My 7 year old daughter was molested by ex-husband and was sun-gated (forensic interview) she was not comfortable disclosing at the time(loyalty to father). Both the caseworker and detective said "your daughter was not sexually abused", I knew this was not true. I have all three of my children in therapy and they are protected from father by the courts on a current investigation he is under for child pornography. The case worker has filed her findings (through disclosures my daughter has made to me, the case worker and therapist)with detective as severe child sexual abuse, however, the case worker told me that because daughter did not disclose at sun gate the detective is not going to pursue charges against him saying that her credibility is shot and the defense would doubt the story, suggesting I coached or coerced her into saying something. Daughter has come to me slowly and graphically describing the abuse. This was at no suggestion from me. The therapist said this is common with abuse and that children tell when they feel safe and ready.
Is this real? Can he walk away from this? I do have an attorney and he suggests talking with detective about seeking to understand why he doesn't have a case. We have a pending civil hearing to determine supervision rights (I am seeking no supervision). Any help would be great.
