AFP seeks quashing of subpoena on Burgos investigation results

Armed Forces of the Philippines (AFP) Provost Marshall Col. Arturo Abadilla yesterday filed before the Court of Appeals (CA) Eighth Division, a motion to quash the sub-poena issued by the court last July 31, directing him to release the results of his investigation on the missing license plates of the vehicle purportedly used in the abduction of activist Jonas Burgos, which was subsequently traced to an impounded vehicle at the 56th Infantry Batallion’s headquarters in Norzagaray, Bulacan.

In an 11-page affidavit, government lawyers asked the court to quash the subpoena, saying the document in question is not under Abadilla’s control, making it impossible for him to comply with the order.

It also said the document is “irrelevant to the issue,” hence there is no need for it to be released.

The lawyers, in defending the provost marshall, further said, “The subpoena ad testifican-dum/duces tecum is unrea-sonable and oppresive because compliance therewith will subject Col. Arturo Abadilla or anyone from the AFP to administrative and criminal liability pursuant to Memoran-dum Circular (MC) 78 of the President entitled ‘Promulgating Rules Governing Security of Classified Matter in Govern-ment Agencies.’”

In refusing to comply with the court directive, the affidavit pointed out “Paragraph 57 of MC 78 declares that the unauthorized publication of any classified information shall be deemed a violation of the circular and subjects the violator to administrative liability without prejudice to any criminal prosecutors.”

It further said “the subject report is an internal document which is not intended for public consumption. It can only be released after it shall have been declassified by the competent administrative authorities.”

Senators want military to explain string of clash setbacks

MANILA, Philippines -- The military must explain its latest debacle in the hands of Muslim extremists, senators demanded on Friday.

"What is happening in our Armed Forces? ... The buck stops with General (Hermogenes) Esperon to explain why we are being clobbered in the field," said Senate Majority Leader Francis Pangilinan.

"Are we sending our young men out to die in the fields because of the incompetence of their superiors?" he continued.

He said Esperon should publicly explain "why we are facing a string of setbacks despite the billions being poured into the military establishment year after year."

"How many more lives will be lost until officers are made to account for their incompetence?" Pangilinan went on.

Senator Richard Gordon also demanded an explanation from the military, albeit on a more subdued tone.

"While we offer our sympathies to the families of the fallen, we have to look more closely into why our troops are suffering this high level of casualties. I believe Congress and the public deserve to know more about the real situation in the South so that appropriate adjustments -- whether in policy or program or materiel or logistics -- can be made and better support to our troops can be provided," said Gordon.

Senator Rodolfo Biazon, a former military chief who retained his chairmanship of the Senate committee on defense, could not be reached for comment Friday.

Gordon said President Gloria Macapagal-Arroyo should order a "top-level" military briefing to include lawmakers on how military operations including troop morale and logistics and intelligence support "are really faring in Mindanao and Sulu."

"This is not a question of assigning blame or pointing fingers. This is just a matter of how we can all pull together for the improvement of the situation in the South," he said.

Pangilinan also called on newly installed Defense Secretary Gilbert Teodoro to "exercise the political will to rid the Armed Forces of the Philippines of incompetents and whip the generals and soldiers into line so that we can make major headway in achieving a just, honorable and lasting peace in the country in our lifetime."

AFP probes men tagged in political slays

The Armed Forces of the Philippines (AFP) on Thursday said it will investigate personnel who have been implicated in extrajudicial killings and other forms of human rights violations.

Lt. Col. Bartolome Bacarro, AFP public information chief, declined to name the soldiers and officers who will be investigated by the Judge Advocate General's Office. He said the preliminary probe is in preparation for possible court martial proceedings against military personnel implicated in the killings.

"The chief of staff has directed the conduct of pre-trial investigation on the cases that are now pending before the civil courts," Bacarro said.

Bacarro said the order is a follow-on to AFP chief Gen. Hermogenes Esperon Jr.'s creation of five general courts martial dedicated to try cases of military personnel linked to politically-related slays and rights violations.

Bacarro said the courts will immediately put a soldier on trial once probable cause is established during pre-trial investigations.

Bacarro, meanwhile, downplayed possible accusations that the hearings would become mock trials since the cases involving the soldiers can be dismissed for double jeopardy.

"Public officials could be held liable. We, in the military, we can be tried separately from our case in the civil courts. We can be arraigned before the military courts, and whatever the result or outcome of these cases, it would have no bearing on the cases before the civilian courts," he said.

Bacarro cited the case of the officers linked to the short-lived Oakwood mutiny. The accused are being tried before the Makati City Regional Trial Court for coup d'etat charges while a separate case in violation of Articles of War 96 (conduct unbecoming an officer and a gentleman) is with a military tribunal.

Bacarro said the creation of the military courts and the conduct of the pre-trial investigation are proofs that the military can be harsh on its personnel who get involved in illegal activities, including killings.

He, however, clarified that: "The [military] institution as a whole does not commit human rights violation. It is not the policy of the Armed Forces of the Philippines to do that."

Activist groups, particularly the left-leaning Bayan and Bayan Muna, believe that military personnel are involved in political killings. The groups and their allies also suspect that the killings are being carried out with Malacańang's knowledge.

Commander in Chief will not order the creation of special courts. She has people who work under her who will do that for her, as evidenced by the PNA article. Reason? Commander in Chief may have to act on the sentence of a court-martial and must therefore keep her distance from the case(s).

In other words, what's being "beached" about by Kanopanice is already underway, and the "beaching" is too late, as usual.

Muslim militants kill 9 Philippine troops in ambush

MANILA (Reuters) - The Philippine military suffered heavy casualties on Thursday after Muslim rebel group Abu Sayyaf ambushed a convoy on the remote southern island of Jolo, the army said.

Major-General Ruben Rafael said nine soldiers were killed and two were wounded when they were attacked by dozens of rebels while on their way to a public market to buy food.

"We've sent reinforcement to evacuate our casualties," Rafael told reporters as helicopters flew to the scene of the fighting to ferry troops and bring back the wounded.

The tropical isle, a base for Muslim militants in the largely Catholic country, has seen an escalation in violence after the army started collecting unlicensed guns from civilians.

It was the second deadly ambush in as many months in the south and marked a deterioration of the situation on Jolo.

An army spokesman, Lieutenant-Colonel Ernesto Torres, said about 100 rebels from the Abu Sayyaf and a rogue faction of the Moro National Liberation Front (MNLF) were believed to be behind the attack, retaliating for losses in an earlier clash.

On Wednesday, soldiers killed four Muslim rebels in a brief gunbattle in nearby Parang town, where a soldier was also killed and five were wounded.

But, the mainstream MNLF, which signed a peace deal with the government in 1996, claimed it was behind the ambush, saying it was retaliation for the deaths of five people during an army offensive a day earlier.

"It was not the Abu Sayyaf," Hatimil Hassan, the deputy chairman of the MNLF, said on local TV. "It was our troops. It was the military's fault. They started it all."

In July, members of the Moro Islamic Liberation Front (MILF), the country's largest Muslim separatist group, killed 14 Marines in an attack on the nearby island of Basilan. Ten of the soldiers were beheaded but the MILF, which is meant to be talking peace with Manila, has denied its members mutilated the troops.

The military also blames members of the Abu Sayyaf for the decapitations. Due to family ties on Jolo and Basilan, there are close links between the Abu Sayyaf, the MNLF and the MILF and sometimes an overlap in membership.

The Philippine government wants to seal a peace deal with the MILF but has sworn to crush the Abu Sayyaf, which is blamed for the Philippines' worst terror attack -- a ferry bombing that killed more than 100 people in 2004.

Death toll from Sulu fighting rises to 21

ZAMBOANGA, Philippines - Twenty soldiers and a civilian were killed Thursday as fighting between government forces and Muslim gunmen spread in the southern Philippine province of Sulu, the military said.

Gunmen ambushed a military convoy and killed 10 soldiers near Maimbung town in Sulu's Jolo island, military sources said on condition of anonymity. A child living in the area was also killed in the crossfire, they added.

They said the attackers were understood to be members of the Moro National Liberation Front, a separatist guerrilla force that signed a peace treaty with Manila in 1996. Some of its members, however, have refused to disarm.

Nine soldiers were killed and two others were wounded earlier in the day in another village near Maimbung in an attack believed to be launched by the Abu Sayyaf, an Islamic militant group with alleged ties to the al Qaeda network, said local military spokesman Maj. Eugene Batara.

One of the wounded soldiers from this attack later died in hospital, a source said.

"We have reports that the Abu Sayyaf were the ones who attacked them," Batara told reporters, saying the gunmen also took six M-16 rifles.

The attack is the latest episode in an escalation of violence in the restive Philippine south, where troops have been massing since July 10 when 14 Marines were killed on the nearby island of Basilan. Ten of them were beheaded.

At least three Abu Sayyaf extremists and a soldier were killed Wednesday and two Marines were wounded Tuesday in clashes in Jolo.

The Abu Sayyaf has been responsible for numerous attacks on Christians and foreigners throughout the Philippines in recent years.

The military has been on an offensive against the Abu Sayyaf in Jolo island since last year and has killed two major Abu Sayyaf leaders since.

The Abu Sayyaf and members of the Moro Islamic Liberation Front (MILF) were behind the July 10 attack, the military and government have said.

The MILF, which is supposed to be observing a three year-old ceasefire, has admitted killing the Marines but denied beheading them.

More than 23,000 villagers residing near MILF camps in Basilan have fled their homes for fear of getting caught up in any possible government attack.

Despite the heightening of tensions, government peace negotiators have said they expect to reopen peace talks with the MILF in Malaysia before the end of this month.

Meanwhile, police confirmed that an alleged Abu Sayyaf member suspected of taking part in the beheading of the 10 Marines had surrendered to a local television crew on Basilan island.

"He surrendered and he is denying the accusations against him. We should talk to him to find out the truth," said a regional police official.

Two other suspects in the beheadings had earlier turned themselves in after the government announced it was going after them.

A Filipino who works as surveillance technician in a casino in California was arrested at a hotel on El Segundo Boulevard near the Los Angeles International Airport. Authorities said he had applied for an emergency passport and could have been preparing to flee the United States.

The report said he was wearing a costume when apprehended. Cocaine was also found in his possession.

Earlier reports said the Filipino suspect bound and gagged three employees and herded seven others at gunpoint into another room, then took $1.5 million from the vault at Soboba Casino on the Soboba Indian Reservation near San Jacinto.

Another Filipino suspect drove the getaway vehicle.

I came to know about moros murderous frenzy by reading history of ACP 1911 45 caliber, watching History channel, I show a movie made in the Philippines and the actor was Gary Copper about Moros in Mindanao and they are fighting against muslim moros (Black and white movie). 1940 Tacoma Narrows Bridge

Slender, elegant and graceful, the Tacoma Narrows Bridge stretched like a steel ribbon across Puget Sound in 1940. The third longest suspension span in the world opened on July 1st. Only four months later, the great span's short life ended in disaster. "Galloping Gertie," collapsed in a windstorm on November 7,1940.

The bridge became famous as "the most dramatic failure in bridge engineering history." Now, it's also "one of the world's largest man-made reefs." The sunken remains of Galloping Gertie were placed on the National Register of Historic Places in 1992 to protect her from salvagers.

A dramatic tale of failure and success
The story of the failure of the 1940 Narrows Bridge and the success of the Current Narrows Bridge is a great American saga. When Galloping Gertie splashed into Puget Sound, it created ripple effects across the nation and around the world. The event changed forever how engineers design suspension bridges. Gertie's failure led to the safer suspension spans we use today.




The Current Narrows Bridge

After 29 months of construction, a new and much safer Tacoma Narrows Bridge opened on Oct. 14, 1950. The current bridge is the 5th longest suspension bridge in the United States. Located on State Route 16 between Tacoma and Gig Harbor, the bridge is 5,979 feet in length. That's 40 feet longer than its predecessor, Galloping Gertie.

Engineers designed the current bridge to carry 60,000 cars a day. But, now it handles an average of over 90,000 vehicles daily.

The New (2007) Narrows Bridge

In 1998 the public was asked, "Should the Tacoma Narrows Bridge be modified and a parallel bridge constructed, financed by tolls on bridge traffic and operated as a public-private partnership?" A majority of the voters answered "Yes." Since then, WSDOT and Tacoma Narrows Contractors (TNC) have been developing plans for the new bridge.

The newest Tacoma Narrows Bridge is being built next to the current bridge. Construction began in October 2002. The project is expected to cost $849 million. The new bridge will significantly improve traffic flow, reducing the three to four hour backups that commuters now face. The projected completion date is early 2007.

massive and looks indestructible and more than a mile
long

It is called the Narrows because the bridge was built
at the narrowest part connecting Tacoma and Gig Harbor.
Gig Harbor is a very beautiful town inhabited mostly
by Scandinavians. Going down the hill towards the water
reminds me of new england...beautiful. Anywhere in my
homestate...is green and beautiful!

It's been a week but all I get was sorry and further patient.
WHY IS PAL TAKING SO LONG TO ANSWER ME?
They are most likely trying to lose/mislay all pertinent records about
my complain. The next we knew the records were all washed out by the
computer and forget all about it. And that's it and nothing more.
What are they are covering and washing out?
Or was there ever an investigation being done?
Was there ever a looking out and securing of the handling details
being made?
Or may I say what I am expecting.
A poor old man should not anticipate anything from the Giants.
Their staff shoo the old dogs and that's it. PAL THINKS THAT
No matter what clarification you need if you are poor you will never
get it.
I need explanation on the terrible dilemma we went through.
Winning a PAL Ticket back home is such a joy but had left us bad
memories hard to forget. We have earned respect in our lives
somehow.
WHY MUST THIS BE DONE TO US IN OUR RIPEN YEARS?
I have lived in Guam for many years. My sons are all in the mainland.
I should have thrown my PAL ticket our have donated it to the dogs
instead.
I should have considered Hawaii for my wife cataract surgery than my
country. I should have spared us from this bad experience.

The increasing criticism of the administration’s human rights records, the latest of which came from foreign chambers of commerce and multinational companies operating in the country, and from seven US retail giants, “show that Arroyo has lost credibility even among the big business community and the officialdom of other countries so that no one seriously buys her government's claim that it is not responsible for the killings and that it is determined to stop the rampage and punish the perpetrators of these killings.”

Foreign businessmen, foreign governments, churches, media and human rights groups had been demanding that the Arroyo administration end the continued political killings in the country.

“In pretending to be solving the problem, but in reality continuing with its campaign of violence against activists, church people, media professionals and other critics, the Arroyo regime has only succeeded in further isolating itself internationally and has gained nothing but notoriety as an international pariah,”.

“Arroyo is now regarded nationally and internationally in the same way as people regarded Ferdinand Marcos, Chile's Augusto Pinochet, Uganda's Idi Amin and other military dictators who were all notorious for their brutal crimes against humanity,”

Human rights organizations say more than 800 persons have fallen victim to extrajudicial killings since 2001, when Arroyo came to power.

Critics also chided Philippine National Police Deputy Director General Avelino Razon for blaming most of the killings on the rebels, calling it a “concoction” meant “to obscure the Arroyo regime's responsibility for the campaign of political killings.”

Palace mulls crisis powers for Arroyo

The looming energy crisis brought about by the extended dry spell might push Malacańang to ask Congress to grant special powers to President Arroyo, ABS-CBN News reported Wednesday.

Executive Secretary Eduardo Ermita said the President would need an emergency prerogative to procure fuel for power plants.

“[Special powers are needed to authorize] for example, the acquisition of materials, resources, equipment without bidding,” Ermita said.

Several dams in Luzon are now in critical level because of the dry spell. Dams in critical level cannot produce enough power to churn out electricity from hydroelectric plants.

Mrs. Arroyo has ordered the National Power Corporation to immediately purchase coal and have them in reserve to fuel power plants in case the dry spell continues.

Ermita, meanwhile, said that there is no need for more independent power producers similar to what former president Fidel Ramos did during the energy crisis in 1992. He also said that government agencies have enough funds to respond to a crisis.

Reports said the government has allotted P28 million for cloud seeding operations. The government likewise appealed for the public’s cooperation in conserving water.

Several senators, meanwhile, opposed the proposal to grant the President emergency powers to deal with the water crisis.

Sen. Joker Arroyo, a Palace ally, said the idea could lead to a political mess.

“The President has enough powers even without emergency powers to cope with the situation," he said.

The senator added that seeking the approval of Congress might lead to chaos in the chambers because lawmakers will definitely clash over the proposal.

For his part, Senate Minority Leader Aquilino Pimentel Jr. said he does not trust the President. She might not use the emergency powers properly, he added.

Senate President Manuel Villar, on the other hand, said Mrs. Arroyo “does not need emergency powers, she needs money.” He did not elaborate. With reports from Lynda Jumilla and Jing Castańeda

71% of Filipinos give Arroyo failing grade in anti-corruption efforts

Seven out of 10 Filipinos gave President Arroyo a failing grade in her anti-corruption efforts, according to the latest survey results of independent think tank IBON Foundation released Saturday.

IBON said 71 percent of 1, 488 respondents believed that Mrs. Arroyo failed to combat corruption in the government while 15.5 percent of them gave her a passing grade.

The July 2007 IBON survey was conducted nationwide and has a margin of error of plus or minus three percent.

The number of the respondents who gave her a failed mark was slightly lower than the 72.7 percent recorded in July last year but substantially higher than the 61.22 percent recorded in the January 2007 survey, the group added.

In July of last year, meanwhile, 14.53 percent believed that Mrs. Arroyo could combat corruption.

"It is also notable that the percentage of respondents who gave her performance a higher-than-passing grade fell to 7.7 percent from 9.7 percent in July 2006 and 13.9 percent in January 2007," it said.

'Corruption law is terrible and inadequate'

Meanwhile a Reuters report saud weak laws, a slow judicial system and public cynicism make it difficult to fight corruption in the Philippines, President Arroyo's anti-graft adviser said on Friday.

Tony Kwok, an anti-corruption crusader from Hong Kong credited with stamping out corruption in the Chinese territory, has beefed up the Philippine government's main graft-busting body but admitted that the Office of the Ombudsman lacks teeth.

"Here, lawmakers failed tremendously because the corruption law is terrible and inadequate. They also failed miserably in providing the Office of the Ombudsman investigative powers," said the 60 year old, who was hired by Arroyo in 2005.

He persuaded the government to more than triple the budget of the Ombudsman from just 300 million pesos ($7 million) in 2003 to around 1 billion today and increase its staff to 200 from 37.

But that is a small team in a corruption-riddled civil service of more than a million employees.

Kwok said that Hong Kong's Independent Commission Against Corruption finds it relatively easy to follow a money trail through banks, but the Philippines' Congress has refused to lift bank secrecy laws.

And, despite his efforts, graft is still viewed as one of the Philippines' top problems.

Shady practices hold back foreign direct investment and widespread tax evasion -- more than two thirds of self-employed people pay less then they should -- has thwarted state efforts to significantly boost tax revenues.

Earlier this year, expatriate business people in Asia viewed the Philippines as the most corrupt country in the region, according to an annual survey by the Political and Economic Risk Consultancy.

Kwok is currently overseeing a project, funded by the European Union, to improve government agencies' internal anti-corruption mechanisms.

Over 6,000 signs have been put up in public offices telling staff and public where to go and whom to ask for help to promote transparency and cut red tape.

Kwok has also helped government agencies craft a code of conduct that requires public and private parties entering into contracts to be accountable for their decisions and actions.

But he said Manila must upgrade its anti-corruption laws and speed up the judicial process to really tackle the problem.

Perhaps most important of all is trying to convince people that government agencies, often viewed as the most corrupt offices in the country, are serious about dealing with graft.

"If the people are cynical there is no chance," he said. "But Hong Kong had the same problem and the Hong Kong experience shows it can be done."

49 US solons urge Arroyo to act vs killings, rights abuses

Worry US aid used to violate human rights

MANILA, Philippines -- (UPDATE) Saying “the well-documented violence that continues with impunity must be ended,” 49 members of the US House of Representatives have written President Gloria Macapagal-Arroyo urging “strong and immediate leadership” to end extrajudicial killings and other human rights abuses.

“Since the extrajudicial killings in the Philippines continue unabated, and given the fact that there are many unanswered questions about the role of the Philippine government and military in these deaths, we respectfully request your strong and immediate leadership in investigating and prosecuting those individuals and/or groups, including those in the AFP [Armed Forces of the Philippines] and PNP [Philippine National Police], responsible for these killings, and in eliminating the underlying causes of the violence,” the bipartisan letter, dated August 1, said.

The solons also worried that US aid to the Philippine military and police is being used to commit the killings, which human rights groups estimate have claimed the lives of more than 800 people -- mostly left-wing activists -- since Arroyo came to power in 2001, and other human rights violations as part of the government’s counterinsurgency program.

“We are very concerned that the extrajudicial killings could be a conscious and systematic part of the Philippine government’s counterinsurgency program and that financial assistance from our government is being used to support, directly or indirectly, those within the PNP and AFP who are responsible for the killings,” they said.

Noting that “the AFP and PNP receive a significant amount of aid from the United States to assist in training and professionalizing the Philippine security forces, to combat terrorist groups, and to upgrade military equipment and hardware,” they said “the numerous reports that our and other congressional offices receive indicate the need for our close monitoring of this situation, particularly regarding the alleged use of US assistance to implement the abductions and killings.”

The letter was initiated by Representatives James L. Oberstar (Democrat-Minnesota) and Joseph R. Pitts (Republican-Pennsylvania) and its signatories included the following chairman of House committees and bodies: Tom Lantos (Democrat-California), Committee on Foreign Affairs; David Obey (Democrat-Wisconsin), Ways and Means Committee; John Lewis (Democrat-Georgia), Oversight Subcommittee; and Mike Honda (Democrat-California), Asian-Pacific American Caucus.

The letter is just the latest in a series of actions by the US Congress to pressure the Philippine government to stop the extrajudicial killings.

Last March, the US Congress held a number of hearings on the issue and invited Filipino activists and church leaders to testify. After that, it included in the Foreign Operations Bill a provision specifying that US military aid to the Philippines cannot be used against Filipino civilians.

“As you may know, there is increasing evidence from well-regarded human rights organizations, including the Melo Commission created by your government, which indicates the involvement of personnel from the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP)” in the killings, the solons’ letter told Arroyo.

Amnesty International and the United Nations Special Rapporteur Philip Alston have reported similar findings.

According to Philippine-based human rights group Karapatan (Alliance for the Advancement of People’s Rights), since Arroyo became president in 2001 until May 15 this year, there have been 863 extrajudicial executions (including 51 journalists) and 196 abductions.

The Philippines is the largest recipient of US military aid in Asia. This year, the US State Department proposed a total of $11 billion of military aid to the Philippines; this amount has been raised to $30 billion by the US Congress. The bill containing this proposal has not yet been enacted into law.

Described by Oberstar as “a sincere communication between the two governments” intended to elicit a positive response from the Philippine government, the US legislators’ letter aired deep concerns over a “growing environment of impunity” in the Philippines.

“The killing of civilians who are peacefully exercising their lawful right in a democratic society to express dissent is a gross violation of universally recognized human rights and international law,” it said.

The lawmakers also cited the May 27 abduction of Pastor Berlin Guerrero, who was allegedly beaten by the abductors until he gave them the names of his family, parishioners, friends, and the password to his computer. The abductors reportedly then replaced Guerrero’s computer documents with incriminating documentation connecting Guerrero to the underground left.

Guerrero remains detained by the Cavite provincial police.

Reports received by US congressional offices say Guerrero had been tortured while reports from the United Church of Christ in the Philippines said the PNP has pointed to Philippine Navy intelligence units as the ones responsible for the pastor’s abduction.

In reaction, the US-based Ecumenical Advocacy Network on the Philippines said the Congressional letter represents a growing awareness of US policymakers about the six-year surge of violence against progressive leaders in Philippine civil society.

“But more needs to be done to ensure that US dollars are not supporting security forces in violation of US law,” it said.

The Ecumenical Advocacy Network represents a coalition of American and Filipino-American church leaders and human rights advocates throughout the United States, lobbying against human rights violations in the Philippines.

Palace folds on emergency powers option

Malacańang yesterday retracted on its earlier plan for President Arroyo to seek emergency powers in solving the water and power crisis in the country.

“On a scale of one to 10, I would put the possibility of the President resorting to emergency powers to address the situation at zero point five,” Press Secretary Ignacio Bunye, in a statement, said.

He added Mrs. Arroyo is not keen on asking Congress for emergency powers to mitigate a dry spell that could lead to an energy crisis.

According to the Palace official, the President is on top of the situation and the government has started undertaking measures to prevent a major water and power shortage in the face of a drought threatening Luzon.

He stressed speculations that the President would use emergency powers to confront the looming crisis must end now.

Bunye said the President has alerted all concerned agencies to take steps in mitigating the effects of the abnormal weather situation, including cloud-seeding operations, particularly in Northern and Central Luzon and the Metro Manila areas.

The Palace’s change of stance came a day after lawmakers from both the Houses of Congress thumbed down the granting of emergency powers to Mrs. Arroyo, saying she has sufficient powers to deal with the situation.

On Wednesday, Executive Secretary Eduardo Ermita raised the idea of asking Congress to grant Mrs. Arroyo special powers should the extended dry spell worsen and result in an energy crisis.

But Senate Minority Leader Aquilino Pimentel Jr. also yesterday said he does not think that the use of emergency powers is necessary to hasten the purchase of imported coal and other fuel to run power-generating plants.

Existing laws already authorize government officials to purchase materials and equipment through negotiated contracts, instead of going through public bidding, in case of emergency, he added.

Pimentel, however, said the emergency purchase of coal by the National Power Corp. would have been avoided if it was farsighted enough to enter into long-term fuel supply contracts to meet its coal requirements.

“There is no need for emergency powers. The President has lots of powers and funds to remedy the water and power crisis,” he added.

Pimentel advised the executive branch not to slacken in implementing water and energy conservation measures, specially in government agencies.

He criticized the lack of mechanism to check whether government agencies are complying with conversation measures, and to impose sanctions on violators.

Sen. Francis Pangilinan noted that instead of courting skepticism on Malacańang’s true intent in asking for special powers, the administration should instead channel its attention and resources to measures and policies that would address environmental issues, “not just for this present fix but for the long run.” Sherwin C. AFP admits radio snafu, probe on

The blame is now being laid on “miscommunication” over the right radio frequency.

Military officials yesterday admitted that there was miscommunication on the radio frequency to be used and that lapses occurred during the encounter between the Philippine Marines and Muslim rebels in Tipo-Tipo (former Al-Barka), Basilan, last July 10.

Armed Forces of the Philip-pines (AFP) public information office chief Lt. Col. Bartolome Bacarro said theiInspector-general of the Philippine Marines, Maj. Gen. Ferdinand Bocobo, is now conducting a probe to determine what charges may be filed against those responsible for the miscommunication. “We are still studying whether the case is criminal or administrative,” he said.

The 14-hour firefight led to the killing of 14 Philippine Marines—10 of whom were beheaded.

Bocobo confirmed earlier reports that the 1st Marine Battalion headquarters in Basilan sent out the wrong radio frequency supposed to be used by air support units from the Western Mindanao Command base in Zamboanga City in communicating with the troops on the ground in Al-Barka town.

Bacarro said the miscommu-nication on the radio frequency was recognized and Bocobo’s recommendation to AFP chief of staff Gen. Hermogenes Esperon Jr. is for him to order the Philippine Marines to investigate some of the administrative liabilities.

The air reinforcements tried to contact the beleaguered Marines on a secondary frequency when the troops on the ground were operating on the primary frequency.

Bacarro explained that under military rules, one of two units communicating with each other cannot switch radio frequencies without the concurrence of the other.

“The UH-1H and MG520 attack helicopters, and OV-10 bomber plane that had come to the Marines’ assistance could not open fire”, Bacarro explained.

He added that it was important for the air support to contact the Marines to determine exactly where to fire since the airmen could not see the troops on the ground due to the thick forest cover.

Bacarro then claimed that the investigation could lead to possible court martial against those responsible for the mistake and they could be subject to criminal and administrative liability.

The spokesman however admitted that the air support would have been sufficient to turn the tide of battle as he further claimed that an air component is an integral part of the operation since that was crucial.

He said the soldier who sent the wrong radio frequency to Westmincom has been identified, but there has been no word on whether or not he has been relieved from his post.

Earlier, the ground commander of the embattled Basilan troops, Maj. Nestor Marcelino, and his battalion commander, Lt. Col. Felix Almadrones, were relieved from the Marine Battalion Landing Team 8 due to “command responsibility” and to give way to the IG inquiry.

A lawmaker from Mindanao meanwhile expressed serious doubts on the authenticity of the reports regarding the killings of 14 Marines in Basilan even as he pushed a congressional investigation to find the true culprits in the crime.

Newly-proclaimed Anak Mindanao Rep. Mujiv Hataman, also from Basilan, said reports reaching his office point to the current investigation into the killings as “leading to nowhere.”

“Even the names of the suspects may not be true,” Hataman said yesterday in an interview after his long overdue proclamation.

Probers said that Muslim bandits linked to the Abu Sayyaf Group were allegedly responsible for the beheading of ten of the 14 Marines. The probe body, however, failed to identify the mutilators of the six other Marines, saying it had no witnesses that testified to the slaying of the six.

Only one out of the four rebels identified by the panel was on the list of some 130 suspects the Arroyo government prepared in issuing warrants of arrest.

Two suspects have surrendered and been arrested over the beheading of 10 Marines, the military said Friday.

The two men turned themselves in to a military unit and handed over a rifle they had taken from one of the slain troops, said regional military spokesman Maj. Eugene Batara.

He provided no identities or other details.

The unit was attacked in a village on July 10 as they followed up a tip that kidnappers were holding an Italian Roman Catholic priest in the area.

A local court has ordered the arrest of 130 suspects, mostly members of the Muslim separatist guerrilla group Moro Islamic Liberation Front (MILF) that has been holding peace talks with Manila.

An erstwhile national security adviser of President Arroyo yesterday urged the government to pursue the manhunt on the 130 members of the MILF that has launched an ambush against the Marines in Basilan.

Rep. Roilo Golez (Paranaque 2nd district) charged that although the MILF had cooperated with the authorities in identifying four members of the Muslim bandit Abu Sayyaf Group, as responsible for the beheading and mutilation of four Marines, it does not absolve them from their unlawful assaults against the Marines who were in the area on a legitimate mission at that time, to conduct a search and rescue operation for the kidnapped Italian priest.

“They (MILF) are not off the hook If they (MILF) truly adhere to the peace pact forged with the government, that they would not allow their sanctuary to be a haven of lawless elements, and if they have nothing to hide, they should cooperate with the government. They should surrender their men who ambushed and killed our soldiers, who are already on their way home to their military camp from a botched search and rescue mission,” he said.

Golez charged that the MILF should accept responsibility for its members’ actions.

“If the ambush and killing spree against the MILF happened inside the AFP camps the government would not tolerate such genocide and atrocious acts, we would bring the culprits to justice. Similarly, the MILF should surrender its men and allow a fair trial to proceed in courts,” he said.

The lawmaker warned that a non-closure of the issue and the longer investigation continues without the case being solved will have a demoralizing effect to the military junior officers, who are disheartened over the lives lost on their side. GMA must heed Chief Justice's advice to stop extrajudicial killings: ECG

Manila -- Eddie Gil said GMA must take immediate positive action on the rising cases of extrajudicial killings involving members of the media and political activists or risk facing another round of possible impeachment proceedings in Congress.

Eddie Gil, former presidential candidate in the 2004 elections, said that in the recent two-day National Summit on Extrajudicial Killings, no less than Chief Justice Reynato Puno has declared that human rights under the Arroyo administration "is now under assault" and that the political branches of the government have failed miserably in protecting the people, particularly media men and political activists, against extrajudicial killings.

He noted that Puno's decision to organize the summit was prompted by growing concern over extrajudicial killings and disappearances and the apparent weakness of the political branches of the government to address the problem.

This developed, he said, as various sectors have expressed suspicion that the military and the police are behind--or at the very least--have tolerated the killings and enforced disappearances of a big number of persons.

ECG said that "it is now President Arroyo's move -- to take all necessary measures to have all these cases fully investigated and solved as well as to put an end to these forms of terrorism that take place in the Philippines."

According to him, "if Mrs. Arroyo cannot do anything right as a positive response to the Supreme Court-covened summit, then she has no right to remain in office as the highest official of the land."

The Commission on Human Rights has recorded 403 cases of extrajudicial killings and the Philippine National Police's Task Force Usig placed the number of those killed for the same period at 115.

The Families of Victims of Involuntary Disappearances (FIND) urged the immediate passage of a law criminalizing state-perpetrated enforced disappearances of government critics.

FIND said that at present, there is no law penalizing "enforced disappearances," which the United Nations has defined as state-enforced, with the aim of concealing the whereabouts of a person, perceived to be an enemy of the state, to evade accountability.

ECG said that "if nothing positive is done to stop the killings, very soon, the Arroyo administration may be charged with sowing a Reign of Terror in the Philippine archipelago."

His yada-yada and summits are jeopardizing the Supreme Court's independence and impartiality. It's really not his job to advice anyone unless asked in the form of a petition.

The constitution designed the Supreme Court to be dormant until asked to do something; it cannot act on its own volition on matters not brought before it and there's a good reason for this.

The Chief Justice must be reminded of this by someone from within the court, NOT by the Chief Executive, NOT by the Legislature.

Arroyo's net satisfaction ratings fall in IBON survey

More Filipinos remain dissatisfied with the performance of President Arroyo despite government claims of significant improvement in the country's economy, the latest IBON survey revealed Wednesday.

According to the July 2-13 IBON quarterly survey,72 percent of 1,488 respondents were unsatisfied and 10 percent satisfied with Mrs. Arroyo's performance in the past quarter. This translated to a net satisfaction rating of almost –62 percent.

The net rating was much lower than that recorded during the January 2007 survey round, where 61 percent found her performance unsatisfactory and 15 percent satisfactory, for a satisfaction rating of –47 percent.

The figures were much lower than results of the latest Social Weather Stations survey, which showed 39 percent satisfied and 42 percent dissatisfied with Mrs. Arroyo’s performance as of late June. The figures are nearly identical to the 39 percent satisfied and 43 percent dissatisfied in the SWS survey of late February.

The President’s net satisfaction scores of –3 in June and –4 in February are both neutral because they show public opinion as rather evenly divided.

According to the IBON survey, almost 55 percent of respondents gave Mrs. Arroyo a failing grade in her performance as president while 40.3 percent gave her a passing grade.

The President received failing grades in the following areas of governance: the economy; jobs/livelihood, peace and order, peace talks, national unity, combating corruption and social welfare. The President received a passing grade only in the area of foreign relations.

Sixty percent of respondents said Mrs. Arroyo should be removed as the country's president. A total of 80.4 percent of respondents said there was no truth to the government's pronouncement that the economy has improved.

The survey also revealed that 75.6 percent of respondents believe that rampant cheating and violence marred the May 2007 elections, while less than five percent said there was no truth to this observation.

A total of 69 percent of respondents believe that Mrs. Arroyo engaged in corruption and cheating in the 2004 national elections while only five percent said there were no truth to the allegations.

Solons oppose grant of emergency powers to Arroyo

Several opposition and administration senators expressed their reservations over Malacańang’s request for emergency powers to address the looming energy and water crisis, ABS-CBN News reported Thursday.

Senate President Manuel Villar rejected the proposal that would give President Arroyo emergency powers to deal with the effects of the dry spell.

"Hindi ako sumasang-ayon diyan. Naniniwala ako na may sapat na kapangyarihan ang pangulo. Pangalawa, tingin ko ang kailangan ng problema na iyan ay pera (I do not agree to that. I believe the president has sufficient powers. Secondly, I believe what the problem needs is money)," said Senate President Manuel Villar.

"The money is there. The President has residual powers to realign funds in the national budget under her disposal to projects that would address the water crisis. Ang problema lang kasi parang may drought sa pondo (The problem it seems is there is a drought in funds)," Villar reiterated.

Villar said the government should augment funding for programs that would dull the impact of El Nińo on agriculture and water supply in general.

"Aside from the Contingent Fund, the biggest source for the anti-drought initiative is the Agriculture and Fisheries Modernization Act, with a P20-billion funding in the 2007 national budget," Villar said in a statement.

Villa said that under existing laws, any government agency can speed up the procurement of goods during a calamity or emergency situation.

Ramos experience

Senate President Pro Tempore Jinggoy Estrada said former President Fidel Ramos was also given the same power during his term and used that to enter into several deals with adverse consequences on the economy and consumers.

"Nabigyan din noon si dating Pangulong Ramos, ano ang nangyari? Pumirma ng pumirma ng sovereign guarantee kaya lumaki ng lumaki ang utang ng bansa (President Ramos was also given [emergency powers] what happened? He signed sovereign guarantees one after the other and our foreign debt increased)," Estrada said.

Another opposition lawmaker Sen. Benigno "Noynoy" Aquino said that Arroyo had exercised more powers "than those bestowed upon her by the people and the Constitution (as) seen in both the EO 464 and CPR issues".

Francis "Chiz" Escudero echoed the same reservations earlier voiced out by his colleagues.

"I have strong reservations about giving her, or anyone for that matter, emergency powers because it usually results in contracts or purchases that are grossly disadvantageous to the government. And we will definitely look into the problem closely as it might be artificially created precisely for this purpose, to get exemptions from bidding requirements," Escudero said.

For their part, Senators Panfilo "Ping" Lacson and Alan Peter Cayetano said they would like to determine first the reasons behind the proposal for emergency powers.

"Anong klaseng kapangyarihan ang hihingin, paano at saan ito gagamitin, kasama na ang mekanismo laban sa pagabuso nito. Saka pa lamang ako magde-desisyon kung dapat suportahan o hindi ang hiling na ito ng Malacańang (What kind of powers will be requested, how and where will it be used, including the mechanisms to prevent its abuse. Only then will I decide if this request of Malacańang should be supported or not)," said Lacson.

"Before asking for emergency powers, they should tell their plan to deal with the impending crisis and show why execution of this plan requires emergency powers and cannot be implemented with existing powers of Malacańang and normal legislative process," Cayetano said.

Sen. Ramon "Bong" Revilla reiterated that there is no need for emergency powers and the government should instead create "Task Force Tubig" tasked to take swift and decisive actions against the crisis.

NDCC supports grant of emergency powers

Meanwhile, the National Disaster Coordinating Council (NDCC) is in support of the proposal and urged the Congress to grant the president with the needed powers to address the effects of the drought on the economy.

"If emergency funds are more available, then we can conduct more cloud seeding operations" Glen Rabonza, NDCC Executive Officer said during a press conference in Sulo Hotel in Quezon City.

Rabonza said that more provinces in northern Luzon are experiencing the effects of the dry spell. The government, he said, was prompted to conduct cloud seeding in Region 1, CAR, Regions II and III to induce rains to improve water levels in reservoirs.

On Thursday, the NDCC said that Pangasinan, Ilocos Norte, Ilocos Sur and Quirino are studying the possibility of declaring a state of calamity due to the continued dry spell.

In Ilocos region, the NDCC reported that the drought has affected 86,000 hectares of farmlands in four provinces including 26,000 in La Union, 47,500 in Pangasinan, 11,400 in Ilocos Norte and 1,160 in Ilocos Sur.

The Department of Agriculture’s attached agency, Bureau of Soils and Water Management is conducting cloud seeding operations using eight rain-inducing planes. The planes would conduct one or two sorties a day, depending on the condition of the clouds.

"This is just one of the precautionary measures taken by the government to reduce the impact of dry spell," said Rabonza.

Substantial amount of rains needed

The Philippine Atmospheric Geophysical and Astronomical Services Administration (PAGASA) said eight storms should have already entered the country by this time. Only two storms has entered the Philippine Area of Responsibility but headed to Japan.

"We really need a substantial amount of rains in August especially in Luzon," Flaviana Hilario, head of PAGASA's climatology and agro-meteorology division said.

As of 6 a.m. Thursday, the water levels in Angat dam dropped to an alarming level of 171.8 meters. Angat dam supplies 97 percent of water to Metro Manila.

Agriculture Secretary Arthur Yap assured the public that the government is doing everything to control the situation.

"The water we have now is still sufficient to irrigate newly planted rice fields in both Regions II and III," Yap said.

Records from the National Irrigation Administration (NIA) showed that Pantabangan (191 meters) and Magat (162.36 meters) dams have enough supply of water for their respective areas. It added that Pantabangan dam can still manage to irrigate some 102,000 hectares of farmlands until the end of November.

"We are optimistic that with the coming rains, the water levels on the two dams will increase incredibly, thus, there is no real cause for alarm," Yap said.

He added that there will be no rice price increase due to the 2.7 percent expansion in rice production.

He also advised affected farmers to plant short gestating crops, vegetables and root crop that does not need too much water. With reports from Lynda Jumilla and PNA

OFWs hit govt for remittance rule

Overseas Filipino workers are up in arms over the government's proposal for them to send their remittances solely through the Philippine Postal Savings Bank, abs-cbnNEWS.com learned Wednesday.

"Yes it (government) is willing to give us a special rate, provided we course our remittances through their favorite Postal Saving Bank," said Francis Oca in an e-mail from Riyadh, Saudi Arabia.

Oca, a certified public accountant who has beenin Riyadh for the last 23 years, said he feels insulted by the proposal.

Oca questioned a proposal by Malacańang that was backed by President Arroyo's economic managers to allocate $1 billion in funding to exporters for a preferential peso-dollar exchange rate.

The proposal came amid the continued improvement of the peso against the US dollar. From 56 in September 2005, the peso now averages at 45:$1.

"I think we have had enough; I think it is high time that we show some muscle.” He suggested to fellow OFWs to “cut remittances by half during the next six months.”

Vic Barrazona, another Saudi OFW, meanwhile, said that Oca's proposal may not be acceptable to other migrant Filipino workers.

“If a low-income OFW is sending a monthly remittance of US$200, cutting it to half may have an adverse affect to his beneficiaries,” Barrazona said.

He suggested a 5-10 percent reduction in remittances for all OFWs. “It will have a better chance of positive response from our ranks."

The issue started this year as the peso continued to improve against the dollar.

Migrant workers said their remittances are no longer worth the same because of the peso performance.

Exporters, meanwhile, are also feeling the pinch because the appreciation of the Philippine currency would mean a bigger loss for them every time the peso goes up against the dollar.

On Wednesday, the peso closed weaker at 45.83 against the greenback, lower than Tuesday's 45.34.

China finds RP banana chips with 'excessive' sulfur dioxide

Philippine made banana chips exported to China have tested positive for "excessive" sulfur dioxide, a Chinese news agency reported Wednesday.

Xinhua News service reported that two tons of banana chips imported from the Philippines by Qingdao company in Eash China's Shandong province contain excessive sulfur dioxide, which may cause nausea and vomiting.

Sulfur dioxide is used as a preservative for dried banana chips due to its antimicrobial properties.

The report said the General Administration of Quality Supervision, Inspection and Quarantine in China found the sulfur dioxide content found on the banana chips were 25 times higher than the limit allowed by Chinese laws on food additives.

The report said the "tainted" products will be returned to the shipper or destroyed by the agency.

The news report came two weeks after the local Bureau of Food and Drugs banned the importation of several China-made products including the popular White Rabbit creamy candies after testing positive for formaldehyde. Formaldehyde or formalin is a chemical commonly used in embalming.

Aside from White Rabbit creamy candies, BFAD also banned the importation of Balrong Grape Biscuits manufactured by Dongguan Balrong Foodstuff Co. Ltd. and Yong Kang Foods Grape Biscuit, manufactured by Dongguan Yongkang Food Co. Ltd.

The Shanghai-based White Rabbit manufacturer Guan Sheng Yuan Co. later revealed that tests conducted by the company showed that their candies did not contain embalming chemicals. The company said fake White Rabbit products have become rampant in recent years in China and abroad because of the popularity of the famous brand.

A woman at a bar on a Saturday night was taken by 5 men, who, according to hospital and police reports, gang raped her before dumping her. Unable to remember the events of the evening, tests later confirmed the repeat rapes, along with traces of Rohypnol in her blood and Progesterex, essentially a small sterilization pill.

The US Deputy Secretary of State said Tuesday he believes that the Philippines could halt the spate of extrajudicial killings in the country as he urged authorities to focus on the cases of politically related murders.

"We of course know about these reports although the facts are not entirely clear as to the extent to which these killings might be occurring. What we want to do is encourage the authorities, the appropriate authorities, to look into these matters and give them the attention that they deserve," John Negroponte said in an interview with Maria Ressa, ABS-CBN news and current affairs chief.

Negroponte added: "We're confident that the democratic spirit that exists in the Philippines and the concern for justice that exists here, your government and your country could deal with this kind of situation. But it’s a situation that bears watching."

Negroponte is in the Philippines to take part in the ongoing meetings among Southeast Asian leaders and their dialogue partners at the Philippine International Convention Center in Pasay City.

Cases of political killings hound the Arroyo administration not only in the country but also in the international community for its alleged failure to stop the murders. Left-leaning groups have accused President Arroyo and the military of involvement in the slays.

The human rights group Karapatan estimated that more than 800 cases of extrajudicial killings have taken place since Mrs. Arroyo took power in January 2001.

Negroponte, meanwhile, reiterated Washington’s support for the Philippines amid the proposal by the State Department to cut foreign military funding.

"Actually, the money that we're seeking is money that's been planned over a five year period. I think there's a slight dip this year but basically, we want to provide a consistent level of military support," he said.

He also lauded the "significant progress" of the Philippine military in terms of improving its capability.

Negroponte served as US ambassador to the Philippines from 1993 to 1996. He subsequently served as US permanent representative to the United Nations from 2001 to 2004 and was ambassador to Iraq from June 2004 to April 2005.

Prior to his appointment in the state department, he was the first ever US director of national intelligence.

The UN has launched a campaign to highlight human trafficking, an issue it says has reached epidemic proportions over the past decade.

Modern-day slavery affects millions of people around the world, the UN Office on Drugs and Crime (UNODC) said.

Its initiative aims to raise awareness of trafficking both among potential victims and those who buy services or products that rely on slave labour.

It comes as the UK marks 200 years since abolition of the slave trade.

The campaign, entitled The Global Initiative to Fight Human Trafficking, brings together a raft of UN agencies and NGOs.

At the launch in London, UNODC Executive Director Antonio Costa said that the types of exploitation varied from place to place.

Many women are forced to work in the sex trade

"In Europe there may be sex-related exploitation while in other parts of the world there may be camel jockeys, children forced to dive looking for pearls or oysters, people beaten like modern slaves, women in quarries," he told Reuters news agency.

He said the campaign aimed to tackle human trafficking "both on the supply side, in making people less vulnerable and more aware, and on the demand side by showing people some of the services they ask for are forms of exploitation".

He also called for greater commitment from countries to legislate against the human trade and to prosecute violators.

Sex trade

According to a report last year by UNODC, countries that were major sources of trafficked persons included Thailand, China, Nigeria, Albania, Bulgaria, Belarus, Moldova and Ukraine.

Thailand, Japan, Israel, Belgium, the Netherlands, Germany, Italy, Turkey and the US were the most common destinations, the report said.

There are no exact statistics on the number of people affected globally.

But according to UNODC, experts believe that some 2.5 million people throughout the world are at any given time the victims of human trafficking.

Many of these are women and young girls forced to work in the sex industry, while others are men forced to work as labourers in dangerous conditions for little or no pay, the UN agency said.

Unlike the United States with its Federal System, the United Nations does not have a government that can unite all the member countries together. The U.S. and Soviet Union were the biggest violators of the concept of unity with their decades of Cold War. Obviously the weaker states are merely exploited to gang up on an issue under the promise of monetary/military aid so the system has been totally corrupted by bribes and strong arm tactics.

But does that mean we'll just sit back and let the bully nations keep dictating the course of the world knowing the weaker ones are getting victimized by such crimes as human trafficking and human rights violations? I don't think so.

WASHINGTON, JULY 30, 2007 (STAR) By Jose Katigbak, STAR Washington bureau - The US will not reduce its military aid to the Philippines, but the US Congress has expressed concern over extrajudicial killings in the country.

The US House and Senate Appropriations Committees voted to increase foreign military financing assistance to the Philippines to $30 million from the $11.1 million requested by the Bush administration for fiscal year 2008, effectively retaining the amount of FMF for the previous year.

At the same time, the committees voted to increase economic support funds (ESF) to the Philippines to $30 million from $25.9 million for the fiscal year, which starts Oct.1.

But the committees expressed deep concern over reports of extra-judicial killings by the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) and warned of possible repercussions.

The committees directed the State Department to report not later than 90 days after enactment of HR 2764, the department’s foreign appropriations bill on the status of investigations into extrajudicial killings and gross violations of human rights by the AFP and the PNP.

House bill HR 2764 said FMF not to exceed $30 million, the same level as that of FY 2007, may be made available to the Philippines in 2008.

It said an additional $2 million may be made available when the Secretary of State reports to the Committees on Appropriations that “the Philippine military is not engaging in acts of intimidation or violence against members of legal organizations who advocate for human rights.”

The Bush administration’s budget proposals for fiscal year 2008 seek to reduce deficits each year and balance the budget by 2012.

The proposals provide a starting point for negotiations with Congress, which has a final say over government expenditures.

But there is no guarantee the recommendations of the appropriations committees will remain untouched when the issue is brought to the floor of the House and the Senate for final voting.

It was not known why the FMF program to the Philippines in the State Department budget was slashed to $11.1 million.

The program provides grants for the acquisition of US defense equipment, services and training.

For fiscal year 2007 the State Department proposed $17.6 million in FMF to the Philippines, which Congress voted to increase to $30 million.

Last March, Sen. Barbara Boxer, chairman of the Senate foreign relations subcommittee on East Asian and Pacific affairs, chastised the Arroyo administration for not taking “sufficient” action to address unresolved killings, and warned strings may be attached to US military aid to the Philippines to safeguard human rights.

The House committee in a report on its web site said it expected a portion of the ESF funds to be used to support peace efforts between the Government of the Philippines and the Moro Islamic Liberation Front, including through the United States Institute for Peace.

“The committee urges the administration to request additional support if a permanent peace accord is achieved,” the statement said.

Other recommendations include $2,000,000 in international narcotics control and law enforcement (INCLE) funding for the Philippines, which is $850,000 above the Bush administration’s request.

BUSH ADMINISTRATION WANTS MILITARY AID TO THE PHILIPPINES CUT

State Secretary Condolezza Rice did not attend the ASEAN meeting in Manila for a very good reason.

Due to billions needed in Iraq, she overhauled the way the aid pie is doled out to over 120 countries.

In her testimony before the Senate foreign relations committee, USAID Director Henrietta Fore said next year’s proposed foreign operations budget is designed to “help build and sustain democratic, well-governed states that respond to the needs of their people, reduce widespread poverty and conduct themselves responsibly in the international system."

The new policy resulted in proposed cuts in foreign aid spending for many of America’s allies, including the Philippines.

Thus, the State Department had recommended cutting Foreign Military Financing (FMF) to the Philippines from $29.7 million to $11.1 million, and the International Military Exchange Training (IMET) from $2.9 million to $1.5 million in Fiscal 2008.

Obviously the biggest issue against the corrupt government of the Philippines is the ongoing violation of human rights which is attributed to the military and police as determined by both local and foreign investigators.

While the Arroyo government may claim that military aid has not been cut because the current version of HR 2764 sets a higher FMF ceiling for the Philippines despite budget request of the Bush administration, it will still fall on the State Department to implement it.

“All it says is that they can not exceed $30 million; but for us that could mean one, ten, 20 or hopefully 30 million, just so long as they don’t exceed $30 million,” one Philippine official explained.

The bottom line therefore, it behooves the Philippine government headed by Gloria Macapagal Arroyo to ensure that, as commander in chief, the military is doing its job to protect the people instead of preying on them to eliminate her political enemies. The United States cannot be an accessory to the crimes committed against the Filipino people by continuing to provide military aid that wind up being used to kill oppositionists and militants just because they do not agree or are critical of the corruption and incompetence of the Arroyo government.

In the 50's and 60's professionals who left the country
were scrutinized very well by the US Embassy. If one claimed
to be a doctor or engineer they ask for your liscene, experience
and school record. Those individuals were tagged as brain drain
and when they arrived at their port of entry they easily find a job
because the state they entered certified doctors and engineers were
needed. These group of people were experienced and highly articulate
in their field of endeavor. I seldom see this kind of ability with
the new comers because the embassy during the later years were more
relax with their requirements. To those who came well preapared asimilation
with main-stream America was easy but for those who came later they seemed
to have a hard time and always complain of descrimination.

I have met a lot of them...temid, passive and not agressive enough to defend
themselves from verbal abuse or percieve descrimatory acts....I have help some.
Most feel like a second class citizen and seemed to bow when a cuacasian talks to them.
Conclusively, if one has to choose between properity and self-respect an answer could be had.

SAN FERNANDO CITY, La Union – The 345-megawatt San Roque Dam power plant in Pangasinan, considered one of the biggest in Asia, has stopped operations due to inadequate water supply.

Engineer Ruben Cuta of the San Roque Multi-purpose Project (SRMP) told The STAR that the three water turbines that generate electricity were shut down because the water level had already reached 225.7 meters, which is very near the critical level of 225 meters above sea level (masl).

“The water level is already in critical condition. Our minimum operating level is 225 masl and we only have 225.7 masl. We stopped operation. If we run now, we will incur possible damage to the turbines,” Cuta said.

SRMP has the capacity to generate 345 MW and supplies power to the whole of Luzon and parts of Visayas.

Cuta said that water coming from Binga and Ambuklao dams in Benguet has also stopped flowing.

Pilipinas Shell Petroleum Corporation, Petron Corporation, Total (Philippines) Corporation and Unioil Petroleum Philippines Inc. announced increases in the prices of their oil products, ABS-CBN News learned.

Pilipinas Shell Vice President for External Affairs Roberto Kanapi announced Friday that the oil company will increase the pump prices of its gasoline, kerosene, and diesel products by P0.50 per liter. The increase in pump prices was implemented Saturday, 6 a.m.

Petron on 12:01 a.m. Saturday raised the price of gasoline, diesel and kerosene by P0.50 per liter (inclusive of Value-Added Tax [VAT]).

Meanwhile Total Philippines and Unioil Petroleum announced that pump prices of its diesel, gasoline and kerosene products will increase by P0.50 per liter (inclusive of VAT). The hike will be implemented 12:01 a.m. Sunday.

Oil companies said the hike in pump prices is needed to reflect the increase in the cost of petroleum products in the world market.

Petron cited that the Dubai crude oil contract prices average month to date on July is $69.54, close to $4.00 higher than the June average of $65.79.

Doubt raised about RP devt plan

Barely a day after President Arroyo announced plans to spend P1.7 trillion (US$38 billion) on development, the international credit rating agency Fitch Ratings warned she didn't have the money.

While government planners make assurances that Fitch's fears are unfounded, there is widespread agreement that the deficit threatens to derail Mrs. Arroyo's economic achievements.

"We have been investing hundreds of billions in human and physical infrastructure. The next three years will see record levels of well-thought-out and generous funding, for government projects," Mrs. Arroyo told Congress in her annual State of the Nation Address on July 23.

She outlined a wish list of projects ranging from roads, airports, land redistribution, water and sewerage and power as well as education and research, which she wanted to start before stepping down in 2010.

But the Fitch Ratings report, issued just after Mrs. Arroyo's speech, said poor revenue collections in the first half of 2007 made it unlikely that the country will keep its budget deficit within a P63-billion ceiling.

Based on first-half fiscal data, Fitch expects the deficit to near double to P125 billion, equivalent to 1.9 percent of gross domestic product (GDP), not including possible sales of government assets in the second half.

"The positive momentum behind Philippine fiscal performance in recent years faltered badly in early 2007, particularly with respect to tax collection," Fitch said in a statement.

"With real economic growth expected to have averaged about 6.5 percent in the first half of the year, the 3.4 percent increase in tax receipts was rather poor," said James McCormack, head of Asia Sovereigns at Fitch.

The rating led the Manila Times newspaper to warn that "without improvements in tax collections, something has to give."

This likely means cuts in expenditure or more government borrowing.

The political opposition, which controls the Senate, is determined to block any new revenue measures.

The budget problems come just before a visit by International Monetary Fund (IMF) managing director Rodrigo de Rato, starting July 30.

Although the Philippines cleared the last of its IMF debt last year the fund continues to watch the country's finances.

But officials dismissed Fitch's criticism and insist they can keep the deficit within target, mainly through privatization deals.

"Fitch did not really say anything new except that what was rather unclear in their forecast," said Finance Secretary Margarito Teves, adding both customs and internal revenue bureaus would be increasing their collections and that privatization earnings would make up the shortfall.

But critics say selling government assets will merely be a short-term measure that cannot be repeated annually.

The Philippines has been struggling to control its budget deficit for years while searching for funds to upgrade its crumbling infrastructure.

Mrs. Arroyo thought key tax reforms would solve this and after some initial success in 2006, her government began targeting a balanced budget by 2008.

But the deficit figures for 2007 reveal the tax changes she pushed for were inadequate.

Even before her speech, the controversy over revenues had caused divisions among her top financial officials, leading to the removal of the internal revenue chief, Jose Buñag last month.
Buñag charged that he had been made the scapegoat for the government's failure to hit its collection targets, which he said were "unrealistic."

Jose Vistan, head of AB Capital Securities Inc. says that "the government set the bar a bit too high," raising the expectations of foreign creditors and equity markets.

He warns that "we still have some work to do, some corruption issues to address, some strategies on how to widen the tax base without introducing new taxes."

This will mean attracting more investment and increasing employment to ensure there are more tax-payers and also cracking down on tax evasion.

"A lot of the taxpayers are not paying the right taxes," Vistan said.

An Irishman in a wheelchair entered a restaurant one afternoon and asked the waitress for a cup of coffee. The Irishman looked across the restaurant and asked, "Is that Jesus sitting over there?"

The next patron to come in was an Englishman with a hunched back. He shuffled over to a booth, painfully sat down, and asked the waitress for a cup of hot tea. He also glanced across the restaurant and asked, "Is that Jesus over there?"

The waitress nodded, so the Englishman said to give Jesus a cup of hot tea, "My treat."

The third patron to come into the restaurant was a Redneck on crutches. He hobbled over to a booth, sat down and hollered, "Hey there, sweet thang. How's 'bout gettin' me a cold glass of Coke! " He, too, looked across the restaurant and asked, "Is that God's boy over there?"

The waitress once more nodded, so the Redneck said to her "give Jesus a cold glass of Coke, on my bill."

As Jesus got up to leave, he passed by the Irishman, touched him and said, "For your kindness, you are healed."

The Irishman felt the strength come back into his legs, got up, and danced a jig out the door.

Jesus also passed by the Englishman, touched him and said, "For your kindness, you are healed."

The Englishman felt his back straightening up, and he raised his hands, praised the Lord and did a series of back flips out the door.

Then Jesus walked towards the Redneck.

The Redneck jumped up and yelled, "Don't touch me...I'm drawin' disability." And I don't wanna lose my disability check!

Govt, MILF issue gag order on Basilan ambush probe

The government and the Moro Islamic Liberation Front agreed Friday that both parties will refrain from issuing public statements regarding the investigation into the clash between the Philippine Marines and MILF members in Basilan earlier this month.

The encounter in the town of Al-Barka resulted in the beheading of 10 of 14 slain Marines. The Marines were on a mission to rescue kidnapped Italian priest Giancarlo Bossi when they were ambushed by MILF members.

The priest, however, said upon his release in Lanao del Norte last week that he was never in Basilan throughout the ordeal that began on June 10 when he was abducted in Payao, Zamboanga Sibugay province.

The deal was reached between the government and the MILF as a joint fact-finding team arrived in Basilan to investigate the July 10 battle.

The agreement was added to the joint resolution signed Monday by the Coordinating Committees on the Cessation of Hostilities (CCCH) of the government and the MILF.

Based on the agreement, both parties told their members "to refrain from issuing public pronouncements that will further complicate the situation in Basilan, aggravate the heightened tensions felt in other parts of Mindanao, or compromise the integrity of the ongoing fact-finding mission."

They also promised to “avoid making public statements that will pre-empt the outcome of the fact-finding activity presently being undertaken by duly-constituted bodies in the affected areas."

Basilan Vice-Governor Al-Rashid Sakkalahul and representatives of Bantay Ceasefire, an independent group, witnessed the signing of the addendum.

The fact-finding panel said it expects to finish the investigation by month's end.

The six-member probe team is led by Brig. Gen. Edgardo Gurrea, the government’s chairman for the CCCH, and Von Al-Haq, his MILF counterpart. Bantay Ceasefire is also joining the investigation.

The team said it will conduct interviews among combatants from the military and the MILF as well as residents in the battle zone to determine if the ceasefire agreement was breached during or after the clash.

No sanctuary
The agreement states that the MILF is not supposed to give sanctuary to suspected terror and kidnap-for-ransom gangs in its territories.

At the time of the gunbattle, the Marines were acting on an intelligence report that Bossi's kidnappers took him to Basilan.

Aside from determining possible violations in the peace agreement, probers will also pinpoint those behind the mutilations of 10 Marines. Guidelines will also be set to avoid a repeat of the incident.

The MILF, meanwhile, assured that if the investigation shows that its men are guilty, it will not hesitate to hand them over to authorities.

"[The investigation] manifests the strong spirit of cooperation and unity between government and the MILF in resolving the unfortunate incident, regardless of the outcome of the probe in the interest of truth and justice," Gurrea said.

In the event of war
At around the same time the deal was reached between the government and the MILF, President Arroyo was in Zamboanga City for a command conference with top officials of the Armed Forces led by AFP chief Hermogenes Esperon Jr.

The conference at the Western Mindanao Command headquarters tackled the possibilities in the event the military pushes through with the proposed all-out war against the MILF following the massacre of the Marines.

ABS-CBN correspondent Jorge Cariño quoted sources as saying that part of the measures is to provide security for civilians in affected areas.

The President was accompanied to the meeting by Basilan Rep. Wahab Akbar, Gov. Jum Jainuddin-Akbar, Budget Secretary Rolando Andaya and Zamboanga City Mayor Celso Lobregat.

who believe that Christ was the Messiah but the Jews
believe that the Messiah is still to come...this started
anti-semitism and agrevated more for their success in any field
of endeavor either in trade or profession. To some degree I dont
call such anti-semitism but rather purely jealousy or more of enviouness
due to their sucess.

In old Europe the Jews could hardly find a descent work and were pushed
to do menial jobs; clerks in banks, clerks for merchants and helpers
in most professional fields. Then one day Germany, Poland, France, Russia
and most Scandinavian countries woke and found out most banks were controlled
by the Jews, jewelries and diamond markets were controlled by them and practically
all professions were headed by the Jews.

I brought this issue out simply because the circumstances of the OFW are better off
than the Jews of Old Europe.

Brownouts may occur anytime--Transco docs

MANILA, Philippines -- The state-owned National Transmission Corp. (Transco) has placed all power distribution companies on “red alert” since Wednesday, indicating that power interruption could occur at anytime without warning, according to documents released by an electric cooperative in Benguet province.

Parts of Metro Manila, Bulacan, Rizal and Laguna experienced two hours without electricity two days ago after Manila Electric Co. (Meralco) implemented rolling brownouts because of the low power supply.

Baguio City and eastern Pangasinan also suffered power outages.

A dry spell that has slowed down hydroelectric power plants, a major shortfall in the coal supplied by government to independent power producers (IPPs), and the breakdown of old power plants have resulted in a “zero-system reserve,” Transco said in a July 23 memorandum that explained its alert status. Transco operates the national power grid.

Gerardo Versoza, general manager of the Benguet Electric Cooperative (Beneco), said “zero reserve” means Transco would need to reduce the power load that reaches households in Luzon should a power generating plant break down.

To do this, Transco must shut down power in selected provinces to keep electricity flowing smoothly through the national power grid. This explains why blackouts have been occurring intermittently in the provinces, Versoza said.

What a difference being out of the congressional power circle makes.

Some members of the administration’s Kabalikat ng Malayang Pilipino (Kampi), which formed an alleged “independent bloc” or “conscience bloc” in the House of Representatives as an offshoot of their failure to wrest the Speakership from Pangasinan Rep. Jose de Venecia Jr., yesterday announced that, as part of the reforms they have spoken of, they will no longer immediately dismiss, or kill another impeachment complaint against President Arroyo and will now act on the merits of the complaint, in the event another impeachment complaint is lodged before the House.

Sorsogon Rep. Jose Solis, spokesman of Kampi’s bloc allied with Camarines Sur Rep. Luis Villafuerte, said the bloc will no longer just dismiss impeach-ment complaints on the basis of their political affiliation with the administration and will instead consider the issue on the basis of the merits of the case.

The Kampi bloc of Villafuerte has supported the speakership bid of Cebu Rep. Pablo Garcia while the other bloc headed by Interior and Local Government’s Sec. Ronaldo Puno supported De Venecia.

It will be recalled that this same group of congressmen that had formed themselves into an “independent bloc” in the House were the very ones who denied the then opposition congressmen from even being given the opportunity to at least present their evidence before the House Justice committee, insisting on killing the complaint without any discussion at all.

“As far as the conscience bloc is concerned, we will make a decision based on the merit of the case. We will decide not on account of our political affiliation (with Mrs. Arroyo),” Solis said yesterday at a media forum in Quezon City even as he stressed that they have no plan of filing an impeachment complaint against Mrs. Arroyo whom they consider the “creator” of Kampi.

The opposition in the House however, has already said that it will no longer lodge another impeachment complaint against Mrs. Arroyo.

Still, if the independent bloc and the opposition join hands, the two groups can count on 73 congressmen that will at least give an impeachment complaint a chance to be heard.

A congressional source allied with the opposition, however, commented that this new stand of Villafuerte’s Kampi bloc may just be “a means to get back at (Mrs. Arroyo)” for her alleged “betrayal” as the President had promised the Pablo Garcia camp that she would stay neutral in the speakership fight but rooted for De Venecia anyway.

“They (kampi independent bloc) know very well that the President fears an impeachment complaint even being tackled. This is just a meaningless threat they are issuing. In the end, they will will do what she wants them to do,” the source said.

Among the members of the so called “independent bloc” are Villafuerte, Solis, Garcia, Cavite Rep. Joseph Abaya and Quezon Rep. Erin Tañada, both of the Liberal Party.

It was learned from House Secretary General Roberto Nazareno that the impeachment complaint filed earlier by lawyer Oliver Lozano had not been endorsed by a single congressman and therefore failed to meet the requirement in the filing of an impeachment complaint. The office of the secretary general has reportedly returned the complaint to Lozano.

Paranaque Rep. Roilo Golez, a member of the minority bloc, also said it would be better for them to buckle down to work than pursue another impeachment complaint against Mrs. Arroyo. Golez, during the recently concluded elections was reported to have allied himself with the Arroyo administration.

Golez, singing the tune of Kampi’s “independent bloc,” explained that the government needs reforms more than a “divisive” impeachment case against the President.

“We would like to work hard. We need constructive participation in the next three years. By the time an impeachment process is completed, the term of Mrs. Arroyo will be nearly over,” he said.

Solis also warned that De Venecia would launch another attempt at Charter change.

He pointed out that the moratorium on Charter change ends in December and that another people’s initiative would again be brewing in the coming weeks.

“What Speaker de Venecia said about a moratorium is only up to December. The way I understand it, by January (2008), the People’s Initiative” will start again, “ Solis said.

De Venecia, however, dismissed Solis’ allegation even as he said he would maintain the moratorium in Charter change in order to focus on Malacañang’s priority bills.

“I don’t want to be hypocritical, for the last 15 years I have been pushing a unicameral-parliamen-tary form of government. But let’s have a moratorium on Cha-cha,” de Venecia said in another forum.

De Venecia said the House will focus on socio-economic bills dealing with cheap medicines; education, power and water for the next 100 days even as Congress awaits the formal submission of the proposed General Appropriations Act for 2008 by the President.

“We have already referred to the appropriate committees some 500 national and local bills and some 30 resolutions filed by members of the House,” De Venecia told the Newsmakers Forum.

“But we shall give top priority to those that greatly affect our masses and the country’s economic development.”

De Venecia also said the House will finalize by next week the election of chairmen of the different standing committees to tackle the hundreds of measures now awaiting committee action. On the efforts to reduce power prices and push national productivity, De Venecia said he is in close consultation with Rep. Mickey Arroyo, expected to be named chairman of the Committee on Energy, on the proposed amendments to the Epira Law.

That's right. I never said that I am unique in this aspect. But then that simply highlights the tragedy that is the Philippines. For every one Pinoy applying these principles to himself/herself, there are a thousand other Pinoys who undermine this effort. Kung baga, whilst there is a sizeable absolute number of Pinoys who are self-reliant, work smart, and are forward thinking, there are millions that are mired in dukha mentality, work hard but not smart (do the same thing year after year without improving efficiency or producitivity by thinking up and applying innovative solutions), and utterly lack foresight.

You're right. It has nothing to do with education or business. The Philippines, back in the 50's, had the most literate and educated population in the Far East, and had an immense head-start over the rest in terms of getting connected with the world economy (scholars were sent from all over the region to study in our universities and learn governance from Pinoys -- how's THAT for irony).

So what happened?

Well, in my view, despite all those trappings of sophistication, the underlying character of Pinoys eventually shone through -- our lack of imagination (we patted ourselves on the back for 50 years for inventing the jeepney), lack of foresight (we had and continue to have the lowest savings rate in the region), and bizarre deluded self-perception (despite decades of steady decline in the face of monumental achievement of the Asian Tigers, we still fancy ourselves as terrific people).

Our collective mediocrity is, therefore, fundamentally structural in nature -- from the way we raise our kids (we force them to adhere to values that deliver zilch, essentially), we tolerate half-arsed work (pwede na yan mentality), and are too lazy to plan and deliberate thoroughly (bahala na mentality).

I don't have to prove anything to you because you are already leading to the answer you seek. You are right, the 50's marked the pinnacle of economic and technological growth for the Philippines with our progress closely behind Japan. Solid state technology was about to replace the old vacuum tube and the colleges and trade schools were cranking out the engineers and technicians that were to serve as the prime movers of the new found techonology.

So what happened to the Philippines despite all that promise and potential? As one Singaporean businessman told me "Your country was on the verge of an economic boom in Asia and all the ingredients were there, except one."

I for one do not believe it was the resurgence of mediocrity that caused our miserable downfall because the products of our educational systems are still around, practicing their skills and proving their productivity to the world. The only question now is where are they and who is reaping the benefits of their talents?

Are you getting the drift? From the peak period of the 50's, all one has to do is follow history in order to discover what events transpired that led to the sad situation that we are in now. Open both your mind and your eyes to the truth and your biases will gradually disappear.

If you love the Philippines, then you should also love yourself because you are a Pilipino. I'm sure you will find the right answers if you try.

I love myself, yes, and I love being Filipino. But when i say that, I speak for myself as an individual and as an individual Filipino.

The assertions i make are about Filipinos as a collective.

Don't get the two mixed up (as many of my detractors tend to do).

And I think i know where you are leading to in your fourth paragraph, particularly where you say: "all one has to do is follow history in order to discover what events transpired that led to the sad situation that we are in now". Sure, there are events that led to the failure of Pinoy society to prosper. But one can argue that other countries had far bigger challenges than what we as a society faced; to cite a few:

South Korea was a war ravaged country well into the mid 50's, AND THEN was ruled by a succession of corrupt dictators as well.

Singapore seceded from the Malay federation and was under constant military pressure thereafter (not to mention being dependent on Malaysia for 80% of its water supply).

Taiwan is de facto at war with China, was ruled by dictators as well, yet managed not only to attract robust foreign investment but developed its own indigenous world-class manufacturing and (later) high-tech industries.

So if you are going to be an apologist for "historical events" that time and again have been used as EXCUSES for the chronic failure of Pinoy society to prosper, here's what i have to say:

THINK AGAIN.
