Prop 8 Stands.

  Local news is reporting that the Cal. Supremes have ruled in favor of Prop. 8, the ban on gay marraige.  Will of the people, and all that, even in Cal.  Amazing...

I think there will be some unhappy zealots when they realize that all of those same sex couples who were married before prop8 are still legally married. California will recognize the marriage of all same sex couples who were married before the passage of prop8. (as per CA.)

While I don't like the result, I really don't see how the court could have found differently, given that this was an amendment to the California Constitution. As far as I can understand, it doesn't make much sense to say the text of a constitution is unconstitutional.

They have to accept the law just like the proponents did.  Apparently Prop 8 didn't negate the marriages already performed....which would not be right to do.  They can try to get it repealed through the voters, which I doubt will work.  I think this fight will be going on long after we are all gone.

wasn't the pro same sex marriage argument that the proposition needed to pass by a higher majority to amend the constitution? That's what the court ruled against.

Hmmmm.  Within just 2 weeks, California voters views stood on denying increased taxes and now this.  Looks like they're taking their state back.

....HAVE much of a state to "take back" before long, carolyn.  I feel sorry for many of them (we have both friends and relatives in CA), but they have brought this onto themselves, imo......by electing a silly C rated actor AGAIN as their governor.

Well I do know Ca. I'm a native Californian. Been here almost 73 years. I fought the Gray Davis recall. I knew Arnold was a lousy actor and would be a lousy GOv. too

I believe the people kicked Gray out because he had us in like $5 Billion in debt. I wish he were back. Arnold has us so much in debt we'll never recover.

However, I suspect that this will lead to yet another judicial challenge..  CA now has 18,000 same-sex married partners, and their legal status cannot be reversed, and you have many others claiming differential treatment.

I think this one is headed for the USSC under the equal protection clause.

Here's the precedent for taking Prop 8 to the USSC.....

Gay and lesbian rights group claimed a victory in 1996 with the Supreme Court's decision in Romer v. Evans, 517 U.S. 620, 116 S. Ct. 1620, 134 L. Ed. 2d 855 (1996). In that case, a constitutional amendment in the state of Colorado prohibited governmental units from passing any statute, regulation, or ordinance purporting to protect the rights of homosexuals or bisexuals. The U.S. Supreme Court held that the amendment violated the Equal Protection Clause because it explicitly denies a single group protection under the law.

but no one is obligated to stop there unless we all agree that it is a valid stop sign

Its all just right wing bullshit. We are a democracy, we are just not an Athenian democracy on the national level. After all the mechanisms that sustain a city-state are different than those needed to span a continent. The far right fanatics keep saying that the United States is not a Democracy because they hate democracy, just as they lie about liberalism because they hate the great Liberal Document otherwise known as the Constitution. Every patriot on the right should ask themselves why their leaders have to lie about democracy and liberalism and try to rebrand them. There is room for both a left and a right liberalism but not for the fascism that has taken over the Republican party and miscalls itself conservative.

IMO, One day soon America will stop the prohibition of same sex marriage. I sincerely hope we are all here to see it happen.
