Whether it becomes law or doesn't, whether the Supreme Court strikes it down, or doesn't, none of that matters. What it accomplished is calling out the federal government for its outright negligence in dealing (or not dealing) with this issue, and in the end this will force the feds to act. That is an accomplishment.
Obama may be able to delay this for a while, but he cannot for very long without risking tearing down the Democratic Party with his inaction. Of course he will also risk tearing down the party with his actions if he doesn't read the tea leaves and understand the national sentiment on this issue. This isn't a 55/45 or 53/47 type of issue like health care was, this is a black and white 70/30 issue, and he, and his most loyal part of the Democratic Party, find themselves in the "30" camp.
This will be very interesting to watch over the next few months.
