I would also think that if a person was stopped with out being checked out, Held until the police arrived and then proved that they didn't have any stolen merchandise that the person stopped would have a good case for unlawful imprisonment. I could be mistaken, I am not a lawyer. Perhaps the McMillans can clarify some of the laws (definitely for California and since they have the Texas link perhaps for Texas).
