I am a distressed single father of two wonderful boys. We moved to the state of Georgia in October of 2000. Everything was fine until the day after Christmas. I left my children in my mother's care in Illinois for their holiday break. I was unable to attend Christmas due to the weather not permitting.
My youngest son David (age 5 ) was ready to leave with my sister for the week. My sister went to the store briefly before starting her trip to Bloomington. David was having problems and threw a tantrum. My mother told him to wait out on the porch for his aunt who was going to be returning within ten minutes. David ran off and my mother couldn’t locate him. Someone had turned David over to the police and when they arrived everyone in my immediate family was searching the block, but they still arrested my mother and placed my two children into foster care. I fought a court battle until February 15 2001. I signed a plea of guilty for leaving my child with an improper caretaker (my own mother, in witch her charges were later dropped) about a month went past after since my children were returned when the local DFCS office had a few complaints. There was no solid evidence to support their allegations, but since I was under supervision, my children were removed from their Georgia schools by Illinois DCFS and placed into custody. They were separated from each other; the oldest John (age 7) was placed into a mental hospital and heavily drugged, while David was placed more than 100 miles from him. I cannot explain how I felt when I saw John in there. That first blank stare from those heavily drugged eyes are forever branded in my memory; it took him at least 20 seconds to recognize me. They had him on concerta and risperdal, yes risperdal the same drug that isn't approved by the FDA for anyone under the age of 18! My son David has been on concerta, witch is rildin in a time-release capsule. ridlin isn't approved for children under the age of 6 by the FDA. He used to be so sharp, but now all he does is space off. I cannot even have a conversation without him spacing off. My 7 yr old is already exhibiting the "goofy" appearance i have seen in so many other children who have been drugged. his extremities are becoming thin and his speech is almost blurred. My child's pediatrician strongly advised against medication for these very reasons.
Now comes the time to where I have a choice, I can give up my job and move to Illinois where the job market is slim to none and draw public aid, or let my children continue to be used as medical guinea pigs for 6- 12 months. This probably won't stop it, they'll most likely force me to drug my children or they will remove them from my physical custody.
I just relocated to Illinois this past week, and learned of the latest concern with my so David.
David had been hospitalized for behavior problems, and I was told after my last visit with him, that he had a tantrum and by the means of his small fingers he had pulled three healthy teeth. I have had medical education in college to a certain degree, and find it physically impossible! The doctors performed an EEG, which revealed seizure activity, but keep in mind that this is a known side effect of one of the medications he was on. Now they have him on and adult dosage of celexa and this is not supposed to be given to anyone suffering from or with history of seizures. I suppose the 100 Mg of Tegretol must be to counter react it. Isn’t this something like “ Speed balling”?
My case plan for me to work on right now is parenting skills. I guess they say I pay too much attention to one child than the other, I guess that is dangerous, and a good reason to keep my children removed from me and supervised visitation(just like a pedophile).
What can I do? Aren’t there any laws to help my children? This has got to be unconstitutional! The only difference between the Gestapo and social services is the black boots.
For God's sake it's illegal to do this to animals, why do we condone it upon our children or worse yet other people's children? There should be criminal consequences for these crimes against humanity!

I live in Arapahoe county Colorado. I have been fighting social services here for quite some time. They first made allegations against me in 2000. I forced them to go to a jury trial and I won. Now 10 months later they have found an excuse to file a new Dependency and Neglect charge on me. They are trying to take all three of my children away from me and I need any suggestions I can get for how to stop them. I am also working on locating people that have been falsley accused in this area so that I we can get together and possibly file a class action suit. Hello angel, The repeated torment inflicted on Colorado families and their children seems to be a common thing. If they don't destroy you the first time around, they apparently will file seperate accusations until they do succeed in completely destroying families in the name of money and brusied caseworker egos.
My brother-in-law is in Arapahoe County and he just barely had a run in with CPS and is getting ready to do battle with them. Unfortunately we referred him to an attorney recommended by Dean Tong - big mistake. We were lucky to run across Suzanne Shell at www.profane-justice.org. She lives in Colorado Springs and she's been a BIG help in this current, ongoing situation.
I urge you to contact her immediately about your situation and see if she can help out. You sound like a fighter so you and Suzanne should get along just fine.

The fact remains that for my three children to have beenstolen from me the accusers had to resort to lies and denying me of my guaranteed constitutional rights. What else is there to say? The Father of the lie is Satan the Devil and to lie and to steal makes you a child of the Devil.

the problem with class action lawsuits is the extensive diversity of problems and families of the individuals involved in the lawsuits. these lawsuits only have any chance of success if filed in federal courts under the various civil rights laws. most states have passed laws against being sued and you can't sue them.
in addition, we actually need a grass roots political organization to CHANGE the laws regarding child abuse and to put the juvenile court systems out of business regarding claims of parental abuse. all parental abuse cases should be heard in criminal court. criminal court has very different rules of evidence and very few cases would make it through these courts.
i made several errors in judgement when involved with CPS and DCFS. first and foremost make yourself aware of the policies and procedures - you can obtain their manuel - most states sell it to you some provide it for free. learn what is considered child abuse in your state - most libraries have copies of the human service codes and the laws governing those laws. you must become the expert. learn which agency perform which functions and make sure you know the title of the individual that is comping to your house, ask for their cards, make a notebook, keep notes so you can keep the all these individual straight. check out family preservation as a mean of getting your children back. decide if you really want an older accusing child back home at the risk of losing your younger kids
once you have done all your home, know the laws, the human service codes, and the policies and procedures you are then ready to plan your strategy - both long term and short term and make informed decisions. make sure you gain copies of your records after each and every CPS-DCFS visit so you are aware what is being written about you. get copies of all the juvenile court records and the court tape as soon as possible. you are entitled to these in most states. learn the appeals process and appeals ALL the decision that you are unhappy with. always, always, keep your cool and your emotions under control when in contact with the governmental employees. never plead guilty to anything. you can be inappropriate, you can be mistaken, you can be wrong, but don't be guilty.
I agree very much that child abuse cases should be moved to
criminal court with full constitutional rights afforded to
the accused.

I think you should think about the things you have done before you try and say you are falsely being accused of child abuse. You think you are being accused because telling your daughter not to do things, that’s not what she or CPS was accusing you of doing. It was all the times you would refuse to buy your family food and supplies to live, for example medical supplies and clothes. Also you need to get help with your alcoholism. You are lying to yourself and trying to make yourself believe you did nothing wrong and that you are not an alcoholic and you keep telling yourself you were being accused doing normal things. But you really need to think hard about what you do.
on january 29th i took my daughter tameeka of 6months to lebanon general hospital for a bloodshot eye.The doctor "paulson" is his name accused me and my fiance of sbs.I told him he was crazy and he called cps on us.Cps took our daughter and the sheriffs treated us like criminals.Several exams later proved an infection in her nasal cavity was the culprit for this hemotoma in her eye.What we went through was not right.Is there any reprocussion for this?Or any lawyer that would pursue the hospital for the wrong diagnosis?They shouldnt be able to get away with this!Anyone that knows what couse of action to take please e-mail me.tgmoser2002@yahoo.com

Catholic Charities told us we failed the adoption study after we raised the child from 3 days old to 33 months old. Who took your nieces and how old were they? In our case it seems my sister supposedly told many lies about me that were not verified and she now has the children, but their first plan was to take her and give her to an adoptive family. My fiancee' and I have just became victims of Cuyahoga County Dept.of CFS.My fiancee's 13 yr old daughter was upset over being denied permission to spend the night at a friend's house because she didn't want to clean her bedroom.The next thing we know a social worker is on the phone telling us that the 13yr old made a complaint to the Child Abuse hotline and we are being accused of abusing our children.The 13yr old and our 3 yr old daughter are now in protective custody .The 13 yr old is staying with the friend of hers that we believe made the allegations,and ,our 3 yr old is staying with my parents until a case plan can be established. My children were taken illegally. My now husband and I were using corporal punishment, which is legal in NC. Family members, including my exhusband made false allegations, alienated my children from me, and manipulated them to lie. The children naturally don't like being punished, but it was being done correctly. Social alledges it wasn't done appropriately, and is trying to cover up taking the boys without a court order and not following state statutes pertaining to their department. They can take the children for 12-24 hours, depending on if it's a weekend, but they have to file a petition within no less than 24 hours. They didn't do this. They filed a petition after 18 days, alledging that I gave voluntary custody to my exhusband, who hasn't paid child support since then, because he was paying $717.00 monthly. We have now filed a federal lawsuit. This isn't the whole story either, but just a hint of all that's happened. There is a lot of corruption in this system.
My sister in Houston is interested in joining or initiating a class action lawsuit against Harris County Children's Protective Service or CPS more generally in Texas. Anyone able to give me information on an existing lawsuit or willing to join in a new class action lawsuit, please contact me.
CPS has labelled me a child abuser (emotional abuse) for reporting the outcries of sexual abuse that my daughter has made against her father and his male roommate. I am only permitted to see my child in supervised visitation when the father permits this. She is still telling me that he is sexually abusing her, but CPS or the police refuse to help.
Her father filed for divorce immediately after being confronted with sexually abusing her. He was awarded custody after he openly admitted to molesting another child (his stepdaughter from previous marriage). He has admitted to me that he had sex with her at 12.
I am at my wits end trying to deal with the system. CPS says that they have been asked by judge of 302nd district court (our divorce judge) not to investigate ANY allegations of sexual abuse by father. This is in CPS documentation. They have made so many false and malicious statements in their documentation against me that it is unbelievable. I am overwhelmed trying to combat their conjured up mental illnesses. One document states that I am manic depressive and another states that I am paranoid schizophrenic. Neither of these are true, but they keep pushing them around to justify their depraved indifference concerning the brutal sexual exploitation of my little girl.
I need help. If I fit into the category somewhere, please let me know. Right now I am without an attorney and desperate to get some help for my baby. It has been 3 1/2 years. She is begging me to get someone, somewhere to help her. I have not had much interest from the media.

Our adoptive caseworker wrote a home study full of lies that she had not even attempted to verify. These are serious and include things that are easy to check on if she had wanted to like "convicted of possesion of controlled substance", and "fired from every nursing home in the city for stealing medication".
This is so irresponsible and harmful to us and the child they took from us that we should be able to sue her. This is unreasonable unprofessional and totally reckless. I came across a Federal case where the caseworker was sue because the families rights were recklessly denied. Then she pretended that she got this information from several family members when the only one she spoke to was my sister who wanted to take the child from us. I am a single mother of two great kids 9 and 11. We have a father figure in their lives that has been a constant fixture for six years now, and more of a father than nature has provided. He loves them as his own.
recently a new neighbor moved in next door and the kids eventually started playing together. My daughter was inappropriately explored. The neighbors 6 year old violated my 9 year old in a way she should have had no knowledge of. When I went to the mother with this she apologized , and was in denial that her daughter could have been violated in this way.
They moved immediately. They reported to dfcs that my child was molested by her father figure and that her child was as well.
we were not charged. we submitted to polygraph. he passed of course. we were told that this was over.
it is not.
another report has been made. this time that my son was bleeding rectally.
the worker again pulled my children from class to ask questions and educate my children.
I am beeing slandered by a different neighbor who was friends with the first. Also her husband watches my home for hours every day. They have gone to my kid's playmates families and spread these lies, in effect socially isolating my children as well as myself.
the dfcs worker said she is not concerned about this new report. WHY then subject my children to this embarrassing interrogation and educating them in this way?

i cannot believe how the local judiciary blatantly violate rules on ex parte communications, appointment of ad litems, etc. i cannot believe how much information is leaked about ongoing investigations - to employers of the parent, for example. i cannot believe how the law enforcement arm helps to "solidify" a cps case that was tenuous at best.

Hello there. If you live in ILLINOIS and have been abused by DCFS or your children have been abused by DCFS...WE NEED YOU DESPERATELY and so do YOUR children! I/we are filing a "class action lawsuit" against illinois DCFS and we NEED other people or families who's children and themselves have been forced to go through the abuse and faults of DCFS of Illinois. If you we're "indicated" wrongfully and treated wrongfully (or your children) STAND UP with us and FIGHT BACK! DO NOT be scared of these people as they are clearly flawed and it has been proven a numerous amount of times very recently. Millions of dollars have been awarded to families and their children recently as a result of DCFS of Illinois' tormenting system. So far, the people involved in this class action lawsuit are, myself, and another gentleman. We were planning on hiring a VERY aggressive and high powered attorney located in Chicago that will take our case on a contingency basis (33%) so we don't all have to fork out money from out pockets (he'll get 1/3 of our end settlement of the lawsuit....which is standard). This attorney deals strictly in fighting DCFS cases and has won millions recently for other families and their children. DCFS has taken away a huge piece of our children's childhood and our adulthood as well and it IS NOT ACCEPTABLE. There are also other attorneys we are considering, like the one who just recently won a federal DCFS case where the judge ruled against DCFS and deemed thier system to be "unconstitutional". This is a VERY serious matter and only serious people need respond. We need to gather some more people ( i KNOW you're out there) and FIGHT for our children. Georgia dfcs took my children after an accident and began inventing charges then placed them in the home of their father who had a restraining order for seperating my shoulder and a prior guilty plea to cruelty to children. It has been over a year and i still have no contact with my 3 and 7 year olds.

I can't believe you haven't gotten a bigger response from people who have read this site. I found out through a friend who knows about everything we've been going through. I'm not sure we would be of any help but I definitely admire you for trying to do something about this. Lord knows, our hands have felt tied through this whole situation!
Based on a teachers aids observation of my 15 year old daughter playing basketball on the school playground one evening with a 26 year friend of our family, 60 year old James Brown, she came to the conclusion that this was inappropriate, "that a 60 year old man should not be playing basketball or doing anything else, that something else is going on here". (The school playground is less than 100 feet from the window of the local police department, out in the wide open space)
The teachers aid, approximately two weeks later, told my daughters teacher that she observed my daughter playing basketball one evening with an old man and that this seemed very inappropriate, and that something more is going on here.
The school personnel called my daughter in, called the local chief of police, and together, interrogated my daughter for approximately one hour and twenty minutes, in direct violation of Illinois statutes, which state "the department (DCFS) shall be the sole investigating agency of suspected child abuse and or neglect". There is no doubt in my mind that none of the officials involved in the initial interrogation of my daughter could meet any of the criteria required to carry on such an investigation. Also, my daughter is a Learning Disabled child, and approximately a month ago her special ed caseworker conveyed to me that my daughter has a level of comprehension in some things equivalent to a fourth grader.
After all of the above, they then called DCFS, and our local school officials and police led the DCFS investigator on all the way through the investigation.
In the past, I have openly and harshly criticized both the local police and the local school officials for some of their practices. Example: In school, last April, her class planned a field trip to go bowling. Their money was due in on Wednesday, and we had forgotten. She took the money on Friday, the day of the trip. A teachers aid snapped "you were to have turned your money in on Wednesday, not today, you just go to the library and write an essay on bowling while we're gone!" When my daughter got home she looked so sad, she was crying, and when she told me what had happened I became furious. The next day I called the school and gave them an ass ripping they will never forget. What kind of people would do this to a poor innocent child? I conveyed to them that they had to be the coldest, most cruel people on the face of the earth, that I had lived in the village for 26 years, and it used to be a good place to live, but I guess the
morals and the scruples of the people now running the school and the village have gone to hell in a handbasket!
It is my intention to file a Conspiracy action in District Court against the Village of Central City and the Central City School District, and DCFS. The final overt act to prove conspiracy would be the calling in of DCFS after Central City School and Police done their illegal interrogation of my special ed daughter. Conspiracy to gather false information and/or bring false charges WHILE ACTING UNDER THE COLOR OF LAW.
This is a long story, too long to print right now, but I am dead serious about a lawsuit, and yes, DCFS is still proceeding under rules and guidelines which were ruled unconstitutional by District Judge Rebecca Pallmeyer in District Court for the Northern District of Illinois.

The Illinois DCFS decided to step in and take my daughter's children from her when she went to a so called Sojurn Center for protection from her abusive husband. She has 3 children by a previous partner, and 1 small child (who is a hydrocehplus baby with celebral palsy. The callous S.O.B.s came to the hospital 5 minutes after the baby had surgery for the third time by incompetant doctors and ordered my daughter and her father from the hospital and said only the father would be allowed to see her, because they were taking the baby into "Protective Custody". She has never done a thing to any of her children, but he threw the baby against the wall and she hit her head and fell into the bed. He also grabbed the older girl of 12 at that time, twisted her arm, and left bruises on her arms. He is mentally unstable, has supposedly tried to commit suicide, only as a ruse to try and get my daughter to come back to him. They are constantly lying to her, making her go to their "TheRapist" and just generally causing more harm than good. Lucky that I was in court the first time or they would have placed the children in a foster home other than with me. To make matters worse, now they are considering letting the Father of the baby have her back, and terminating the Mothers parental rights, all because she won't take any bull from them. Also, I might add, the Father, has not done any of their so called Service Plan. He constantly calls our house and harasses, threatens, and numerous other things to aggrevate, even though we have a restraing order aginst him. The daughter can say one wrong word to one of the Social Workers and they come unglued. The whole Nation"s Family Services needs a complete overhaul, but first of all, we have to vote and get all those out of office who pushed so far to the left to have such stupid laws passed to give the monsters the power they have to make people and their families miserable. Springfield is the main office for our region, and if anyone want's to start causing problems, they just turn everything over to private agency, they call it, so they don't have to deal with. And what is it all for? MONEY THEY RECEIVE FOR EACH CHILD THEY HAVE ON THEIR LIST.

I can't believe I just found this message!! My former employer at a daycare who falsely accused me of child abuse and DCFS who indicated me have ruined my life!!!!! Even tho I found an attny in Springfield who helped me get my case expunged, I was fired from my job and have basically been blackballed from my profession. I haven't been able to get work in a year so I don't even bother to get dressed or go outside anymore. The attorneys I've talked to don't seem to believe I can sue DCFS or former employer and yes I've talked to the firm that was lead counsel on Dupuy vs McDonald. I've also talked to my State Rep., State Senator, US Senator, and Congressman. I have been so stressed and depressed over this that I don't even know if I can work anymore. I'm with you!! I e-mailed you a message with my e-mail address on it. By the way-it cost me $3500 to get my name off the CANTS-and the attny stepped-in after I wrote my own appeal. I had a hearing before the ALJ that lasted 9 hours-and the CPS investigator didn't even show up. However, her supervisor said during the hearing that even tho the child accused a "white teacher" of harming him, my employer called the hotline and gave them my name as being that white teacher "and that was all the evidence they needed Or cared about". Somebody needs to be held accountable for ruining my career.
My attorney spoiled an opportunity for me to appeal to the circuit court by saying "we won't get anywhere". We have another chance to appeal decision saying I have no standing in court but I can't find out if she filed the motion. It's not all her fault because these laws are so complicated and it is so expensive that unless you are wealthy to begin with you can't do anything. We weren't even accused or abuse or neglect. My sister told lies about me to have my great-niece that I raised from 3 days old to 33 months old taken from me and given to her. She did not want the child at birth and did not even want to know her until the caseworker made her arrange a visit for the sibling who is 5 years older than she is. After knowing her for less than a year only every other Sunday afternoon, she told the lies. The caseworkers did not even ask me, the rest of the family, or check records to find out if she were telling the truth. They took the child without notice and we were denied an appeal because, "sibling placement bars appeal". I do not feel that placement with a brother who is 5 years older than she is justifies being taken from the only mother and father she has ever known. We have even been denied visits. We are heart broken and I know our little girl is devastated. I was a "stay at home Mom," and now she is in daycare for 11 hours a day, five days a week. We have spent $8000.00 so far and we are not wealthy. Any suggestions?

that dcfs and the school that trumped up these false charges. If anybody knowns of an agressive lawyer in Chicago that specializes in this type of lawsuites

I know it has been a long time since this web site was created so i would like to know how the lawsuit went and if i could have the name of the attorney who represented you as I have an unusual case that i think dcfs needs to be sued for malpractice.
These animals, you know the people who said alls they are here to do is protect peoples children. Well over a year ago they took my son from us and we are innocent. They still have not given him back yet and we are not gonna stop fighting but they are taking advantage of us and I want to make it known what they do, and I want to know how they can do it. Please contact me and anything I can do to help I will we just want our son back home where he belongs so we can raise him not someone else.

I fought DCFS for 7 straight years from 1993-2001. I completed all the services they set forth for me to do. I even retained custody of my son while I had 2 other children in the system. I even paid a REAL lawyer to fight my case, but to no avail. At the last court date I appeared at they had the audacity to ask me for drops, parenting classes, etc when I had completed all these years prior. And which this was not a drug case, and never was. It was an abuse/neglect case. After being told that I would have to perform these same services again, I told the caseworkers I wanted my case closed because I was not going to have them make any more money on my kids heads, which I regret to this day. Though my children are with family members and I can either see or talk to them daily, I miss them and would give anything to have them both home. Today, I am the married parent of 7 children, including the 2 children who never left the system, and 5 children who I have retained custody of from birth. DCFS tried to gain custody of my third child as a newborn, even went as far as to change courtrooms to have a judge remove my son. The judge allowed me to retain custody of my son on a 220 protective order, which I followed, and the order was subsequently lifted a year later. I gave birth to another son 2 years later, who I also retained custody of. IN my opinion DCFS is nothing but a bureaucracy. It is big business, just as slavery was. I even know of adults who grow through this fucked up system from 17 and up. AT age 21, they let you go withough a wish or prayer, and if you get SSI, they will get your money and fuck that up too. Can somebody out there please tell me if this case can be included in a class action lawsuit case. Please e-mail me if you want more information.

I am 23 years old and was a Teaching Assistant at the Illinois Center For Autism. A little girl made an allegation against me which is completely false and impossible. I did everything by the book there in order to never be in a situation like this. This girl was very mentally disturbed and does not even talk she used a doll and picked my name out of a group of names. The fact that she was going through puberty also plays a role in this. DCFS made their report Nov 21 almost one month after I had been removed with pay from my job. Now over 90 days since the report and 120 since i left my job with pay I have heard nothing nor has my work. My work is adminstratively terminating me as of Feb 28. I need to know how to get an answer from DCFS. Also if they indicate falsely I need to know what to do. This is my livlilood and what I went to college for 5 years for. I am confused and frustrated. Any advice would be greatly appreciated.

I am going thru the same thing. I have 5 children (2 sets of twins). My baby at 6months was taken from me and my husband because of a medical condition that mirrors SBS. During this we have been subject to numerous false sex abuse claims one for skin tags that their brillant doctors cannot identify. Now we are almost through with them after 2 yrs and one of my children in foster care says someone touched them. It wasn't us because we are still closely supervised when we see them. But the police are still looking at my husband and 2 males in the foster home. Yet the kids are still in the home and we have lost all contact with all children. We are on verge of losing everything we have because we are too rich for a public defender and too poor for a private. To top it off the foster mom has been hitting the children with a wooden stick but we were told that it wasn't important because there were no bruises on the children.
