We the people must stop Social Service’s abuses against the children, and innocent parents. We must make new laws happen. Too many children are in foster care already. It costs the tax papers more money to place children in foster care then welfare. The juvenile courts procedure must change.
Here are the lists of changes that need to be made in the juvenile and adult proceedings. Without these changes more innocent families may lose their children to the foster care system.
This is a petition to change the California juvenile courts system. We need to change the Welfare and Institution Code and rules of the Superior court. We want to make sure that parents get a right to a fair trial in the juvenile courts and that parents get treated with fairness. There are 5 major changes that need to be corrected in the juvenile courts.
1. We need the right to a trial with at least six peers. At the present time one judge makes the decision for a child's life.
2. We need to open the courtrooms so citizens can understand what is going on in the juvenile courtrooms. At the present time courtrooms are closed to the public. Parents need the right to have family members and advocates in the courtroom. The public should have the right to know.
3. We do not need to allow double jeopardy in the juvenile courtroom. At the present time parents are retried in the juvenile courts after being found innocent in a criminal court. This should not happen.
4. In order to accept the contract of the reunification plan, parents should not have to waive their rights to a trial. At the present time, the minute order in the parents file states in small print. "Submit to allegations waives right to a trial." Parents need to be able to plea bargain without being forced to waive their rights.
5. Hearsay should not be admissible in the juvenile courts. The juvenile courts need to produce more factual evidence. At the present time in the social workers' report, hearsay evidence is admissible. The juvenile courts need to produce more evidence.
