I doubt that it is dying, and there really is no reason to move it as long as it's planted correctly. The most common mistake people make when planting trees is to either plant them too deep, or to plant them in a wet area. Most plants do not like wet, soggy soil around their roots. When you plant them the top of the root ball should be at least 1-1/2" above grade, then mound some soil over the root ball. The roots need to breath that's why you want to plant them a little high. Especially in a clay type soil.

Make sure the soil around the roots isn't too soggy. That' would be my biggest concern right now.
