His sin was one of omission, not commission, so he certainly would not have been guilty of murder. And back then DUI was not what it is now, and the prevailing wisdom was that being drunk, and fearing the problems that would cause for him, was the main reason why he didn't notify authorities until he would have been totally sober.
The questions about this incident were always more moral in nature than legal. Mainly, in 8' of water how could he not have gotten her out of that car before she drowned? And many people seemed back then to think that it was questionable if he even tried, though he said he did.
