Your seller is not the first or only that sells copies of resin figures on EBAY. There are several powersellers that sell Verlinden copied figures all the time. There are even two selling Legend engine sets for both the M60 and M48 now. EBAY and PAYPAL will do nothing. I know this from past experience. I sent EBAY exactly the same pictures you posted after purchasing my one M60 engine set and EBAY said that because the listing does not state that it is Legends merchandise, there was nothing they could do. Though I like EBAY for finding deals, their rules and regulations leave a lot to be desired.
