If you live in California, I would like to start a CPS movement. We must do everything in our power to fight back CPS. That includes taking CPS to court. If you are willing, we must start by a claim form, from your local County. Then file your claim on libel, what CPS said about you. That is the fist step toward LIBEL, meaning written words of slander. After they reject your claim. Then you go to your local Superior Court and ask for a fee waiver. After you completed the fee waiver attach your proof of income. Then you go back to the Superior court house and ask for a Complaint form called personal injury and a Summons also ask for a declaration form. You complete the forms. The declaration form you fill out what the social worker said about you in writting and give the name of the social worker and the name of the adult juvenile court and address and date that it took place. Make sure you don't sign the Summons back because that is the proof of service, you make two copies of each of your documents. You go back to the Superior court house and file your papers. Then you get your Summons file and Complaint and Declaration file. You have your Summons serve with the Complaint, you do not serve them, have some one else serve them. After they are serve you have someone fill the back of the Summons as proof of service. Take your Summons back to the Superior court house and file the Summons, that is proof that they were serve. Now wait for them to answer the complaint. CPS will not like if there is a flood gate of filing of lawsuits against them. Then go to a paralegal of your choice and ask for help. CPS may file a motion to throw your case out, just file an ammended Complaint with your paralegal and have them serve again.
