing scheme. The S & Ls also made loans to one another ("linked financing") that were never intended to be paid off.

SHERMAN ANTITRUST ACT

Trusts and monopolies are concentrations of wealth in the hands of a few. Such conglomerations of wealth are injurious to the public because trusts minimize, if not obliterate normal marketplace competition, and yield undesirable price controls. These, in turn, cause markets to stagnate and sap individual initiative. To prevent trusts from creating restraints on trade or commerce, and reducing competition, Congress passed the Sherman Antitrust Act in 1890. The Sherman Act was designed to maintain economic liberty, and to eliminate restraints on trade and competition. The Sherman Act is the main source of Antitrust law. It outlaws conspiracies between corporations designed to control the marketplace.

Four kinds of market conditions are considered anticompetitive: (1) a division of markets -- where firms divide a region into territories, each promising not to compete in one another's territory; (2) a tying arrangement -- in which a company requires its customers to use some other service it offers; (3) group boycotts -- in which a company boycotts retail stores that do not comply with its rules or desires; and (4) price-fixing -- in which the price of a commodity is set or controlled via a conspiracy.

Price-fixing may take one of four forms: (1) predation -- in which large firms agree to sell low to drive our weaker firms; (2) identical bidding -- in which bidders all agree to submit identical bids for a contract; (3) geographic market sharing -- which divides markets into territories among companies to fix prices and (4) rotational bidding -- in which the winning bid is rotated among a group of companies for lucrative contracts.

OSHA & ENVIRONMENTAL CRIMES

The control of workers' safety has been the province of the Occupational Safety and Health Administration (OSHA). The agency sets industry standards for the proper use of chemicals, and invokes criminal penalties on violators. It has been estimated that 21 million workers are regularly exposed to hazardous materials while on the job. It would cost $40 million to alert these workers, and $50 to track whether or not they develop diseases. Industries that have been hard hit include the asbestos and cotton industries.

Pollution is another problem. Sometimes pollution involves negligence and other times it is deliberate. The Union Carbide disaster in 1984 in Bhopal, India killed 10,000 people and injured another 60,000, and was determined to be negligence. The Exxon Valdez spill in 1989 fouled 700 miles of shoreline, and resulted in $1 billion in criminal and civil fines. This was the largest amount paid in history for environmental pollution. There are a number of recent Environmental Laws:

The Clean Air Act (1990) -- give EPA power to impose penalties on anyone knowingly violating EPA standards

The Clean Water Act (1990) -- punishes knowing or negligent discharge of pollutant into navigable waters

The Refuse Act (1899) -- punishes waste discharge that damages water quality anywhere

The Resource Conservatory Act (1976) -- provides criminal penalties for storage or disposal of any solid waste without a permit

The Toxic Substance Act (1988) -- prohibits manufacture or distribution of any chemical substance in a manner not in accordance with required testing or manufacturing requirements

The Insecticide, Fungicide & Rodenticide Act (1988) -- regulates the manufacture and distribution of pesticides

The Superfund Act (1988) -- requires the cleanup of hazardous waste at contaminated sites

COMPUTER CRIME

It can be argued that computer crime is different from cybercrime. Computer crime tends to be traditional crimes of property committed with the use of a computer, and cybercrime tends to refer to new, emerging forms of crime that, as of yet, defy standard criminological classification. Computer crime of the traditional variety tends to fall into one of five categories:

1. Theft of services -- unauthorized user penetrates a system
2. Use of data for personal gain -- blackmail, harassment, etc.
3. Financial gain -- some type of financial processing to obtain assets
4. Theft of property -- extracting money under false pretenses
5. Hacking -- using a virus to disrupt or destroy programs or networks

Theft, followed closely by fraud, tend to be the most common types of computer crime:

Trojan horse -- using one computer to reprogram another

Salami slice -- using a dummy account to extract a few cents

Super-zapping -- using diagnostic program to crack system

Logic bomb -- using a subroutine that waits for an error to occur

Impersonation -- using an authorized identity for unauthorized access

Data leakage -- using printouts of small amounts of data

Computer Laws are extraordinarily complex. There's the problems of definition, jurisdiction, and evidence. A good primer on cybercrime investigation can be found elsewhere, and then, a whole course could be established in computer forensics. Most offender profiling techniques rely upon the distinction between insiders and outsiders, with insiders (employees or those with legitimate access to their targets) comprising about 75% of all offenders. The FBI is continually surprised, when under the plain view doctrine, they investigate an insider threat and find examples of child pornography, organized crime connections, and even recreational hacking. Employees also often waste a lot of company time using their network access to surf, shop, or engage in other instances of lost productivity. It makes sense to profile the typical computer abuser. Every organization has them, and here are some of the signs:

numerous logon sessions, some attempts under different name

sloppy password management

unusual interest in computer system printout

mixes personal equipment with company equipment

Outsiders, who are usually evident when there is a system intrusion (hacking) or the planting of a virus or worm, are frequently analyzed using the following typology which classifies outsider threats:

industrial espionage - theft of proprietary information or trade secrets

terrorism - attempts to influence or disrupt U.S. policy

national intelligence - attempts by foreign governments to steal economic, political, or military secrets

infowarfare - cyber attacks by anyone on the nation's infrastructure to disrupt economic or military operations

Laws that are frequently used to prosecute computer criminals and cybercriminals include the following:

Computer Fraud & Abuse Act (1986) -- makes it a felony to use a computer to gain $5000 or more or to access data affecting national interest

Computer Abuse Act (1994) -- criminalizes "reckless" conduct and enhances penalties for defense, financial, or federal interest targets

Communications Decency Act (1996) -- criminalizes use of computer to provide minors with indecent material and for harassing someone

Economic Espionage Act (1996) -- protects trade secrets from falling into the hands of any foreign instrumentality

INTELLIGENCE ANALYSIS OF WHITE COLLAR CRIME

One of the more prominent theories is that offenders possess an "unshareable financial problem", the result of living beyond their means, piling up gambling debts, etc. (the three Bs: Babes, Booze, Bets), and feel they cannot let anyone know about their situation without ruining their reputation. Other theories stress the "culture at the top" notion, which sets the tone for the ethical climate in the organization. The whole world of business is kept in line by what is called "economism" -- a self-regulating compliance strategy based on the deterrent effects of economic sanctions and civil penalties. This inherently places a lot of trust in the personalities of those who work in business.

Regardless of the motivation, the offenders are probably as complex as the laws and regulations in this area. The required mental states, for example, range from "negligently" to "recklessly" to "knowingly", depending upon what type of white collar crime you're talking about. Prosecution, or more specifically, deciding who prosecutes, opens up a cornucopia of agencies, all with joint and/or overlapping responsibilities. In some cases, the level of cooperation is well-known, such as between the FBI (threat of criminal charges) and FTC (civil cease & desist orders), but OSHA inspectors have only recently been equipped with police powers, and the investigative arms of many other agencies are not well known.

One of the most important things in investigation of white collar crime is the need for partnership and teamwork. Intelligence work in this area is often disorganized and inefficient, and a team approach can solve this. The Treasury Dept., for example, may have the money laundering analysis expertise, and a local police department may have a proven ability to produce analytical activity charts. The "strike force" model is one of the most common team approaches in law enforcement. This establishes a network of agencies all working on different aspects of the problem.

Another thing that should not be overlooked is the corporation itself. Businesses spend millions of dollars a year conducting internal audits. Along these lines, one should not neglect the private security force employed by the corporation. Their employees can be valuable sources of information. In addition, sometimes the employees of the organization itself can be induced to "snitch" or "whistle blow" on other employees.

The main piece of evidence that will be viewed most strongly in court is any evidence of disguise or coverup. This will ordinarly be presumed as evidence of intent under most legal standards. Concealment of the violation is therefore the most vital piece of evidence to look for. This necessarily involves unraveling the "paper trail" and pouring over a large roomful of obscure documents. Many agencies have hired college students or recruited interns to temporarily help them with these chores. Records analysis is something that may take years to complete, but then you have to focus on individual offenders eventually. But with records analysis, you should look for:

Maintenance of two sets of books or records

Destruction of any books or records

Payments to fictitious companies or persons

False invoices or billings & double payments on billings

Company loans to employees or other persons

Large or frequent currency transactions

Use of photocopies instead of original documents

Presence of second or third party endorsements on checks

Over the years, a certain number of "indicators" have tended to be a composite of the white collar criminal. These indicators include:

The presence of illegal income

The presence of large cash transactions

The presence of multiple bank accounts

The sudden ownership of one or more businesses

Multiple businesses at one address

Corporations with little or no physical assets (paper corporations)

Out-of-country bank accounts

Beside proof of intent (via habit and character evidence) which satisfies the mens rea element of crime, and proof of destruction or coverup (via shredded or duplicate documents) which satisfies the actus reus element of crime, AND the testimony of at least one witness (via an informant or snitch co-worker), the intelligence analyst should be prepared for the court to expect the introduction of charts diagramming the scheme or conspiracy. Such charts require an understanding of conspiracy.

PROVING CONSPIRACY

A conspiracy is difficult to prove (see this lecture on conspiracy law and this other lecture on accomplice law which cover the basic legal elements). Accomplice law includes terms such as "aid", "abet", "assist", "counsel", "induce" or "incite" which may have different meanings depending upon what jurisdiction you're in. Normally, you can't be considered as an accomplice simply for being there -- you must be constructively present. Accomplice law is also where the notion that you can't hold a corporation criminally liable comes from, specifically from the doctrine of respondeat superior which establishes the notion of "vicarious liability" where a master is responsible for the illegal conduct of their servant. The relationship is what creates the liability. It often comes up in business, where a corporation (as an entity, not a person) cannot commit a crime (cannot form criminal intent) but it can be held "criminally liable" if the only punishment sought is a fine or seizure of property. Officers of a corporation can be punished by imprisonment only if the corporation itself has been held "criminally liable" first (a pretrial finding of at least negligence), the officer has been found guilty of malfeasance, misfeasance, or nonfeasance by their corporation, and (unless stated otherwise in statute) the officer causes, requests, commands, or in any way authorizes the illegal act to be committed.

Now let's consider conspiracy proper. The essence of conspiracy is an agreement. It doesn't have to be a written one. Usually, it's inferred from the facts or circumstances. What the agreement has to be about doesn't even have to be criminal, only "unlawful". Under some statutes, the conspiracy can involve any act injurious to public health, public morals, free commerce, or any act perverting justice. Because a conspiracy by itself is treated almost as a substantive crime in itself, this is the only inchoate offense that the law permits a person to be charged with in addition to the target crime (that is, a person can be charged with both the crime and conspiracy to commit the crime). This probably won't be reduced by plea bargaining.

Conspiracy is something prosecutors love to prosecute. There's a lot of presumptions and procedural rules that favor the prosecution. It's easy to get a conviction for conspiracy because, basically, all the prosecutor has to do is present all the evidence and let the judge tell the jury what test will be used to determine whether an agreement existed. In most jurisdictions, proof of the agreement is sufficient; no overt act is required. In jurisdictions requiring an overt act, the standard is not as high as the law of attempt, and is basically proven by showing at least one of the conspirators had at least the intent to commit a substantive offense. Conspiracy is still a specific intent crime, so "purposively" must be used, not just knowledge, although there's a whole string of case law indicating erosion in this area.

The elements of conspiracy include:

(1) mens rea -- a specific intent to attain a particular criminal objective on the part of at least one person in the partnership. Purpose can be inferred from circumstances surrounding the combination, such as failure to keep records, clandestine meetings, quantities involved, continuity of the relationship, etc. There are different rules used by different jurisdictions on the kinds of relationships that qualify:

unilateral rule -- the idea that among a group of conspirators, there is at least one individual with criminal intent

bilateral rule -- the idea that one cannot conspire alone; at least two guilty persons are required

Wharton's rule -- the idea that because conspiracy charges imply a danger to society, there must be more (>2) partners than the minimum number required to commit the crime (a third party must be involved), so therefore, conspiracy to commit adultery, bigamy, and incest will require 3 people

(2) actus reus -- proof of an agreement is proof of the actus reus for conspiracy. Proof of an unwritten understanding will suffice. Most agreements are of two types, and the judge is obligated to instruct the jury how to determine the types:

chain conspiracy -- this usually involves the distribution of something, like drugs, where each person in the conspiracy handles the commodity at different points in the process, like with the stages of manufacture, distribution, and sale, which form a linear (from left to right) chart when diagrammed.

Defenses and Other Issues: It's important to remember the danger of entrapment. Police cannot initiate a conspiracy or a crime -- that would automatically be entrapment. They can, however, give somebody an opportunity to enter into an already existing conspiracy where the police agent is a feigned accomplice. This means that already existing conspiracies must be infiltrated. Other than entrapment, the only other defense available to the defendant is complete and total withdrawal. The standard is high. The defendant has to show their complete and total withdrawal that they tried to notify or tip off authorities, felt guilty about their own involvement, and took active steps to thwart the conspiracy. The last thing to remember about conspiracies is that, in this area, the law doesn't recognize anything sacrosanct about the husband-wife relationship. All bets are off in terms of privileged relationships. A skilled investigator can use this to obtain important information and witnesses. "Pillow talk" will do you in with white collar crime.

Call-sell operator -- one who sells fake long distance phone call time cards
Canister con -- fake canisters for donations to bogus causes
Charity con -- any use of fake charities or good causes
Circle of friends con -- scams involving friends, relatives, and associates
COD scam -- con in which empty COD package is delivered to victim
Computer repair con -- hacker con to gain access to someone's computer
Coupon con -- any scam involving counterfeit coupons
Credit repair con -- creating an unusable new identity for a victim
Damage claim artist -- a professional accident victim
Diary scam -- any scam involving selling the fake diary of a famous person

Phantom employee -- nonexistent employee time billed to a company
Phony invoice scam -- sending legitimate-looking bills to a business
Pidgeon drop -- street swindle where con man and victim "discover" a lost wallet or purse. The con man convinces the victim to ask a "lawyer" what to do. The lawyer (another con man) says the victim should put up earnest money while owner is being contacted to negotiate the reward
Ponzi scheme -- any investment racket, pyramid scheme, or chain letter in which operator skims commissions off of deposits made by later investors
Religious scam -- any use of religion in a religious con game
Reload scam -- telemarketing recalls on people who have fallen for something before and are on a suckers list
Roof repair scam -- fake or shoddy roof repair by unscrupulous repairmen
Shoulder surfer -- one who steals phone calling card numbers by loitering near phone booths
Slip and fall artists -- one who orchestrates phony falls and threatens lawsuit
Social engineer -- computer hacker who talks someone into giving up their password
Spanish prisoner scam -- a con in which the victim is convinced that a wealthy prisoner is being held captive without access to his riches, and that if he or she helps bribe the captors, they'll get a reward
Straw man con -- someone who profits by posing as someone they're not, usually in a real estate transaction to pose as buyer or seller
Sweepstakes con -- when marks are advised they won a prize and pay fees
Sweetheart scam -- a con in which the con artist romances a victim
Swoop and squat -- a staged car accident in order to make money
Telemarketing scam -- any con game involving telecommunications
Trash and dash -- a scam in which con men pose as janitors to steal valuables
Triple-A con -- pretending to work for AAA, and offering to fix bogus car problems for a small fee
Vanity con -- any use of person's ego or love of self to engage in a con game, like modeling work or publishing a song, requiring up-front deposits
Work-at-home scam -- scams offering victims easy money for things like stuffing envelopes and product assembly at home, requiring up-front fees
Worker compensation scams -- filing false injured at work claims
Yank down scam -- intentionally pulling display items in stores on top of yourself to file false injury claims

MONEY LAUNDERING

Money laundering is the process by which cash derived from a criminal enterprise is exchanged, intermingled, or converted with other cash which produces no trace of origin for the original cash. The term goes back to the Al Capone days of Chicago mobsters in the 1920s who used local laundries to cover up their profits from gambling, racketeering, and bootlegging. It is the process of converting funds derived from illegal activities into spendable or consumable form. "Hiding" dirty money is not the same as "laundering" it. Money laundering is regarded as the world's third largest business, following the legitimate financial sector and manufacturing. The United States, not offshore banks or other places, is responsible for about half of the $750 billion that are laundered every year. Some 60-80% of all federal money laundering prosecutions involve drug-related "kingpins" although terrorists, arms dealers, and international criminal organizations also launder money quite regularly.

The basic mechanics of money laundering, according to Richards (1999), involve three steps: (1) placement - getting illegal proceeds into the mainstream financial system; (2) layering - mingling the funds with those of legitimate origin and moving or transferring them around different financial institutions; and (3) integration - reintroducing the funds back into the mainstream economy to be invested or spent legitimately. For example, a drug kingpin would ordinarily see to it that his drug money is all collected and sent to what is called a "counting house." These houses are usually in a remote location near the dealership region and are heavily armed and secure places. From there, the money is broken up into small amounts, usually less than $10,000, and then given to runners called "smurfs" (what investigators call the runners who scurry in and out of banks), who deposit their small amounts simultaneously in nearby banks. After a week or so, the smurfs then order their accounts to be transferred to someone else's account in a larger, big-city bank. The holder of that account then wire-transfers a large sum of money to a foreign bank, where it is converted to a certificate of deposit that is then used as collateral for a loan at another foreign bank. These loan proceeds are then sent to Mr. Big or whomever the kingpin is. It should be noted that this example doesn't exhaust all the possibilities. In addition to "smurfing," organized criminals often mix their money with bank deposits for cash-rich businesses, like casinos, restaurants, and bars. Furthermore, various ethnic groups frequently have their own underground banking system, such as Hawala for Middle Easterners, or fei chi'en for Asians.

What this dumbass fails to realize.............is that after the carriers took half the harris cola to apply it to health care costs, then gave what was left to us, they jacked up our percentage of health care eating up any cola.

Every time the harris cola is applied, it allows the carriers to raise our healthcare contributions. UTU members will wake up to this fact come July 1st when they see their health care contributions raise to $160.33 a month with only a dime an hour raise. BLET members will see an 8.5% raise on July 1st and will be paying less in health care at that time.

majority of american workers pay 1/3 of healthcare

by we pay a lot less and make a lot more

because of our unions we make more and pay less for h&w. things can always be better but look around at the rest of america. 1/3 of our monthly healthcare premiums would be about $400

Why is one group of people who are getting a sweetened deal voting in a contract for everyone else who gets something much different?

Sort of like intraunion pattern agreement. All for a few, the rest get the shaft.

Some of us don't consider being a father in absentia and living like trailer trash a decent standard of living. That might work with the UTU but not on the other side of the cab.
