Local news is reporting that the Cal. Supremes have ruled in favor of Prop. 8, the ban on gay marraige. Will of the people, and all that, even in Cal. Amazing...
I think there will be some unhappy zealots when they realize that all of those same sex couples who were married before prop8 are still legally married. California will recognize the marriage of all same sex couples who were married before the passage of prop8. (as per CA.)
While I don't like the result, I really don't see how the court could have found differently, given that this was an amendment to the California Constitution. As far as I can understand, it doesn't make much sense to say the text of a constitution is unconstitutional.

They have to accept the law just like the proponents did. Apparently Prop 8 didn't negate the marriages already performed....which would not be right to do. They can try to get it repealed through the voters, which I doubt will work. I think this fight will be going on long after we are all gone.

Well I do know Ca. I'm a native Californian. Been here almost 73 years. I fought the Gray Davis recall. I knew Arnold was a lousy actor and would be a lousy GOv. too
I believe the people kicked Gray out because he had us in like $5 Billion in debt. I wish he were back. Arnold has us so much in debt we'll never recover.

I think this one is headed for the USSC under the equal protection clause.
Here's the precedent for taking Prop 8 to the USSC.....

In that case, a constitutional amendment in the state of Colorado prohibited governmental units from passing any statute, regulation, or ordinance purporting to protect the rights of homosexuals or bisexuals. The U.S. Supreme Court held that the amendment violated the Equal Protection Clause because it explicitly denies a single group protection under the law.
