Brittany Murphy's husband and mother made a frantic attempt to revive her before paramedics arrived ... this according to notes written by an investigator from the L.A. County Coroner's office. And, there were a shocking number of strong prescription meds on Brittany's nightstand.

TMZ has reviewed the documents, written by Investigator Blacklock. According to his notes, Brittany Murphy "had been complaining of shortness of breath and severe abdominal pain" for 7 to 10 days prior to her death. According to the notes, Murphy went into the bathroom at around 7:30 AM Sunday and shut the door.

A half hour later Brittany's mother, Sharon Murphy, went to check on her daughter, opened the bathroom door and "discovered the decedent lying on the floor unresponsive." According to the notes, Sharon yelled for help. Brittany's husband, Simon Monjack, who was in bed, heard the screams and ran to the bathroom.

According to the notes, Sharon called 911 and Simon "attempted to revive the decedent by placing her in the shower and running the water."

The notes continue -- "The decedent remained unresponsive and purged her stomach contents prior to the arrival of the paramedics."

When the paramedics arrived, Brittany was "without signs of life."

Paramedics moved Brittany from the bathroom to the master bedroom, where they found a slew of prescription drugs -- "A check of the nightstands revealed large amounts of prescription medication in the decedent's name. Also noted were numerous empty prescription medication bottles in the decedent's husband's name, the decedent's mother's name and unidentified third party names."

According to the notes, the medications included Topamax (anti-seizure meds also to prevent migraines), Methylprednisolone (anti-inflammatory), Fluoxetine (depression med), Klonopin (anxiety med), Carbamazepine (treats Diabetic symptoms and is also a bipolar med), Ativan (anxiety med), Vicoprofen (pain reliever), Propranolol (hypertension, used to prevent heart attacks), Biaxin (antibiotic), Hydrocodone (pain med) and miscellaneous vitamins.

The notes say, "No alcohol containers, paraphernalia or illegal drugs were discovered."

According to the notes, "The night prior to her death, the decedent had consumed some noodles, leftover Thai food, Gatorade, water and tea with lemon."

The notes also say Brittany had a history of hypoglycemia and was hospitalized in April 2009 for low blood sugar while on location in Oregon."

Monjack told the investigator during the 7 to 10 days prior to her death, Brittany complained of shortness of breath and severe abdominal pains but he was not overly alarmed because "she often suffered from severe menstrual pains."

The investigator spoke with police at the scene, who told him "foul play is not suspected."

MCARTHUR, Calif. Authorities say two brothers drowned after falling into icy waters while attempting to rescue a dog that fell into a Northern California lake.

The coroner's office identified the men Monday as 38-year-old Noel Smith of Burney and 32-year-old Nathan Smith of Citrus Heights.

Authorities say the men ended up in the water Saturday evening after their dog fell through the ice at Big Lake in Shasta County. One of the men was submerged for about 20 minutes and the other for about 50 minutes. Rescuers pulled them out but were unable to revive them.

A third man in their group also went into the water, but managed to swim back to shore. He's being treated for severe hypothermia.

The dog survived.

NORTH HAVERHILL, N.H. (AP) - Denounced as "evil" and "despicable," three young friends who plotted the killing of a developmentally disabled Walmart cashier who had been hitting on a co-worker drew long prison terms Monday.

Timothy Smith, Anthony Howe and Amber Talbot, who pleaded guilty to murder and conspiracy in the October 2008 death of 25-year-old Christopher Gray, sat at adjoining tables in court as the victim's family members tearfully remembered him and berated his killers.

"Just remember that night," said David Kemp, 33, Gray's brother. "I hope it eats you and eats you and eats you until can't take it (any) longer."

Smith and Howe each got 40 years to life and Talbot 25 to 50 years for taking the Groton, Vt., man to a mobile home under the pretext of watching movies. There, Smith, 24, and Howe, 19, who are cousins, stabbed and strangled him as they stood around a campfire.

Gray, an aspiring auto mechanic whose buoyant personality helped him overcome a low IQ, attention deficit disorder and a speech impediment, became a target after wooing Talbot, 18, who also worked at the Woodsville Walmart.

Her boyfriend, Michael Robie, 19, became enraged when he heard about it and plotted revenge, enlisting the other three from his cell. Robie, who was heard discussing the attack in tape-recorded telephone calls from jail, has pleaded guilty to assault and conspiracy.

He is awaiting sentencing.

On the night Gray went missing, Walmart surveillance video showed the three picking him up after work at the Woodsville store, before they drove to Talbot's home. "He was only there because he wanted you to be his friend," his father, Michael Gray, told them Monday.

Talbot hung her head, her brown hair falling in her face, as Gray's "mom," legal guardian Annie Crowley, 38, of Groton, Vt., chided her as the one who lured Gray.

"Are you more than just a stupid girl that who caught up with the wrong crowd?" she told Talbot, standing at a podium in the hushed courtroom. "I think so. I believe all the young men involved are your victims."

Crowley, who had been his guardian for about two years before his death, broke down in tears as she read her statement. "How am I supposed to live with myself, knowing that I was his guardian? I was supposed to be looking out for him," she said.

Shirley Kingsbury, Gray's aunt, stood by the podium as Assistant Attorney General Jeffery Strelzin read her statement for her.

"You are despicable human beings," he read from her statement. "My heart is broken forever."

Smith, who had confessed to the killing in a handwritten letter to Gray's family after the slaying, apologized again Monday.

"I see Chris every time I try to sleep. No matter how many times I say I'm sorry, I can't bring him back. But I wish I could. That night, I should've told Chris what we planned on doing, and not to come," Smith said.

Before the sentencings, Gray's family and friends threw an appreciation luncheon for police and prosecutors from Vermont and New Hampshire who cracked the case.

A dozen uniformed officers and plainclothes detectives received lapel pins from Crowley in an informal ceremony before sitting down to a buffet lunch at a community organization's office in nearby Wells River, Vt.

"It was my honor to work on this case," said Assistant New Hampshire Attorney General Lucy Carrillo, as she stepped up to have Crowley pin her.

"We just felt it was important that they be recognized for the work they put into it," said Crowley. "I felt Chris would have appreciated that and would have wanted us to be grateful," she said.

TAMPA, FL -- Shawna Hodge waited in her wedding gown in the middle of Tampa International Airport, holding a sign with the name of her true love.

Hours after she was supposed to say "I do", Shawna was still missing her groom.

"Nothings gone as we've wanted, but we're working it out," said Shawna Hodge.

Winter weather stranded her soldier husband-to-be up north, and every path to get him home to Orlando met a dead end. It seemed every flight Cody Beckwith booked from the Baltimore area to Orlando was delayed or canceled.

It quickly became clear he'd be missing his own wedding.

So when Cody's family finally found him a midnight flight to Tampa, Shawna decided the airport would just have to do. With the wedding party in tow, Shawna took a road trip to TIA to get her man.

Dressed all in white, Shawna waited for Cody to arrive and give him the surprise of his life. Everything was set for an impromptu wedding.

Around midnight Sunday, Cody finally arrived. He quickly said "I do" to Shawna's improvised wedding plans.

It was hardly the homecoming Cody expected, and far from the wedding of Shawna's dreams. Still, after a ceremony that lasted a matter of minutes, the couple says their wedding was just about perfect.

The Dallas Cowboys are two wins from bringing a playoff game to their new $1.2 billion showplace. They're also two losses from possibly extending the longest playoff victory drought in franchise history, which might spark a search for the sixth coach since that last postseason win nearly 14 years ago.

It would be easy for the Cowboys to get blinded by the bright side after handing New Orleans its first loss Saturday night. Coach Wade Phillips was quick to recognize that Monday.

"You've still got to back it up and play the next one just as well," Phillips said. "We played well in a lot of areas. We still have some work to do."

First on the list before Sunday night's visit to Washington was cutting kicker Nick Folk after he missed a late 24-yarder that forced the Dallas defense to secure the 24-17 win by making one more stop against one of the league's most dangerous offenses.

It was the sixth straight game with at least one miss by Folk, which finally forced the team to hold auditions Monday for a replacement. Late in the day, Dallas signed former Redskins kicker Shaun Suisham and released Folk.

As well as linebacker DeMarcus Ware played just a week after a frightening neck injury, the Cowboys still have to evaluate his health daily and decide whether he can return to playing every down.

Ware practiced sparingly last week and was limited mostly to passing situations against the Saints. Phillips said he thinks the playing rotations will return to normal against the Redskins.

"He went back in the game in regular situations," Phillips said. "He felt good enough to do that and did that."

Before Folk's miss put the outcome in question, receiver Roy Williams ruined a chance for Dallas to answer the first Saints touchdown when he dropped a third-down pass near midfield early in the fourth quarter. Less than four minutes later, New Orleans (13-1) scored to pull within 24-17.

Critical drops by Williams are magnified because he cost Dallas three draft picks and a $45 million contract extension a year ago. But Phillips flatly rejected a question Monday about whether Williams might be headed to the bench.

"I think we still have hopes that the things we see in practice more and more are going to happen," Phillips said. "He's going to keep working at it, and we're going to keep working at it."

The last time the Cowboys felt this good was the last time they won a big game. Their 20-16 victory at Philadelphia in early November gave them a four-game winning streak and sole possession of first place in the NFC East.

That roll even prompted questions about Dallas playing a "trap" game in Green Bay because the Packers were 4-4 and coming off a loss to lowly Tampa Bay. The Cowboys promptly played their worst offensive game of the season in a 17-7 loss.

This time, the last-place Redskins are on tap.

"We're going to go over the film today, and we're going to be hard on them for the mistakes they made," Phillips said. "They realize there's things we could have done better and there's things that cause you to play your best to win. And that's every game, whoever you're playing."

If the Cowboys (9-5) win in Washington, they will finish the regular season at home against Philadelphia (10-4) with a chance to win the NFC East and host a playoff game at Cowboys Stadium a week later.

The stakes won't be as high as the finale last year, when Dallas was trounced by the Eagles in Philadelphia with the NFC's final playoff berth on the line. But for a team that risked losing control of its playoff fate if it had lost in New Orleans, it will be quite a turnaround.

"I told them before the game it'd be an upset if we got beat. And that's what we felt like," Phillips said. "I think we can build on that. That's the kind of game that define you as far as confidence."

A high-ranking Army official's new policy making pregnancy among troops in Iraq an offense punishable by court-martial is raising eyebrows, even though experts say he is well within his rights to do so.

Military experts say Maj. Gen. Anthony Cucolo III is well within his rights to punish soldiers for becoming pregnant or getting a woman pregnant under his command.


According to the Nov. 4 general order of Maj. Gen. Anthony Cucolo III, a commander in northern Iraq, the punishment would apply not only to the female soldiers who become pregnant, but also to the male soldiers who impregnate them, even if the couple is married.

Cucolo told ABC News that the policy, believed to be the first of its kind, was necessary to avoid losing valuable troops in his 22,000-member command.

"I need every soldier I've got, especially since we are facing a drawdown of forces during our mission. Anyone who leaves this fight earlier than the expected 12-month deployment creates a burden on their teammates," he said in a statement.

"Anyone who leaves this fight early because they made a personal choice that changed their medical status -- or contributes to doing that to another -- is not in keeping with a key element of our ethos, 'I will always place the mission first,' or three of our seven core values: loyalty, duty and selfless service," he continued. "And I believe there should be negative consequences for making that personal choice. "

The pregnancy policy is just one provision in a larger general order that also prohibits soldiers from sexual contact with Iraqis or third-party nationals who are not members of coalition forces.

Provisions in the Nov. 4 order are also applicable to civilians under Cucolo's command.

"I do not expect those who have never served in the military to completely understand what I have tried to explain above," Cucolo wrote. "Recently I was asked, 'Don't you think you are treading on an intensely personal topic?' As intensely personal as this topic might be, leaving those who depend on you shorthanded in a combat zone gets to be personal for those left, too."

Army spokesman Lt. Col. Nathan Banks told ABCNews.com today that Cucolo, like any other commander, has the right to institute and enforce policies as he sees fit.

"Under his command, that's his take," Banks said.

That means, Banks said, that troops in different parts of Iraq and Afghanistan are subject to varying regulations. Some commanders, he noted, have made DUI a court martial-worth offense, while some haven't.

Civilian military lawyer Wayne Kastl, lead counsel with the Military Defender law firm, said this type of policy proves this isn't your grandfather's Army.

He pointed to stories about drinking, sex and other debauchery that permeated Army life during previous wars.

"I think the policy is to put the fear of God into folks over there," he told ABCNews.com. "I don't like it, but I would say that order over there is probably legal."

"I think the troops over there are fighting hard and getting PTSD and all sorts of horrible stuff," Kastl said. If they need a "little comfort helping through the night," he added, so be it.

John Hutson, a former longtime military judge advocate and currently the president and dean of Franklin Pierce Law School in New Hampshire, said it's well within Cucolo's rights to hand down such an order, especially if pregnancy has become a serious issue within his ranks.

When a woman becomes pregnant, "you've taken somebody and you've made her less effective," he said. "And I think its only fair that if you do that with the woman then the man be held equally culpable."

But if the measure is largely preventative and not in response to a growing trend, Huston said, "then it's probably ill-advised."

Will New Policy Cut Back on Pregnancies Planned to Flee Iraq?

"It's not saying you can't have sex," Hutson said. "You have to take precautions."

Still, he added, "in some respects, it flies in the face of family values."

National Organization for Women president Terry O'Neill said the policy infringes on women's rights.

"How dare any government say we're going to impose any kind of punishment on women for getting pregnant," O'Neill said. "This is not the 1800s."

She said NOW would seek to have Cucolo's order rescinded, and would turn to Defense Secretary Robert Gates and even President Obama for help.

"We're going to contact the White House and see if we can contact the Department of Defense and find out if anything can be done to reverse this ridiculous order," O'Neill said.

Kastl said he understands the Army may have its reasons for such an order. Sex among its ranks can cause trouble in many regards, including favoritism of the partner.

Also, soldiers found to be pregnant are sent back to the U.S. in short order and Kastl said he has heard anecdotal evidence of female soldiers intentionally getting pregnant to be sent home.

Because of that, he said, "I can see why they're doing it."

Hutson agreed, saying pregnancies planned to relieve the female soldier of duty is a form of malingering, an Army term for a soldier who injures him- or herself to prevent dangerous assignments.

Kastl noted that the Army already encourages its female soldiers to take medication to stop their menstrual cycle. And in some cases, Cucolo's order may be redundant, since the Army already prohibits fraternization between superiors and subordinates, though it seemingly has no current take on sexual contact between members of the same rank.

Cucolo himself said in the statement to ABC News that his order "made an existing policy stricter."

But Hutson worried that Cucolo's policy could cause an increase in abortions overseas. And since military hospitals do not perform such procedures, female officers may find abortions are available not "in the way you want them," Hutson said, forcing women to potentially dangerous providers of such services.

O'Neill echoed those concerns.

"Where are they going to go?" she said. "Where in Iraq are they going to terminate a pregnancy?"

Kastl theorized that the punishment handed down to those who violate Cucolo's order would likely be handled as a violation of Article 91, or violation of a general order, which is punishable by up to one or two years in prison.

But he said it's unlikely the Army would actually keep an expectant mother or father behind bars for that length of time.

We gave Mama a beautiful service yesterday. Actually, to our surprise she had prepaid for all her services and all we did was purchase a vault to have her put in. After the graveside services were over, my husband had bought 6 balloons, 1 big one for her and 5 smaller ones to represent each of her children. We each signed a card attached to a balloon and wrote on the card whatever we wanted to & sealed it. The grandchildren signed for the 2 deceased children. The balloons were the color of each of our birthday month, with Mama's being in the center. It was a beautiful but cold day and when we tied them all together to keep them together we let them go. We all watched til they were completly out of sight. I think she would have enjoyed that. Maybe she was somewhere watching too. I like to think she was smiling at us. Even the funeral service people were watching.
I'm trying not to grieve for her. I know she is at peace. I just have this awful sad empty place in my heart that will probably never go away.

BRASILIA, Brazil - A man jailed for piercing his 2-year-old stepson with up to 30 needles said he intended to spite his wife by killing the child, who is recovering from surgery and scheduled for more operations later this week.

Roberto Carlos Magalhaes said Sunday that he drugged the boy with wine and had his lover hold the child down while he pierced him.

"I did this two or three times a week during one month," the 30-year-old bricklayer told Globo TV's "Fantastico" program in a telephone interview from a jail in the northeastern state of Bahia.

The boy was too drunk from the wine mixture to cry while the needles were being pushed in, but he felt pain after the alcohol wore off, Magalhaes said.

"It was truly an unbearable suffering," he said. "It was to get back at the boy's mother. I thought the needles would work their way through his body and kill the boy. It was a way to kill without anyone discovering."

But the pain led the toddler to complain to his mother, and on Dec. 10 she took him to a hospital where X-rays revealed about 30 needles lodged throughout his body.

The boy is recovering well from a five-hour operation Friday to remove four rusty needles that were near his heart and in his lungs.

Doctors said they will try to remove three needles from the boy's abdominal region on Wednesday. He is expected to undergo a third surgery in the near future at the Ana Nery hospital where he is being treated in the northeastern city of Salvador, said hospital spokeswoman Susy Moreno.

Hundreds of people across Brazil had contacted the facility to inquire about the boy, Moreno said.

"Many people are coming by to bring Christmas presents," she said. "Many are also calling us to express their outrage. ... The support has been incredible."

Along with Magalhaes, police believe his lover, Angelina Ribeiro dos Santos, was also seeking revenge on Magalhaes' wife.

The bricklayer told detectives that dos Santos would enter into trances and give him commands to insert the needles, police inspector Helder Fernandes Santana said.

Magalhaes and dos Santos were both arrested, though no charges had been filed. They were taken to an undisclosed location for their own protection after a mob threw stones at the police station where they were being held.

Dos Santos is not believed to be a member of any religious or occult group, and authorities believe the pair came up with the idea on their own.

The boy's name is not being released because of his age.

Local media reported Monday that another 2-year-old boy was being treated in the northern state of Maranhao after having nine needles found in his body. Police were investigating the circumstances of the case.

GREELEY, Colo. (AP) - Sheriff's officials arrested a woman suspected of making up to 48 false distress calls to 911 in a four-month period. The woman, 44, was arrested Friday on suspicion of attempting to influence a public servant, false reporting and resisting arrest.

Sheriff's officials said a caller using a prepaid mobile phone would say she was going to kill herself or have officers shoot her. Other times she reported her mother had a heart attack and wasn't breathing. Emergency responders were never able to find the woman in the spots where she said she was.

Sheriff's officials said they arrested the woman with help from a phone company.

NEW YORK (AP) - A Brooklyn man is in trouble over a plan to make money off a city-owned garage. Authorities said he broke in to the closed garage near the old seaport district and Wall Street, reopened it and began charging people for parking. The scam didn't last long.

The city's Department of Investigation said police chased him off the site on just his second day, then lifted his DNA from a soda can to prove he was there.

He now faces charges of burglary and criminal impersonation.

ATHENS, Ga. (AP) - Athens-Clarke police are looking for a woman who destroyed $1,000 worth of perfume at a store after being told she couldn't return items without a receipt. The Athens Banner-Herald reported Monday that police said the woman pushed over a large plastic display stand holding several hundred sample-size bottles of perfume that cost $3.50 each.

A clerk at Joy Joy Beauty said they told the customer she couldn't return several items Saturday afternoon because she didn't have a receipt.

They said the display stand broke after the woman pushed it and every bottle of perfume smashed against the floor as she stormed out of the store and drove away in a green van.

WASHINGTON (AP) - Washington's police chief criticized a veteran detective Monday for pulling a gun during a mass snowball fight. Authorities said the officer is on desk duty while the case is under investigation.

Metropolitan Police Chief Cathy Lanier said she had watched video clips from the weekend confrontation and has no doubt that the off-duty officer pulled his gun after snowballs hit his personal vehicle during Saturday's record snowfall.

"Let me be very clear in stating that I believe the actions of the officer were totally inappropriate!" Lanier said in a statement. "In no way should he have handled the situation in this manner."

Hundreds of people were gathered for the snowball fight on a major street during Saturday's snowstorm.

One video posted on YouTube showed a man holding what appears to be a gun in the snowy street. Another video shows the same man telling people he is "Detective Baylor" and that he pulled his gun because he was hit by snowballs.

Videos also show a uniformed police officer holding his gun by his side before holstering it again. Police said in a statement Sunday that the uniformed policeman was there in response to a call about an armed man, acted appropriately and did not point his weapon at anyone.

Assistant Police Chief Peter Newsham told reporters Monday that the detective has been placed on desk duty and his badge and weapon have been withdrawn. He did not identify the officer but described him as a veteran detective with more than 25 years of experience.

"He has a very good reputation," he said.

Newsham said the internal affairs division wants to complete its investigation as quickly as possible, within a number of weeks.

"We have to put the whole incident into context," he said.

There could be a recommendation to discipline the detective, which could range from a reprimand to removal, he said.

Police have at least two videos of the incident, and Newsham said there could be more as the footage shows other people with cell phones and cameras. Police are working to obtain any additional material and will continue to speak to witnesses. He asked people to contact police if they have more footage or to make a report about it.

It's unclear why the officer stopped in the first place, Newsham said. There were no arrests, he said.

Newsham praised the work of other officers who arrived at the scene and de-escalated the situation.

He called the incident "very disappointing" as video of it garnered national attention after circulating on the Internet.

"It does bring a negative light" on the department, he said. Newsham said the incident detracts from the work that day of hundreds of officers who helped people in the snow and directed traffic.

NASHVILLE, Tenn. Carrie Underwood is engaged to Ottawa Senators hockey player Mike Fisher, her publicist said Monday.

No wedding date has been set for the couple, who have been dating for about a year.

"The couple couldn't be happier," said publicist Jessie Schmidt.

Fisher, 29, recorded his 300th career point for the Senators in their 4-1 win over the Minnesota Wild on Saturday. Fisher had an assist on Anton Volchenkov's goal in the first period.

Asked by The Associated Press last month what Underwood's family thought of Fisher, the 26-year-old singer said they were supportive.

"They love me and I would hope my parents would think we raised a good, smart girl, so she's going to do the right thing no matter what it is," she said.

Days before the CMA Awards in early November, Underwood did not know whether she would be spending the holidays with Fisher.

"Christmas, I don't know. We haven't really thought that far ahead. We kind of take it one week at a time," she said then.

Underwood has kept her relationship largely under wraps, but she gave Fisher a very public shout-out in the liner notes of her current album, "Play On," that was released Nov. 3. She wrote, "Thank you (No.) 12 (referring to his jersey number.) You are the most amazing addition to my life! You are such a wonderful person and have had such an amazing hand in the building of this album and in the growth of me as a person. I love you so much! You make my life better in every way!"

Beyonce's mother Tina Knowles files for divorce

HOUSTON (AP) - Beyonce's mother, Tina Knowles, has filed for divorce from the pop diva's father and manager, Mathew Knowles. Tina Knowles began legal proceedings Nov. 11, according to documents filed with the Harris County Court Clerk. She launched the House of Dereon clothing line with Beyonce in 2006.

"The decision to end our marriage is an amicable one. We remain friends, parents, and business partners," the couple said in a statement provided to The Associated Press on Friday. "If anyone is expecting an ugly messy fight, they will be sadly disappointed. We ask for your respect of our privacy as we handle this matter."

The divorce filing came about a month after Mathew Knowles was named in a paternity suit. Los Angeles resident Alexsandra Wright claims in the lawsuit that he is the father of her unborn child.

Tina and Mathew Knowles wed in 1980. In addition to 27-year-old Beyonce, they have another daughter, 23-year-old singer Solange.

Update: Laura Dekker, Dutch teen found in Caribbean

Authorities are this afternoon trying to piece together how 14-year-old Dutch sailor Laura Dekker managed to slip out of the Netherlands and fly to the Caribbean - and whether anybody helped her flee.
Dekker, who lost a court battle in October for the right to set off on a risky solo around-the-world trip, was discovered on Sunday in the Dutch island territory of St. Maarten, three days after her mother reported her missing.

It was unclear if she knew anybody on the island, half of which is part of the Netherlands Antilles, or whether she had any plans to use it as a start point for a sailing voyage. Unconfirmed news reports said she left home with about £3,500 in cash.


Dekker's 26-foot yacht Guppy, which she planned to use for her circumnavigation, remained moored at its usual harbor in the central Netherlands.

Police plan to interview Dekker when she returns to the Netherlands in coming days.
'We have a number of questions for her,' police spokesman Bernhard Jens said, including: How did this happen? Why did you go? How did you go? Did you go with somebody else?'

Dekker's family has similar questions, spokeswoman Mariska Woertman told The Associated Press.
Having spoken briefly with Dekker on Sunday, Woertman said Dekker was doing well 'under the circumstances,' but that 'we haven't had any time to talk yet about the reasons why."

'What exactly has been going on over the past few days or weeks. We just have to wait until she is back home and speak to her about that.'

Senate health care bill clears key hurdle

Washington (CNN) -- Democrats won a major victory in their push for health care reform early Monday morning as the Senate voted to end debate on a package of controversial revisions to a sweeping $871 billion bill.

The 60-40 party-line vote, cast shortly after 1 a.m., kept Senate Democrats on track to pass the bill on Christmas Eve. If it passes, the measure will then have to be merged with a roughly $1 trillion plan passed by the House of Representatives in November. Shortly after the vote, the Senate went into recess until noon Monday.

The vote left President Obama on the cusp of claiming victory on his top domestic priority and enacting the biggest expansion of federal health care guarantees since the enactment of Medicare and Medicaid over four decades ago.

"Today, the Senate took another historic step toward our goal of delivering access to quality, affordable health care to all Americans," Senate Majority Leader Harry Reid, D-Nevada, said in a statement.

The bill will help "promote choice and competition to drive down skyrocketing health care costs for families ... all across America."

The vote was the first of three this week requiring Democrats to win the backing of 60 members -- enough to break a GOP filibuster. Final passage of the measure, in contrast, will require a simple majority in the 100-member chamber.

Many political observers believe Monday's outcome indicates a likely Democratic win on the remaining procedural hurdles and the final vote.


Republicans ripped the majority for passing the measure in the middle of the night and accused Democrats of ramming the bill through despite growing public opposition.

"Make no mistake: If the people who wrote this bill were proud of it, they wouldn't be forcing this vote in the dead of night," argued Senate Minority Leader Mitch McConnell, R-Kentucky.

"Mark my words: this legislation will reshape our nation. And Americans have already issued their verdict. They don't want it. They don't like this bill, and they don't like lawmakers playing games with their health care to secure the votes they need to pass it."

The unusual timing of the vote was a consequence of Senate rules, Democrats' determination to pass the bill before adjourning for the holidays, and the GOP's willingness to use every possible legislative tactic to slow the bill's progress.

Unanimous Republican opposition has forced Reid to win the support of all 60 members of his traditionally fractious Democratic caucus. Compromises made to win the backing of more conservative members, such as Nebraska Sen. Ben Nelson and Connecticut Sen. Joe Lieberman, have enraged many liberal Democrats and threatened to undermine support for the bill.

Liberal Democrats are particularly upset with Reid's decision to abandon a government-run public health insurance option and an expansion of Medicare to Americans as young as age 55 -- ideas strongly opposed by Lieberman and other centrists.

Top Democrats, however, argue that the Senate bill as written would still constitute a positive change of historic proportions. The legislation, according to the nonpartisan Congressional Budget Office, would extend health insurance coverage to over 30 million Americans while reducing the federal deficit by $132 billion over the next decade.

The deficit would drop by another $1.3 trillion between the years 2019 and 2029, the CBO said.

Democratic leaders in the House and Senate have now reached agreement on a broad range of changes that could affect every American's coverage.

Among other things, they have agreed to subsidize insurance for a family of four making up to about $88,000 annually, or 400 percent of the federal poverty level.

They have also agreed to create health insurance exchanges designed to make it easier for small businesses, the self-employed and the unemployed to pool resources and purchase less expensive coverage. Both the House plan and the Senate bill would eventually limit total out-of-pocket expenses and prevent insurance companies from denying coverage for pre-existing conditions.

Insurers would also be barred from charging higher premiums based on a person's gender or medical history. Medicaid would be significantly expanded under both proposals.

Every Democratic senator has the power to kill this bill, and that fact gives Senate negotiators tremendous leverage.

There are, however, major differences between the Senate measure and the more expansive -- hence expensive -- House bill.

One of the biggest divides is over how to pay for the plans. The House package is financed through a combination of a tax surcharge on wealthy Americans and new Medicare spending reductions. Individuals with annual incomes over $500,000 and families earning more than $1 million would face a 5.4 percent income tax surcharge.

The Senate bill also cuts Medicare by roughly $500 billion. It does not include a tax surcharge on the wealthy, however. It would instead impose a 40 percent tax on so-called "Cadillac" health plans.

Proponents of the tax on high-end plans argue it's one of the most effective ways to curb medical inflation. House Democrats are adamantly opposed to taxing such policies, arguing that such a move would hurt union members who traded higher salaries for more generous benefits.

Another key sticking point is the dispute over a public option. The House plan includes a public option; the more conservative Senate plan would instead create new nonprofit private plans overseen by the federal government.

Under both plans, individuals would be required to purchase coverage. But the House bill includes more stringent penalties for most of those who fail to comply. Both versions include a hardship exemption for poorer Americans.

Employers face a much stricter mandate under the House legislation, which would require companies with a payroll of more than $500,000 to provide insurance or pay a penalty of up to 8 percent of their payroll.

The Senate bill would require any company with more than 50 employees to pay a fee of up to $750 per worker if any of its employees relies on government subsidies to purchase coverage.

Abortion has also been a sticking point for both chambers. A late compromise with conservatives in the House led to the adoption of an amendment banning most abortion coverage from the public option.

It would also prohibit abortion coverage in private policies available in the exchange to people receiving federal subsidies.

Senate provisions, made more conservative than initially drafted in order to satisfy Nelson, would allow states to choose whether to ban abortion coverage in plans offered in the exchanges. Individuals purchasing plans through the exchanges would have to pay for abortion coverage out of their own funds.

Many observers expect the final bill will conform largely to the measure now moving through the Senate.

"Reid had to make a lot of concessions to get his entire caucus behind the Senate bill," said CNN deputy political director Paul Steinhauser.

"He can't afford to a lose a single vote. Every Democratic senator has the power to kill this bill, and that fact gives Senate negotiators tremendous leverage in their negotiations with the House."

Nelson told CNN's "State of the Union" on Sunday that he would withdraw his support if the final bill gets changed too much from the Senate version under consideration.

Among other things, Nelson had a provision added to the bill requiring the federal government to cover Nebraska's costs for expanded Medicaid coverage after 2016. No other state is currently slated to receive such a benefit.

Obama will be remembered for driving the United States into Bankruptcy, with all his give away programs,but isn't that what he was taught by his buddies in the who were once the weatherman? Their idea (back in the 60's) was to take over the government through social programs. Acorn was on of theirs and now that they got their guy in the white house they will get what they wanted.

The Price Is Right? Payoffs for Senators Typical in Health Care Bill

While Sen. Ben Nelson got a particularly juicy concession -- permanent and full federal aid for his state's expanded Medicaid population -- in the health care bill, support from a slew of other senators likewise came with its price.

Sen. Ben Nelson's hardly the only lawmaker extracting sweetheart deals out of the health care reform bill.

While the Nebraska Democrat got a particularly juicy concession in exchange for a "yes" vote on the 10-year, $871 billion package -- permanent and full federal aid for his state's expanded Medicaid population -- support from a slew of other senators likewise came with a price.

Western states got more money for hospitals that serve Medicare patients. Louisiana got up to $300 million in Medicaid benefits. The list goes on.

Senate Republicans lined up Saturday to decry the latest deal targeted toward Nebraska, which was decried as the "cornhusker kickback."

"Votes have been bought," Sen. Saxby Chambliss, R-Ga., said.

But Senate Democrats said the payoffs are nothing unusual, and in fact typical.

"People fight for their own states. That's the nature of a democracy," Sen. Amy Klobuchar, D-Minn., said on "Fox News Sunday," defending Nelson against withering attacks from the GOP.

"This is just part of the normal legislative process," said Jim Manley, spokesman for Senate Majority Leader Harry Reid.

As a measure of just how typical they are, a slew of payoffs and concessions have been struck over the past several months.

-- Sen. Mary Landrieu, D-La., won between $100 million and $300 million in additional federal aid for her state's Medicaid population. The deal, secured before she cast her critical vote in favor of bringing the health bill to the floor, was immediately dubbed the "Louisiana Purchase," though the actual Louisiana Purchase was considerably cheaper.

-- Vermont and Massachusetts got $1.2 billion in Medicaid money -- a change that was described as a correction to the current system which exempts those two states because they have robust health care systems. Vermont Sen. Bernie Sanders also boasted Saturday that he requested and won an investment worth between $10 and $14 billion for community health centers.

-- Western states secured higher federal reimbursement rates for doctors and hospitals that serve Medicare patients. The provision covers the low-population "frontier" states and applies to Montana, North Dakota, South Dakota, Utah and Wyoming -- the latter two states are both represented by two Republicans, but ended up as beneficiaries anyway since they qualify. The legislative language defines frontier states as states where at least 50 percent of the counties have fewer than six people per square mile. Sen. Kent Conrad, D-N.D., chairman of the Senate Budget Committee, defended the "special deal," telling "Fox News Sunday" that those five states were getting an increase in reimbursements because they get the lowest amount in the country. "That doesn't offend me at all," he said. "It's in fact, fair."

-- Florida, New York and Pennsylvania -- where five of six senators are Democrats -- will have their seniors' Medicare Advantage benefits protected, even as the program sees massive cuts elsewhere.

-- Sen. Max Baucus, D-Mont., reportedly secured expanded Medicare coverage for victims of asbestos exposure in a mine in Libby, Mont.

-- One unknown state is receiving $100 million for a "health care facility" affiliated with an academic health center at a university that contains the state's only "public academic medical and dental school." It's unclear for which state that language was written.

-- Nebraska's Nelson won permanent federal aid for his state's expanded Medicaid population, a benefit worth up to $100 million over 10 years. Other states get the federal aid for three years, but Nebraska's benefit is indefinite. His state also got an exemption for nonprofit insurance companies from a health insurance company tax. Many believe this was targeted at Mutual of Omaha, but senior Democratic aides would not confirm that.

Independent Sen. Joe Lieberman didn't extract any payoffs for Connecticut. Rather, he succeeded in stripping the government-run insurance plan from the Senate health bill, along with a proposed expansion of Medicare that he recently said he opposes.

Career-Killing Votes Loom on Health Reform [Grace-Marie Turner]

Senators are in the midst of taking a series of career-killing votes to fulfill President Obamas goal of getting a health overhaul bill any bill passed before Christmas.

Even as they walk the plank, many of them are telling constituents that the legislation is not that bad because they got special favors for their state. Or because Sen. Harry Reid was forced to drop the public plan. Or because the Congressional Budget Office says the bill is paid for (albeit with big tax increases and cuts to Medicare).

But a torrent of dangerous, collectivist provisions remains in the legislation, targeting Americans from coast to coast. Here are a dozen constituencies that will be gored, to which senators will have to answer next time they go before the voters:

Seniors: Even though they are being told otherwise, seniors will pay the biggest price for reform. Half of the reason that Sen. Reid got a favorable cost estimate from CBO is because his bill cuts Medicare by $471 billion over the coming decade. An earlier report from the programs chief actuary says cuts this deep would cause many providers to stop seeing Medicare patients or even to close their doors.

Everyone: The federal government would, for the first time, require every American to have health insurance. The government would stipulate what that mandatory insurance must cover and how much of their incomes people can afford to pay for it, and penalize them if they dont comply. While some would be eligible for subsidies or waivers, most Americans would face tax penalties of $750 a year or 2 percent of their incomes, whichever is higher, to force compliance.

People buying their own insurance: The CBO says that families purchasing insurance in the individual market would not see a reduction, but rather an increase, in their premiums by $2,100 in the year 2016. Thats over and above the increases they already will be facing as health-insurance premiums continue to rise at about twice the rate of general inflation. A family would pay $15,200 for health insurance by 2016 if Sen. Reids bill passes, and $13,100 if it doesnt. The CBO concluded that premiums in the individual market will be 10 to 13 percent higher in this market than if Congress did nothing.

People who work for small businesses: Those receiving health insurance through their employers will continue to see higher costs, with premiums for a family getting coverage though a small business increasing to $19,200 by 2016 about the same pace as they would without reform.

People who work for large companies: The White House boasted that under the Senate bill, premiums for employees of large firms would remain mostly unchanged. But that means they would continue to go up almost as fast as they have been, reaching $20,100 for a family and $7,300 for an individual by 2016.

All employers: Companies also face an avalanche of new reporting requirements, penalties, and potential fines. Firms face fines whether or not they provide health insurance if any of their workers get taxpayer-subsidized coverage. And with subsidies available for families earning up to $80,000 a year, the exposure is significant.

Young people: Most havent a clue that the federal government is about to slap them with a new mandate requiring them to purchase expensive health insurance. Studies show that they would likely pay premiums two or three times the amount they would normally be charged based upon their age and expected use of health services.

Patients: A new independent board will have the power to cut Medicare benefits, and its decisions can only be overruled by another act of Congress. Private plans are likely to follow its recommendations. Congress doesnt want to be held directly responsible for the rationing decisions the board inevitably will make, but the voters will quickly figure it out.

Doctors: Starting in March, doctors, hospitals, nursing homes, and others who treat Medicare patients will face a 21 percent cut in their Medicare payments. This means doctors face a permanent lobbying campaign just to keep payments from being slashed.

Health-sector companies: While few people have sympathy for health-insurance companies and drug plans, they, too, will also face onerous new federal regulations and higher taxes costs that can only be passed on to consumers in the form of reduced benefits or higher premium costs.

States: While about 10 states receive special favors (as in, pay-offs) in the Reid bill, the others will wind up with higher costs for their already budget-busting Medicaid programs. Another 15 million people will be added to the rolls of this program, which was originally intended for low-income people.

Budget watchers: The Reid bill would increase federal spending by $2.5 trillion in the first decade it goes into effect, but it is paid for by a combination of job-killing taxes and unrealistic cuts to Medicare. No one including the CBO believes these pay-fors are sustainable. As a result, the health overhaul bill inevitably will swell the federal budget deficit.

Health-insurance costs are likely to begin soaring right away, most of the new subsidies for insurance dont kick in until 2014, higher taxes go into effect almost immediately, and seniors will find it harder and harder to find a doctor to see them and to get the care they need.

Murphy Sick and Vomiting Just Before She Died

Brittany Murphy was very ill in the hours before she went into cardiac arrest and died, sources tell TMZ.

We're told Murphy was taking prescription meds for flu-like symptoms she had been experiencing for several days. We're told Murphy began vomiting early Sunday morning and told family members she was feeling very ill.

Sources say various prescriptions were found in the home -- written for Brittany Murphy, husband Simon Monjack, and Brittany's mom. One source says, "There were a lot ... a lot of prescriptions in the house."

Law enforcement sources tell us Murphy collapsed in the bathroom and somehow ended up in the shower ... there was, we're told, a significant amount of vomit in the immediate area.

We're also told authorities did not find illegal drugs in the house, but Murphy was definitely taking various prescription meds.

Sources say her condition and the meds could have triggered a heart attack, but it's too early to know. An autopsy will be performed Monday or Tuesday. We reported earlier Monjack did not want an autopsy but ultimately it's the Coroner's call.

As we first reported, Brittany Murphy's mother told paramedics her daughter suffered from diabetes. We're told it was type 2 diabetes and people involved in the case doubt her condition caused her death

Brittany Murphy - No Evidence of Criminality

TMZ has learned the LAPD has concluded its preliminary investigation into the death of Brittany Murphy and sources tell us detectives have determined there is no evidence of foul play or other criminality.

The PD is now waiting for the autopsy results from the L.A. County Coroner. If the Coroner's findings raise red flags, we're told the LAPD will pursue the matter further.

The LAPD did not determine cause of death -- that's the Coroner's job.

Alaina Reed Hall of 'Sesame Street' and '227' Dies at 63

Alaina Reed Hall, the kind-faced actress best known as Olivia on 'Sesame Street' who later starred on '227,' died Dec. 17 in Los Angeles after a lenghty battle with breast cancer, the Springfield News-Sun reported. She was 63.

Starting in 1976 and running up until the late 1980s, Hall was known to millions of children as photographer Olivia on the PBS show. She told the News-Sun in 2004 it was "the best job I ever had."

In 1985, she was cast in the urban sitcom '227' as Rose, the go-to friend in the neighborhood. The cast also included the always-sassy Jackée Harry and ran for five seasons.

UPDATE: Brittany Murphy Autopsy Completed

TMZ has learned Brittany Murphy's autopsy is complete. There were no signs of foul play, we've learned, and there was nothing that pointed to a cause of death. The cause of death has been "deferred" pending other tests.

Sources say the L.A. County Coroner will wait for the toxicology report, as well as the histopathology (study of her organs and tissues) and neuropathology (study of her brain).

One source said the body appeared "normal." In addition, we're told she did not appear overly thin -- in contrast to some photos that surfaced several weeks ago. There was no evidence of trauma to the body.

We're told the Coroner will not determine cause of death until the other reports are submitted -- in 4 to 6 weeks.

One issue the Coroner is interested in -- what prescription drugs were in Brittany Murphy's system.

Melissa and Tony Wescott are afraid of their son. They're so afraid of the boy they adopted that they're trying to have Oklahoma law changed so that they can return him to the state's care.

"He tried to burn our home down. The note said, 'I'm sorry you had to die,'" Melissa Wescott told "Good Morning America."

She said she and her husband have found butcher knives under his mattress and lights hidden in his bedroom.

The Wescotts' 11-year-old son has been locked up in a psychiatric hospital in Tulsa, Okla., for nearly a year. But now doctors say he's not a danger to himself or anyone else, and the boy is scheduled to be released from the hospital next month.

Despite the doctors' opinion, the Wescotts say they are so afraid of having him back home that Melissa plans to stay awake at nights while her husband sleeps.

Adopted Son Diagnosed with Several Mental Health Disorders

The trouble started shortly after the couple -- who couldn't have children of their own -- adopted the boy in 2007. His behavioral problems became so severe that he needed inpatient care.

Within a year of the adoption, the Wescotts told the Tulsa World, the child was diagnosed with reactive detachment disorder, disruptive behavior disorder, major depressive disorder, post-traumatic stress disorder and fetal alcohol syndrome.

The parents said the boy became violent toward other children and nonresponsive to adults, hurt and killed animals and ran away regularly, requiring help from police.

So they're trying to return him to the care of the state's Department of Human Services, but the state says adoptive parents should be treated no different from birth parents.

Adoptive Parents Treated the Same as Biological Ones, State Says

"A parent is a parent," Karen Poteet, who runs the state's post-adoption program, said. "It doesn't matter where the child came from."

Poteet says all parents are warned that the children they are adopting were abused or neglected and that the symptoms of that treatment could manifest themselves years later.

Poteet, who adopted two sisters in 2001, knows that all too well.

"My children were abused from the moment of conception because their birth mother chose to drink the entire pregnancy. That's no fault of my children," she said.

But the Wescotts say their son needs more care than they can provide. They are afraid to let him back into their home. If they don't, though, they could face felony child abandonment charges.

"It's not like we are trying to return an itchy sweater," said Melissa Wescott, who said she loved her son "unequivocally."

She said she believes loving him means letting him go.

Poteet said the last thing adoptive children need is to be rejected by another family, although that's rare.

Groups Tries to Change Law

There are 11,0000 children in Oklahoma's adoption system. This year, only 13 adoptions have been dissolved -- an expensive and lengthy legal process that's similar to a divorce.

The Wescotts can't afford it, so they're trying to have the law changed.

The Wescotts are part of a group seeking changes in state law that would allow adoptive parents to return custody of foster children to the state in certain circumstances.

"If a family can show that they have exhausted every resource ... every opportunity they can ... to save their families and this is what they're left with, then I think they should have this as an option," said Tina Cox of the Adoptive Parent Support Group. Adoption Issues Being Studied by Task Force

A Oklahoma legislative task force is evaluating issues involving adoptions of children in state custody.

Advocates of changing the law say adoptive parents should not be punished if their children have major disabilities that were not known or disclosed ahead of time.


"We knew what we could handle and what we couldn't," Melissa Wescott said, adding that they requested a child who wasn't "violent or acting out sexually."

DHS disclosure documents call the child "well-behaved" and "polite and well mannered." He is described as "respectful toward authority" and "makes friends easily." The papers say he has no "significant behavioral problems which would be considered abnormal for a child his age."

Poteet said adopted children have to have people who will stand up for them.

"If we don't do it, who's going to do it?" she said.

and he's as excited as a little kid..I think he's hitting the eggnog..yeah yeah I am mrs scrooge..I figured today that christmas was like a wedding..people want it perfect and if its not they take it out on those around mainly retail employees..I had a lady get mad because I wouldn't guarantee her casserole(yeah I said casserole) was gonna get to Alaska by christmas even going air...all could think of is that has got to be a damn good casserole...

I'm not excited about Christmas, but about going to Oklahoma Wednesday to spend Christmas with my son, his family and a big bunch of friends. Also the man checked the cabinets in the garage today and on the 7th of Jan. he will install them. Remodeled kitchen and then the house painted.
