Hi sweetums...I'm pretty sure this is how it goes but I believe that you can subpoena all the people you want but you DO have to pay them if they ask for it(ie. doctors, psychologists, therapists, "experts" in any given field). Some will do it pro bono but like with this therapist you are talking about, this court procedure would be taking time out of his normal schedule where he could be getting a paycheck.
If the State subpoenaed him on the other hand...I believe they have to compensate him as well. Although they would probably only pay him based on a "rate" of what the government has established as a base pay to pay "experts". When jurors get subpoenaed to testify they are entitled to pay from what they would have lost from not working at their place of employment. Albeit very little pay but it's still compensation :)
I hope this answers a few questions for you...although...you might be able to subpoena his records of the therapy sessions?
I don't know how that would work...b??? Do you have any suggestions?
