Sometimes Supreme Court Justices will go outside of Constitutional Law to International Law in order to justify their ruling. I personally disagree with this practice with the exception with International Law where the United States had a hand in drafting. The Geneva Convention for example. Gee, in a perfect world (e.g. before income tax) that would be great.  But then what would all the rich politicians do to make money?  What would the power hungry religious right use to trample non-believers' rights?  Let's face reality, you'll never see goverment out of your pockets in our lifetime, in fact, it will get worse.
