This board was created so folks can discuss the current Michigan wolf dog legislation and how that impacts and/or affects the federally proposed Shambala bill. The Shambala proponents and anti wolf dog people consistently delete what they don't like to read. Questions regarding statements made; questions they just don't want to answer. Logic states that if you have nothing to hide, then you have nothing to hide. Not answering questions because, to quote" I have nothing to say to your kind" is nothing but an excuse to hide behind lies. Trash however (spam, etc) will be removed. This is an open forum. Unlike the anti board and Shambala, nothing will be deleted. Post here if you dare. Try to be nice, but quite frankly, I am not your mother. If you want to act like a jerk, that is your god given right.

Alright Ladies and Gentlemen, here’s how it is like to own a wolf mix. He is athletic, likes to play with kids and dogs, fearful of cats (probably was smacked before) and enjoys a good deer chase. He doesn’t know yet that they are meat, but there’s something important about them. He stays close when I take wooded trails; if I sit down he’ll find a stick to chew on – without an expressed acknowledgement of my presence, but with an overall healthy attitude toward life. On the way back it’s a different story however. He runs ahead and waits with his back hunched and eyes fixed. In a second the attack will begin. Of course it will end in 3 or 4 seconds after he gets a knee in his chest or a fist between his eyes.
It’s evening; time to go to sleep. He’s upset because you didn’t let him in your bedroom. Quietly he will sit in the dark on my antique sofa with his head hanging over the armrest without responding to my voice. The only thing that can bring him back is to say “good boy, good boy”. With this, he will look up and next his claws are clicking toward the master bedroom, where he will spend the rest of the night by my side of the bed snoring and passing gas.

Bad Situation

I got a bad situation and hope somebody can advise.
I got a brother and sister high content, very beautiful pair,
bred once and threw nice pups, all sold good. Kids going by tease them in there pen and he is digging out a lot now. One kid got bit,
not bad, but now neighbors want them dead and called
animal control. I got them at my brothers now so animal control can't kill them.
Need to find a good home for them. Tried a rescue but they say they
won't take them because he bit the kid who asked for it by teashing. They are good dogs. Kind of shy with most people and
they don't like other dogs. Brother cant keep them because his wife says no they are dangerous to the kids. I live in southern Arizona and will ship. They are free if you can pay to ship them.

I am sorry for writing so long after your message was posted. I was just curious what became of your wolfdogs? I hope that there was a happy ending to your bad situation. New Jersey is not a state that regulates wolf dogs. I was very lucky to have befriended a medium percentage dog years ago and lived with him as a regular house dog for 15 years. Because I had a great experience I am very stuck because I hear such sad stories about WDs and problems people have experienced. I honestly hope everything worked out for you and your animals

MICHIGAN'S NEW LAW AIMS TO EXTERMINATE WOLF DOGS

IT DEFINES THE TARGET BREED AS FOLLOWS:

"Wolf-dog cross" means a canid resulting from the breeding of any of the following:
(1) A wolf with a dog (2) A wolf dog cross with a dog

NOTE:

1. Dogs are in the same biological class as wolves. Wolves are the species. Dogs are a subspecies.
2. Every dog is a direct descendant of wolves, regardless of it's appearance.
3. THUS, every dog is, by legislative fiat, a wolf dog cross, no matter how remote its wolf ancestry.

Sen Leon Stille and Rep Gerry Law pushed this tyrannical law through the legislature, and Governor Engler signed it, all with full knowledge that it's target animals cannot be identified. Such is the power of the Michigan Humane Society.

One Senator who opposes "Breed Specific" laws has warned that the real danger of the new law is that with just slight change of definitions, ANY DOG BREED CAN BE ELIMINATED.

Animal rights activists will surely eliminate every breed in time, if this law is allowed to stand. Think about it.

Please contribute to the legal expense (estimated at $30,000 to $50,000 ) of challenging this unconstitutional law.

Girl Mauled to Death by Pit Bull

TYLER, Texas (AP) - A 3-year-old girl was mauled to death by her family's pit bull Tuesday after her mother fell asleep and the child wandered into the back yard, police said.

Investigators said Bevelon Austin apparently fell asleep and never noticed that her daughter Allayah had wandered into the yard where nine pit bulls were chained.

Mike Lusk, a Smith County Sheriff's Department detective, said a member of the family has already used a gun to kill the dog responsible for the mauling. The family's other eight pit bulls have been taken to the Humane Society and put under quarantine.

Police said it's too early to say if any criminal charges will be filed in the girl's death.

Researchers earlier this month announced rottweilers had surpassed pit bulls as America's deadliest dog. The large dogs were involved in 33 fatal attacks on humans between 1991 and 1998, according to a report by the American Veterinary Medical Association.

Pit bulls were involved in 21 fatal attacks over the same period.

Michigan wolf dog lawsuit information & Beth Duman

After hearing disheartening news from a recent Michigan animal control conference, I feel I must clarify some information. Some was no doubt accidental and came from lack of knowledge, but other was obviously deliberate slander and harassment.

First of all let me clarify exactly what the lawsuit we, Michigan Wolf Dog Rescue, along with the Michigan Wolf Dog Association, have instigated.

Mr. Marshall Tanick, an attorney based out of Minneapolis, MN had agreed to take our case. He clearly stated that the litigation will move forth in several stages.

Phase 1: Discovery and research. For this, his firm required a $5,000 retainer, which, contrary to what Beth Duman stated at the conference, was raised in less than 6 days. I have posted this several times and on various boards.

Phase 2: Litigation. For this Mr. Tanick requires $30,000 to be held in an escrow account. The reason for such an amount is simple. He feels, with the background on this legislation, that the lawsuit will move forward quickly and founds must be made available. He also must pay a Michigan attorney for his work.

I find it abominable that Beth Duman would stand up and state that the lawsuit and it's instigators are nothing more than a joke because they have 'raised only $6,000' so Michigan Animal Control need not worry over this and proceed with tracking down wolf dogs. Mrs. Duman has done animal control officers in this state a great disservice by instilling a false sense of security and assuring them that the wolf dog people are nothing but joke and 'nasties'.
I find it interesting, to say the least, that Beth Duman has NEVER been to my home or to our facility nor has bothered to learn what we are actually about, yet feels justified in stating to all Michigan animal control directors that we are not an organization or a rescue.

I have no idea where Mrs. Duman gets her information, if she indeed gets it anywhere, but we have raised over $16,000 so far. No, we do not yet have the full $30,000, but I am VERY confident we will, and shortly. And contrary to what some think, the case is ready for litigation. Work has been done by our attorney for several months.

Second, as I was told by an animal control acquaintance, the legitimacy of our organization was repeatedly brought up by Mrs. Duman.

The Michigan Wolf Dog Rescue is an incorporated Michigan non profit and a federal 501(c)(3) organization. We have a board of directors and officers. Where Mrs. Duman, according to an officer and a vet, state that the MWDR is "more like just on person" shows ignorance and spite. The IRS closely (and I mean CLOSELY) monitors our activities and our books. Claims that we do not have a facility are a joke, and a deadly one to potentially confiscated or abandoned wolf dogs. What Mrs. Duman should have stated was that she did not know WHERE our facility is. Very few people know, and for good reason after what I was told.
It certainly is not in my back yard (I live in the city of Marysville that does not allow more than 4 canines and does not allow for kennel licensing......and besides, half an acre is not enough space). I find it very difficult to believe that a so called professional, hired to instruct officers, would repeatedly state lies to a room full of animal control officers and deliberately attempt to destroy the reputation of an organization that has rescued and placed many wolf dogs within the past five years.

I hope this clarifies the situation for those of you interested.

I agree!!!!!!!!!

This whole group of people have been going all over the internet, hiding behind anonymous names, and deliberately are trying to destroy every wolf-hybrid (wolfdog) owner they can find, no matter what type of facility they have, then they try to pit wolf-hybrid owner against wolf-hybrid owner, figuring we are all dumb enough to fall for that and fight each other, which is purely stupid. None of us know what percentages our animals are. These people are the only ones that know what percentage our animals are, yes and without seeing them in person. I flat told them, I could tell their percentages by their body language and their personalities. That give them something more to chew on!!!!!! LOL

So for everyone out there, YES, all of us wolf-hybrid people do stick together and support each other and why shouldn't we, since we all are in it to care for the wolf-hybrids in the first place. Their care, concern and protection is no.1 on our list.
This anti wolfdog group can go spit their bullshit someplace else, because we know we stand behind each other.

We are more than half way there folks!!

Please keep the donations coming. I personally put in over a hundred a week. Even a few dollars from everyone each week adds up. We are almost there!!

Tanick needs and deserves the $30,000 he requested for phase two: LITIGATION.

The case is done and ready to be filed. And with what we sent him this week, there is very little doubt of losing.

All we need is a bit more than $13,000, and since we raised the bulk of this in the past few weeks alone, I know we will reach our goal.

Sounds like you all are doing a wonderful job. I am happy to see the great results and look forward to seeing this as a start of changing laws that are against the wolf-hybrids, also refered to as the wolf dog. Merriam Webster says: a hybrid is 1) an offspring of two animals or plants of different races, breeds, varieties, species or genera. Roget's Thesaurus says: a hybrid is 1) an offspring produced by parents of different strains, breeds, varieties, species, or genera. SYNONYMS:bastard,cross,crossbred,crossbreed,half blood,half-breed,mongrel,mule.
So either term is correct, wolf hybrid or wolfdog. I just wanted to kick this in as it seems so many people are obsessed with saying the term wolf-hybrid is incorrect.
Also I will be sending another donation around the first of the month. I am glad to be of a little help, to help the wolf hybrids. I really appreciate the work you are doing and give you a tremendous amount of credit for it. Thank you sincerely, "Wolf Haven of Arkansas"

Two dead dogs were brought to the Marquette General Hospital autopsy room by Trooper Hartley from Michigan State Police. The remains of the dogs were received by Dr. Smith and placed in the Marquette General Hospital morgue crypt

"Dog .1, Ivan; appearance consistent with Malamute. - This dog
is wearing a color with a tag bearing the name "Ivan". The dog weighs an estimated 110 to 120 lbs. and is 28 Inches high approximately at the shoulder. Two bullet wounds are noted. Examination of gastric contents shows the stomach contains ],"r'50 gm. of contents. This content includes nuni(@rotis pieces of skin consistent with Human skin. The pieces range in size up to approximately 10 @inches in maximum dimension. Some of the skin pieces contain incised and puncture wounds consistent with dog bite injuries. Multiple pieces of muscle tissue, fitt, connective tissue, tendinous tissue, an(i occasional small bone fragments are present. A few fragments of material consistent with day pieces of dog food are present.

The stomach contains approximately 50 gm. of viscid "coffee ground" green tinged material. . few half inch fragments of material consistent with pieces of dry dog food are present. NO flesh or other evidence of human remains are present in the stomach or small intestines.

Special Examinations

Corre'Lation of dog jaws with injuries imply that dog -1, the larger animal, was primarily responsible if not completely responsible for the premortem injuries. Physically, dog -i's jaws and teeth fit perfectly with premortem injuries allowing visualization of the manner in which the complex injuries were created (Photos taken, Michigan State Police files).

Dog jaws do not "fit" any of the major pre-mortem Injuries.

The dog brains are removed, labeled, and taken by Dr. Randy Johnson to be shipped to the Michigan Department of Public Health for "rabies examination"

Look at this report, notice the things in BOLD? I have no doubt in my mind about the severe neglect of a little girl who's MOTHER WAS TOO GOD DAMN BUSY TO SEE TO HER CHILD! Wolfdogs will start looking pretty good to you, when you realize how long you will rot in hell for your lies and deeds.

Whine all you want. You want to stop the breeding? You want to get animals I love and live with banned? You shouldn't have bred to begin with. I think I will go around the country and try to get women and men sterilized who are bad mothers and fathers. Perhaps they need rabies testing and should loose their heads.

I get my information from the police report, below that is the most factual rendition without your bullshit I've yet to see.

DOG ATTACK (HUMAN DEATH)

TIME / LOCATION

This incident occurred at approximately 11:40 A.M. on 3-2-89. The incident was called in at 1:10 P.M. Officer arrived at 1:30 P.M. to the driveway area of Box 1087, Rte. 3 just off County Road PB in Tilden Township, National Mine Location.

INFORMATION

Undersigned officer was contacted by Central Dispatch and sent to the above location to check on a report of a down child, possibly deceased.

SCENE

Officer arrived and was contacted by subjects who advised they had found the body of a child in the shoulder ditch-area of the listed driveway. The body was approximately 40 feet off the driveway in the snow. Two witnesses and two ambulance attendants were at the scene. Officer was advised the victim had no vital signs. The victim was checked by officer and he also found none. It was apparent to officer the victim had been deceased for some time.

There were blood stains sprayed in the snow and on the snow banks in the area. There were indications that there had been a struggle of some type in the driveway and in the snowy area near the driveway. This area covered about 200 feet from the start to where the body was located. There were clothing and personal items strewn around the driveway.

AMBULANCE

Bell Memorial Hospital ambulance attendants were advised by officers to take the victim to Bell Memorial Emergency Room and wait there for instructions from the medical examiner.

INTERVIEW WITH SHIRLEY SUNDBERG

Sundberg is a mail carrier for the National Mine area and advised the following:

At approximately 1:05 P.M. she was in the above listed area delivering mail when she observer 2 dogs ripping and tearing at some clothing or what she thought was possibly a deer hide. She continued down the roadway a short distance delivering mail and upon returning she observed a child’s backpack lying on the shoulder of the road. She then noticed a boot and some bloodstains on the side of the road. She was unsure what was going on at that point and when she noticed a Tilden Township pickup truck nearby she waved him down and told him what she saw and asked if he would check it out.

SUNDBERG told officer the first time she went by the scene she observed three dogs. The third dog was a short distance away from the other two who were in the area. The third dog was smaller than the other two and off-white in color with longer hair. The other two dogs were ripping at the clothing of the victim. SUNDBERG then accompanied officer to the residence of the dog owners and pointed them out to officer.

SUNDBERG later pointed out what she thought to be the third dog but before this officer could find it, it had disappeared down the road. Officer and SUNDBERG checked out several dogs in the area but none

matched the third dog's description.

After talking to SUNDBERG for some time, it is believed the two dogs that were killed were the only ones actually involved in the child’s death. Possibly the third dog was only a passerby and just interested in what the other two dogs were doing in the area.

INTERVIEW WITH FREDERICK VANLUVEN:

FREDERICK JAMES VANLUVEN of Rt. 3. BOX 1039A Ishpeming is an employee of Tilden Twp and was the worker SUNDSERG waved down to investigate the dogs. VANLUVEN advised he went over to the scene and observed the two dogs by the body. These two dogs were later killed by officers. Upon his arrival they both fled. VANLUVEN walked up the body and realized it was a small child. He checked for vital signs and found none. He yelled to SUNDBERG to call police. VANLUVEN also told officer he could ID the child as she is niece.

CONTACT WITH FRED ALDERTON

FRED ALDERTON, grandfather of the victim, is also co-owner of the Number 2 dog. He advised officers during their first contact with him that he did not know who the Number 1 dog belonged to. Both dogs were in his yard at this time in the driveway. ALDERTON gave officers permission to kill his dog when he was told what had happened.

ALDERTON advised he baby sits the victim when her mother is not home but did not know she was missing. He stated sometimes when she gets off the bus she goes home and watches TV and sometimes she comes over to his house.

Later, ALDERTON told officer that dog Number 1 belonged to his other daughter TAMI’S boyfriend. He told officer that neither of the dogs were mean and had never bit anybody. He said they have only had Number 2 dog for 8 or 10 months. About 6 weeks ago she had pups. None of the pups were outside at the time of the attack. He stated that Number 1 dog had been at the house for only one week. He said that he and TAMI and her boyfriend were in the house at the time of the attack and had hot heard anything.

DOGS INVOLVED

NUMBER 1 DOG: An eleven month old Husky, brown/ black/ white, weight 110 lbs.; known by the name "IVAN". The owner has only had this dog for two weeks and purchased it from the HOUGHTON HUMANE SOCIETY. The dog had all of its shots and was not sick. It did not appear to be malnourished or abused.

NUMBER 2 DOG: A 1 1/2 year old Husky/ shepherd mix. brown/black in color, known by the name "BRANDY". This dog was previously owned by TIM HANSEN of Ishpeming.

NUNBER 3 DOG: Not found. An off-white mutt type dog with long hair weighing about 50 lbs. It is felt that this dog was not involved in the attack but happened to be in the area at the time.

Number 1 dog was shot and killed by TPR. SWEARENGIN in the driveway of the ALDERTON residence. The dog was shot 2 times with a 223 rifle and died on the spot. An autopsy on this dog showed it to be the main subject of the attack and the most involved in the victim's death.

Number 2 dog was shot by TPR. SWEARENGIN on County Road PB. It was shot a second time and died in the yard of ROY DELARYE about 100 feet from where it had been shot the first time. An autopsy on this dog showed it to also be involved in the death but to a lesser degree.

INTERVIEW WITH ROY & GAIL DELARYE

ROY DELARYE of County Road PBD, Rt. 1, Ishpeming, advised officer that approximately 11:40 A.M. he looked out the kitchen window and observed the 2 dogs that were later killed, ripping and tearing what he thought was a bag of trash or a deer hide. This was in the area where the body was found. He advised that it is not uncommon for dogs in the National Mine area to be roaming around getting into people’s trash, etc. He advised that there is also a trapper in the area and sometimes he has animal carcasses taken from his property by animals in the area. He advised that when he observed all the commotion with the police, etc. he went down to the scene and then realized that it was a small child that the dogs had been at and not anything else. It was in his yard the second animal died. The animal ran into his breezeway area and was later removed and destroyed.

GAIL is the wife of ROY and lives at the same address. She advised at 11:30 A.M. she saw the victim get off the bus and walk up her driveway. She said the victim was fine at the time and no dogs were around. She stopped looking out the window and went back about her business. She said a few minutes later her husband called her to the window to show her the dogs and she related the same story as he did about them.

CONTACT WITH ELLA ALDERTON

ELLA ALDERTON, wife of FRED, advised she was gone during the attack but her husband, daughter (TAMI) and her boy-friend were home. She advised the victim comes over to her house after school sometimes if she feels like it. Other times she stays home and watches TV if her mother is not home. She did not have anything more to add than what FRED had told the officer.

INTERVIEW WITH MICHAEL DAILY

MICHAEL JAY DAILY, W/M DOB 9/3/66, 105 E. Montezuma, Houghton, MI is the owner of dog Number 1. When he is not going to college at Houghton, resides at the ALDERTON residence. He advised that Number 1 dog is his having purchased it from the Houghton Humane Society 2 weeks ago. The Aldertons had been keeping the animal for him for approximately one week. The dog was current on his shots, and he had no idea as to why it would have attacked the victim. He stated that the dog has not shown any aggression towards anybody since he has owned it.

CONTACT WITH TED SMITH
TED SMITH, W/M, 1094-B, Ishpeming, is the owner of a large white dog that lives in the general area of the attack. Undersigned officer, along with DETECTIVE KING, contacted the owner of the animal, Mr. Smith, and advised him of the situation. The dog was checked over and nothing found on the dog. While officer was there the dog regurgitated the contents of its stomach. Undersigned officer (TPR SWEARENGIN) inspected the contents and found no evidence of this dog being involved in the attack. Undersigned officer does not believe this dog was directly involved in the attack. At best, the dog may have been in the area after the attack.
INVESTIGATION
Investigation of this attack was conducted by TPR. SWEARENGIN and D/SGT. JOHN KING with assistance from TPRS. KRUGIELKI, HAAS, and HARTLEY.
Photos were taken by D/SGT. JOHN KING at the scene and at the autopsy. KING also picked up the clothing and other items strewn at the scene. All officers looked for the third dog with nil results. TPR. HARTLEY transported the two dead dogs to Marquette General Hospital in an Ishpeming Twn. Pickup truck.
CONTACT PROSECUTOR:
Prosecutor WALKER was contacted by D/SGT. JOHN KING and advised of the situation. At this point, no authorization for any charges on any one is being contemplated until further investigation is concluded.
VICTIM:
ANGIE MARIE NICKERSON WF 4-21-83 address Rte. 3, Box 1087, (National Mine) Ishpeming, MI, 4 feet tall, 60 lbs., brn/brn hair in a pony tail. Victim was a student of National Mine School in the kindergarten class. She was last seen alive by GAIL DELARYE at approximately 11:30 A. M. on 3/2/89. CLOTHING: Blue jeans, a black striped sweater. Found at the scene also were a pink boot and a pink jacket.

CONTACT WITH MOTHER OF VICTIM

PATTI JEAN NICKERSON,- W/F, DOB 9-9-60 of same address, TX 486-6909. Arrived at the scene about 20 minutes after officer did. She was advised of the situation and gave officer the following information.

She advised she went to town to have her hair done and was accompanied by her boy friend DON MANNING. She has made arrangements with her parents to watch her daughter if she is not home. Sometimes her daughter did not go over to their home but would stay home and watch TV. She advised they have never had any trouble with the dogs before and she was not aware of her daughter being afraid of any of the animals.

INTERVIEW WITH JESSI NICKERSON

JESSI is the brother of the victim and he advised he had never had any problem with the dogs. He told officer his sister was afraid of the big dog (Number 1).He said she never teased the dogs and liked all animals.

INTERVIEW WITH DON MANNING

DON MANNING, boyfriend of the victim’s mother lives at Box 44, M-3S, Palmer TX- 475-5195. He advised he picked up PATTI after the kids went to school and they went shopping and when they returned they saw police. He did not know anything in particular about the incident until arriving and being briefed by undersigned officer. He stated that the dogs have been around and that he has not seen any vicious actions by either of the dogs since he has been in the area, although the one dog has been at the house for just a short time.

AUTOPSY:

An autopsy was conducted at Marquette General Hospital by Dr. RANDY SMITH with TPR. SWEARENGIN and D/SGT. JOHN KING present. The two dogs were also checked by DR. SMITH and officers. Preliminary results were that the two dogs were both involved in the attack and death of the victim. Further information will be in the formal report.

CRIME SCENE INVESTIGATED:

The undersigned was contacted by Station #81 desk and advised that there had been the death of a child in the National Mine area. This death was located just off of County PB in Tilden Twn., National Mine. The desk advised the undersigned that it appears the child has been killed by dogs. At the present time there is a trooper at the scene.

The undersigned went directly to National Mine with TPR. KRUGIELKI and located TPR. ALVA SWEARENGIN at the scene of the incident. TPR. SWEARENGIN advised that he had ordered the body removed due to the fact that the relatives had just arrived. The body at the present time was located at Bell Memorial Hospital, Ishpeming, MI.

MEDICAL EXAMINER CONTACTED:

The undersigned had contact with DR. RANDY SMITH, chief medical examiner for the county of Mar­quette. He was advised of the situation and the fact that a five year old white female had been mauled to death by dogs and partially eaten. He was also advised TPR. SWEARENGIN had shot two of the dogs believed involved in the incident. RANDY SMITH advised to transport the body from Bell Memorial Hospital to Marquette General Hospital as soon as possible and that upon bagging of the two dogs, they are to be brought to Marquette General Hospital also.


RETURN TO SCENE:


The undersigned then returned to the scene of the incident and processed the scene for TPR.SWEARENGIN. Numerous photographs were taken of the area that the body was in and also the road area located approximately 40 feet from the edge of the victim's home towards County Road PB. The undersigned's opinion is that the child was attacked on the road approximately forty or fifty feet from her residence by one or more dogs, knocked down several times, then it appears bled on the road in minor amounts, becoming a large amount and, then a great amount as the child and dogs approached the area where her body was found. Numerous photographs taken of this also. Six items were removed from the road and from the area where the body was located. These will be carried under a separate heading.

INFORMATION FROM TROOPER SWEARENGIN:

TROOPER SWEARENGIN advised that the dogs that he had shot had been pointed out to him as being the dogs possibly involved. One dog had managed to elude him, that being a white dog, fairly good size. TROOPER SWEARENGIN advised that he did not get a good look at the dog and that possibly it could be a neighbor’s dog, TED SMITH’S dog. Upon locating a possible dog the mail-lady, who originally had made the report to the state police post, would have to be contacted to verify if it was the same dog.

ATTEMPT TO LOCATE THE THIRD DOG

The undersigned, TPR. SWEARENGIN, TPR. KRUGIELKI, TPR. HAAS, and later on TPR. PHIL STANTON, all patrolled the area with negative results. One large white dog was located trying to jump the fence going into the caving ground. This animal was pursued by TPR. STEPHEN HAAS and the undersigned to its residence. This residence is the TED SMITH residence located directly down the hill from the scene of the incident.

TPR. ALVA SWEARENGIN brought the mail-lady and complaint to the SMITH residence. Upon viewing the dog she stated it was not the dog.

Due to the lateness of the evening at this time and the fact that the dog could not be located all of the officers directly involved left the area with the exception of TPRS. HARTLEY and KRUGIELKI who are now working the afternoon shift. They would stay in the area in an attempt to locate the suspect third dog.

DOGS TRANSPORTED TO MARQUETTE GENERAL HOSPITAL:

The dog wagon was followed from the Ishpeming Police Department and both of the dogs that had been shot by SWEARENGIN were taken to Marquette General Hospital where they were taken up to the laboratory and placed in the morgue. These dogs will be autopsied sometime during the day 3/3/89.These animals were transported from the scene by TPR. HARTLEY who was driving the Ishpeming dog wagon.

ITEMS REMOVED FROM THE SCENE OF DEATH:

(1) One (1) purple book bag full of books
(2) One (1) small, size 8, pink jacket, torn with a sleeve missing, LORJAN brand
(3) One (1) pink snow boot
(4) One (1) piece of pink cloth
(5) One (1) plastic bag containing a piece of insulation material
(6) Two (2) pieces of white coat material
These items were removed from the scene and packaged by the undersigned. They will be taken to the Marquette Crime Lab as soon as possible. However, all of these items are wet and will have to be dried.
AUTOPSY HELD
The morning of 3/3/89 the undersigned was contacted by DR. RANDY SMITH at approximately 9:15 A.M. He advised that as soon as the undersigned could arrive, the autopsy on the victim and the dogs would start.
On 3/3/89 DR. RANDY SMITH performed an autopsy upon the victim at Marquette General Hospital. A large amount of polaroid photos were taken by the undersigned of the victim along with polaroid shots of the dogs involved.
Approximately one hundred and twenty-five (l25) 35 mm photographs were also taken by the undersigned reference this complaint.
It appears that the child was attacked and partially eaten by one or more of the animals involved in her death. Most of the skin and muscle area on the buttocks had been stripped. The muscle and skin area of the legs was stripped. A large area was open between the chest and the hip in the right back area and a large amount of intestines had been removed.

AUTOPSY DOG #1

Dog #1 which is the large male was autopsied by DR. RANDY SMITH. Found in the stomach content of this animal was what appears to be the material that was stripped from the victim. This dog’s head was severed from its’ body and then skinned revealing the skeletal portion of the head. The teeth part of the dog were fitted into several wounds on the child and it appeared to be this animal that caused most of the damage to the child.

AUTOPSY DOG #2

This is the smaller female dog that was seen tugging on the child’s clothing. There was nothing found in this dog’s stomach other than bile and blood. Its’ head was also skinned and the teeth did not match up with the wounds on the child.

HEALTH DEPARTMENT INVOLVED:

DR. RANDY JOHNSON, Marquette County Health Doctor, came into the room during the autopsy. Due to the type of death involved and the fact that there were 2 dogs involved, both of their brains are being shipped to the Health Dept. in Lansing to determine if they were rabid or not. Both of these brains were packaged separately and given to DR. RANDY JOHNSON who said he would transport these items to the Health Lab in Lansing.

( On 3/8/89 the undersigned was contacted by DR. RANDY SMITH and advised that he had been advised by DR. RANDY JOHNSON of the Marquette Co. Health Dept. that neither one of the dogs were rabid. )


ITEMS REMOVED FROM THE VICTIM:

(7) One (1) child’s sweater, black in color, with yellow, red, and blue stripes
(8) One (1) child’s white sock
(9) One (1) small white panty
(10) One (1) girl’s white undershirt
(11) One (1) small pair of girl’s jeans
These items will be taken to the Marquette Crime Lab to determine blood type, to determine if there were any animal hairs on them which could possibly be compared with the two suspect animals.
ITEMS REMOVED FROM DOGS AND VICTIM TO BE TAKEN TO MARQUETTE CRIME LAB:

(12) One (1) plastic container which contains chest hair removed from dog #1 (the large male)
(13) One (1) small brown envelope which contains known hair from dog #1 which is the large male
(14) One (1) small brown envelope which contains known hair from dog #2 which is the female
(15) One (1) small stick and purple material type hair holder which has known samples of victim’s hair
(16) One (1) brown dog collar with tag bearing the name “IVAN” and TAMI ALDERTON, Rte. 3,
National Mine, 486-6909
(17) One (1) brown envelope which contains two blood samples from the victim

CONTACT M.S.P. LAB, MARQUETTE:


The undersigned had contact with the M.S.P. Lab in Marquette on the evening of 3/3/89, D/Lieutenant DAVID LARSEN. The undersigned advised that he would be bringing in numerous items to be compared in this complaint. However, they would have to dry out and possibly would dry over the weekend.
On 3/6/89 the undersigned did, in fact package all of the items held as evidence in this complaint and took same to the Marquette Crime Lab for analysis. All of these items were turned over to DENNIS MAPES of the Marquette Crime Lab. The type of information requested from the lab is the type of blood of the victim and also determine if this type is on any of the dog hairs. Also if there are dog hairs on the clothes they are to be compared with the known dog hair that was removed from both dog #1 and dog #2.There is a bloodstain on the tag of the brown dog collar which should be compared with the victim's blood. Also the chest hair removed from dog #1 should be checked for blood type to determine if it is the same as the victim's or the dog's own blood.

CONTACT PROTECTIVE SERVICES
The undersigned had contact with Protective Services on the morning of 3/6/89. Protective Services worker, DAN FORRESTER, had been contacted by Sergeant PAUL NUMIKOSKI reference the possibility of a
P. S. Case. At this point in time, DAN FORRESTER does not believe it is a protective services' case.
The undersigned had contact with JULIE HADDAS, the supervisor from Protective Services. She was appraised of the situation and the fact that her office would be receiving a copy of our complaint for discussion to determine if there is any action to be taken by anyone from Protective Services.


RECONTACT GARY WALKER:


The undersigned, along with TPR. ALVA SWEARENGIN, had explained the basic facts as they were known to GARY WALKER in his office on the afternoon of 3/3/89.At the present time the only thing that has been done in this complaint is to determine where the third dog is and its owner. Also determine who owned dog #1 prior to it being picked up and brought to National Mine. He is requesting that some one get a hold of the former owner of the large dog to determine if the dog was vicious or not.


CONTACT D/SERGEANT BALL:


The undersigned had contact with D/SERGEANT BALL by TX on the morning of 3/6/89. D/SERGEANT BALL was requested to find out who the Humane Society worker was that had the dog, if there was any paperwork filled out on the animal when it was turned over to the present owner, and who the former owner was so that the undersigned and one of the prosecutors from the Marquette County Prosecutor's Office could do these interviews.


D/SERGEANT BALL advised that they have no building that the Humane Society uses to keep any animals. The animals that are taken in are kept by the local worker . He will check and advise later today what the situation is and as to what information he is able to find out.

RECONTACT PROSECUTOR'S OFFICE:


The undersigned had contact with GARY WALKER in the afternoon of 3/6/89 and he was appraised of the situation as it stands at this time. He advised that tomorrow morning would be soon enough for his office to receive a copy of this complaint.


ADDTTIONAL INFORMATION:


The undersigned had been contacted by an anonymous person who advised that he had been contacted by DAN and RITA NIEMISTO of the National Mine area, TX 486-6330.The subject had been advised that the victim had been chased by the same animal some time prior to the incident in which she died.

Numerous attempts have been made this date to contact the NIEMISTO'S by TX with negative results. Further attempts will be made.


ATTEMPT TO CONTACT PATRICK HEALEY:


The undersigned had been made aware by CHIEF JOHN HEALEY of the Ishpeming Police Department that his brother, who is a U.P.S. driver, had been in the National Mine area between 12:20 and 12:30 P.M. on the day of the incident. His brother had advised him that he had seen several dogs in the area and thought they were playing with garbage.

Upon contact with CHIEF HEALEY and his dispatcher, LAURA REED, both advised that PATRICK had observed the dogs in the area but the only one he could describe or remember was a very large male husky/German shepherd.

CONACT WITH RITA NIEMISTO:

RITA and DANIEL NIEMISTO. Rte. 3. Box 1128, Ishpeming, MI, TX 486-6330.


Contact wasmade with RITA NIEMISTO by TX. She advised that she lives next to the school in National Mine. RITA NIEMISTO is the party that information was given to the undersigned about an having seen a similar type attack on the same victim earlier. Upon having contact with RITA NIEMISTO she advised that she did not see the dogs attack the child, however, had been going by when the child got off the bus and the dogs ran down to the area where she was at. That is the only information that she had. She advised that she never did see any of the dogs actually attack the girl on that date nor did she see anything on the day of the death of the child which was 3/2/89.



RECONTACT D/SGT BALL:


Contact was made with D/SGT. BALL and a copy of his information was obtained which will be used to complete the additional information needed in this complaint. Copy of said complaint in attached to this complaint and will be included with the original.



RECONTACT WITH MARQUETTE COUNTY PROSECUTOR'S OFFICE:


The undersigned had contact with Marquette County Prosecutor's Office at approximately 10:30 A.M. on 3/7/89.After discussing the case and what needed to be done on it. the undersigned along with the Chief Assistant Prosecutor PETER PLUMMER and TROOPER MITCH KRUGIELKI, proceeded into the Houghton area to complete the necessary interviews that had to be done there.

INTERVIEW MICHAEL JAY DAILY:

On 3/7/89 at approximately 1:15 P.M. MICHAEL JAY DAILY was interviewed at his place of residence on Montezuma Avenue in the village of Houghton. Interview took place in the front seat of Car U8120. MR. DAILY was advised why the undersigned and the prosecutor were there and that we needed a verification of the information he had originally provided to the trooper involved. MR. DAILY advised that he picked up the dog approximately one week ago on a Thursday from a person in Ahmeek. MI. This person is the person who keeps the dogs for the Humane Society. MR. DAILY advised that he had gone to this location four or five times before he took the dog. Upon first taking the dog, he brought the dog to the Frat House in Houghton where the dog was kept until he left to take it to the ALDERTON residence. He clarified the day that he picked the dog up as stating "it was a couple of days before he got out of school on break" which he believes to be 2/23/89. He stated that during the time he had the dog in Houghton the dog did break loose and he did have trouble enticing the dog back to be rechained. He stated that. upon getting out on the break for spring. he went to the National Mine area and took the dog with him. The dog was chained at that residence until 3/1/89. He believes about 3/1/89 the dog was unchained. He has no idea who released the dog. however. he advised that ELLA ANDERTON said that if the dog stayed around he could stay off of the chain. As to the party he picked the dog up from at Ahmeek. He stated he believes the woman's name was ROBERTA NIEMI. As far as obtaining any paperwork from the Humane Society, he said no paperwork was exchanged between himself and ROBERTA NIEMI.

Upon arriving in the National Mine area and attempting to license the dog, he had taken it to DR. ALTO in Negaunee to obtain his shots. He advised that when he picked the dog up he had been told by ROBERTA NIEMI that the dog had been beaten and was afraid of men. This is the reason he went to the location where the dog was kept four or five times in an attempt to gain the dog's confidence. As far as being mean, MICHAEL advised he didn't think the dog was mean. As far as the day in question. he advised that his girlfriend TAMMY and himself had fallen asleep in ELLA ALDERTON'S house. They were responsible for watching for the child to come home from school but they knew nothing of the incident until ELLA ALDERTON came home and told them what had happened. To the best of their knowledge they had been asked by PATTI NICKERSON, mother of the victim to watch for the child as PATTI was going into town with her boyfriend to have her hair fixed. MICHAEL stated the child was supposed to come up to Grandma's house after school.


CONTACT AMIMAL CONROL OFFICER OF HOUGHTON COUNTY:


At 2:30 P.M. on 3/7/89 the undersigned, along with PETER PLUMMER and TROOPER KRUGIELKI. made contact with the Houghton County Animal Control Officer, SIDNEY COLLINS. He stated that the dog in question had been picked up by himself after he had been chasing the dog for several weeks. On being picked up, the dog looked well-fed and would run when approached. As far as any contact he had with the animal he stated the dog never became vicious with his and he never had any trouble with him. The dog in question which he picked up was a large husky/malemute and he guesses the weight between 80-90 pounds. He stated the dog was timid and it in his opinion that it was probably mishandled.

SID COLLINS advised that he has had two complaints on the animal. the first one being 1/4/89 at approximately 9:30 A.M. This complaint came in from AGNES ASSILA. He advised that the dog was staying in the area by her house which is located on the Old Mill Road in Atlantic Mine, MI. He stated he had received a similar complaint from DEBBIE KEMPPINEN on 1/12/89 at 8:55 A.M. She advised that the dog was in the area and had been for quite some time. He advised that on 1/16/89 at approximately 1:30 P.M. he had picked the animal up at the KEMPPINEN residence and had taken it to DR. AHO, on Sharon Avenue in Houghton, MI. This dog was kept at that location until 1/20/89 when it was released to the Copper Country Humane Society. DIANE TRUDGEON. The dog as far as he knows was then taken care of by Copper Country Humane Society until it was released. He has no idea what could have happened to the dog or where the dog had gone. He advised that the Copper Country Humane Society has no specific place that they keep these dogs, however, there are several people who will keep the dogs for the Humane Society and feed them. To the beat of his knowledge they have no permanent location where the dogs are kept.

Animal control officer, SID COLLINS, did provide a copy of both of his complaints along with a copy of the card he fills out when a dog is picked up. He also includes on this card if the dog is destroyed or released. This animal had been released on 1/20/89 to the Humane Society. These will be attached to the complaint also.

CHECK LOST AND FOUND ANIMALS FOR PLACEMENT AND OTHER NEWSPAPER ADS:


The undersigned and PETER PLUMMER and TROOPER KRUGIELKI did go to the HOUGHTON GAZETTE and check their ads for the month of December looking for a possible missing dog ad. Nothing was located in the December want-ads of the HOUGHTON GAZETTE.

CONTACT WITHROBERTA NIEMI:


ROBERTA NIEMI. Five Mile Point Road, Ahmeek, MI. 49901, TX 337-2234. was contacted by the parties involved on 3/7/89 at her residence located north of Ahmeek.

ROBERTA NIEMI advises that she does take care of numerous animals for the Copper Country Humane Society. She stated that as far as the dog in question, she had the dog at her residence for approximately 3-4 weeks having obtained it from the humane society. This dog was brought to her by JOAN SCHUTTE who lives in the Ahmeek area. She advised that she thought the dog was brought from a vet but she was unsure. As to the release of the dog, she stated that a subject by the name of MIKE came to her house and she had been that he would be coming by DIANE TRUDGEON. She filled out no paperwork on the dog when the dog was taken. She stated that the dog in question was kept outside during the time it was at her location. She stated the dog was a male and was very shy for whatever reason. As far as any past history on the dog, ROBERTA

NIEMI advised she had not been told anything. She stated that the dog would back away from a male upon being approached. She believes that the dog was picked up by MICHAEL on the Monday before spring break. As far as the type of collar the dog had, she advised that they supply a collar if one is needed. She is unsure if they put a collar on that dog or not. She thinks this animal was about one year old and weighed approximately 85-90 pounds. She has no idea where the dog came from. She does not believe he had been neutered and knows that he was a male. She stated that the normal procedure is that the animal is taken to a vet and then is brought to her place until they can place the dog. She does remember talking to the subject who picked the dog up. The fellow stated that he was going to give it to his girlfriend and that he did come to the residence 3 - 5 times to see the dog prior to taking him.

CONTACT AND INTERVIEW WITH DEBRA KEMPPINEN:


On 3/7/89 at approximately 5:50 P.M. DEBRA KEMPPINEN was contacted at her residence located at 127 Huron Street, Atlantic Mine, MI, TX 482-8081.
DEBRA KEMPPINEN stated that the animal in question had been in the area for approximately ten days and she was feeding it. To the best of her knowledge this dog had a brown collar on. She further advised that she made several telephone calls to the local animal control officer but this subject could not catch the dog when he came. She has no idea where the dog came from. However, it was a large husky with strange eyes and she would guess the weight to be 80-85 lbs. As to the actual apprehension of the animal, she stated that she is the one who caught him as she baited the dog with food and then caught his collar and snapped him on a chain. She stated she believed the animal first came to her residence in the early part of January and she believes it was a male. She stated the dog would go to the kids and she thinks it was approximately two to three years old. As far as any missing dog ads in the local paper, she stated that she had called all of the ads that were in the paper on any type of dog, reference this one and was unable to find the owner. She said the dog kind of looked strange and reminded her of a wolf. She did state that, upon calling the animal control officer and his arrival, he had trouble loading the dog. However, she didn't believe the dog was snapping at the man at that time.
CONTACT AGNES ASSILA:
On 3/7/89 at approximately 6:30 P.M. AGNES ASSILA of Old Mill Road, Atlantic Mine, MI, TX 482-3854, was contacted by the parties involved. She stated that the animal in question had been around
her residence since approximately two weeks before Christmas. She stated that some time in November or December there were ads in the MINING GAZETTE that they were giving this type of dog away,
however, she never did call the ad and is unsure if this is one of the dogs involved or not. She stated that she had two young boys that would come to her residence and that this animal would pull the kids around by the seat of their pants. She stated that she could not catch the dog, however, she did feed it. The dog catcher said it had quills in its mouth, however, she was unsure of this. She stated that sometime around the first of the year this dog did get some quills in its mussle and then left the area around her residence. Her son thinks that the dog had a black collar on with the tag removed. However, he is unsure. MRS. ASSILA advised that she did have a picture of this animal and that although she was unable to locate it at this time, she would take the picture to the Houghton County Sheriff's Department and leave it there the next day, that being 3/8/89. She advised that she normally goes to town approximately 10:00 A.M. and the first stop she would make would be at the Animal Control Officer's Office, that being the Houghton County Sheriff's Department.
PHOTOGRAPH OBTAINED:

On the morning of 3/8/89 the undersigned and TROOPER KRUGIELKI did stop at the Houghton County Sheriff's Department. There was a picture of the large husky dog left there by MRS. ASSILA. This copy is attached to the complaint.

RECONTACT THE MINING GAZETTE:

The undersigned and TROOPER KRUGIELKI did recontact the MINING GAZETTE and went through all of their ads in an attempt to determine if any of these dogs had been given away or were sold. There were approximately four ads in the paper pertaining to husky type animals. Upon checking with these people, they either all had the dog at this time or knew that the dog that they had given away was alive and in good hands.



CONTACT DIANE TRUDGEON:


On 3/8/89 the undersigned and TROOPER KRUGIELKI had contact with DIANE TRUDGEON at her place of employment which is COPPER HARBOR SCHOOL in Copper Harbor, MI. She has an address of Box 251, Mohawk, MI, TX 337-S3S5.

MRS. TRUDGEON advised that she is the president of the COPPER COUNTRY HUMANS SOCIETY, Box 3S4, Hancock, MI. 49930. She advised that she came in contact with this animal on 1/16/89 having been advised by Houghton County Sheriff's Department. This dog was picked up approximately 1/20/89 and taken to ROBERTA NIEMI'S by JOAN SCHUTTZ and herself for confinement until such a time an they could find an owner for the animal. The dog had come from DR. AHO'S office located on Sharon Avenue in Houghton. These animals, when picked up by an animal control officer or anyone else, would be taken to a vet in the local area. The dog would receive its vaccinations and after a four-day stay would then be released to them. They have no paperwork whatsoever that this animal was ever given its shots by the vet, however, this is not unusual as there is never any paperwork. She went on to state that there was no paperwork exchanged between herself, any member of the Copper Country Humane Society, and the new owner. She states there is no "cost" for any animal that they give away, however, if they would like to make a donation it would probably have been given to ROBERTA NIEMI.ROBERTA NIEMI never advised her that the person who picked up this dog gave any donation to the society.

When questioned about a particular ad which had been located in the paper, stating a large male husky, last chance, she stated that ad was placed by ROBERT BASTIAN. This subject stays in the Calumet area. She stated that while she was in the car with this dog there were no problems. The dog did not growl nor was he vicious. She was not aware that this animal left the area and it was their policy that the animals do not leave the area. However, in this case that in what happened.


CONTACT DR. AHO:


DR. DALE AHO'S office. the COPPER COUNTRY VETERINARIAN CLINIC, located at 904 Sharon Avenue, Houghton, MI. TX 482-1771, was contacted by the parties involved.

This dog was brought in by the animal control officer from Houghton County. It was given its vaccination, that being rabies, distemper and hepatitis, with the billing being billed to the Copper Country Humane Society. This dog was then released to the Humane Society for placement. As far as any quills being in this dogs face, the parties at the Copper Country Veterinarian Clinic, do not remember seeing any.

CONTACT NEGAUNEE VETERINARIAN CLINIC:

Negaunee Veterinarian Clinic is staffed by DR. GERALD AALTO and S. SUSAN CAMMON. The undersigned and the officer involved made contact at the Negaunee Veterinarian Clinic and SUSAN CAMMON advised that the dog "IVAN" as they have it noted, was brought in 2/28/89 for shots. The shots were administered by DR. CAMMON for distemper and rabies, this due to the fact that these shots have to be given before the dog can be licensed. The dog was brought in by MICHAEL DAILY.

The next day the undersigned was recontacted by the doctor who advised that this animal was not well behaved and did try to bite her when she tried to cut his toenails. She did not cut all of the toenails on this dog due to this fact. MICHAEL DAILY had told her that the dog did not like having his feet fooled with.

RECONTACT WITH DR. RANDY SMITH:

On 3/8/89 the undersigned was contacted by DR. RANDY SMITH and advised that he had been advised by DR. RANDY JOHNSON of the Marquette County Health Department that neither one of the dogs were rabid.

RECONTACT FROM ANONYMOUS SOURCE:

The undersigned had been contacted by an anonymous source and advised that the items of clothing from the child that were missing could be located at DIANE JOHNSON'S residence located right next to the ALDERTON'S.

CONTACT DIANE JOHNSON:

In the early evening hours of 3/8/89 the undersigned and TROOPER KRUGIELKI had contact with DIANE JOHNSON of National Mine. Her house is located directly above the scene of where the body was located. Her driveway is located in about the area where the dog attack took place. She stated that she did pick up a hat in her driveway which was pink in color. She did pick up a sleeve in the middle of the driveway. Also a boot and a sock on the left side of the road. These items were picked up by herself, placed in a bag and then placed in the entryway to her house and then sent to the dump the next day. She had done this due to the fact that she had asked the grandfather FRED what she should do. FRED told her to pick the items up and she stated she did. Upon picking them up, she said "what shall I do with them?" and the grandfather told her to throw them away. DIANE JOHNSON has an address of Route 3, Box 1089, Ishpeming, MI, and no telephone.

CONTACT MADE WITH FRED ALDERTON:

The undersigned went to the FRED ALDERTON residence and asked MR. ALDERTON to return to the rear seat of Car #6120 and at that point asked MR. ALDERTON if what his neighbor, DIANE JOHNSON, had stated was true. He stated "Yes". He was advised that we had been looking for these items, however, now that they were destroyed there was no sense in looking any further. As far as any questions about the incident at this point in time FRED ALDERTON advised that he had none. As far as his daughter to the best of his knowledge, his daughter has none.

Undersigned attempted to contact PATTI NICKERSON every day and each day, upon calling, was told that she was sleeping. However, upon her returning the calls the undersigned was not in the office.


ADDITIONAL INFORMATION ON POSSIPLE THIRD DOG:
On the morning of 3/7/89 at approximately 9:30 A.M. the undersigned was contacted by DEBRA PELLOW who is on the Tilden Township Board and has a TX of 485-4203.
PELLOW advised that this dog had been seen by a BERNARD AHO, TX 486-9104. This subject should know who the owner of the third dog is.
CONTACT BERNARD AHO:

BERNARD AHO was contacted by the undersigned at TX 486-9104. He advised that he had been going towards his home by the school and upon driving up the hill had noticed several dogs in the area of the location of the victim's body. He backed up and pulled up alongside of where the dogs were, looked at what he thought was a ragdoll and upon approaching it, had looked up the road and saw what he thought was stuffing. He thought the dogs had pulled a ragdoll apart so he left and went home. This was approximately 12:20 or 12:30 P.M. As far as identifying the other dogs, he stated he could not as he does not remember what they looked like.

LETTER RECEIVIED:

The undersigned was advised by CHIEF JOHN HEALEY of the Ishpeming Police Department that they had received a letter addressed to the family of the dog victim (Girl, age 5). C/o Ishpeming Police Department, (Headquarters), Ishpeming. MI. 49849. Under that was the spelling (Please forward) with a return address of JOSEPH M. FARKAS, P.O. Box 254, Vales Gate, New York, 12584.

CHIEF HEALEY was wondering if the undersigned wanted to take this to the family of the victim. The undersigned advised CHIEF HEALEY that he would drive to his station and attempt to make a determination.

Upon arrival at the station and looking at the type of letter it was, contact was made with ELLA ALDERTON and she was advised at that time that the undersigned had no idea what was in this envelope and that the undersigned felt it would be to everybody's advantage for the undersigned to open this envelope prior to giving it to MRS. NICKERSON. ELLA ALDERTON agreed and the envelope was opened. It was found to contain religious information from the Seventh Day Adventists. This envelope was taken to the ALDERTON residence and given to one of the daughters of ELLA ALDERTON as MRS. ALDERTON was not home.

RECONTACT RANDY SMITH AND PROSECUTOR'S OFFICE:

Both RANDY SMITH and the prosecutor's office were contacted by telephone and advised of the update on this complaint and the fact that at this point in time it appears the only thing left to do is to wait for the lab results which should arrive shortly.

CONTACT M.S.P. LAB IN MARQUETTE:

The undersigned had contact with DAVID LARSEN and advised that it appears there is very little to do on this complaint and that we would be waiting upon the arrival of the lab reports as to the numerous things that were requested that the lab personnel do.

The mysterious disappearing post on the Patti BB

The following is a copy of my posting to the Patti BB that just disappeared this afternoon, have to wonder WHY????? Oh, BTW Patti, it most definately is the complete Police Report that was sent out by the state of MI upon request. All you did was whine that it was only a partial report and now it is complete and you are still pulling my posts. No, I have not posted the formal autopsy report but the PR contains some of the information but not in detail. What are you trying to hide??????

like the full police report. The only thing I notice, again, not having the report in front of me, is the last page where Casselman is NOT to be spoken too until going thru the police. He is the ambulance chasing lawyer that helped Patti Nickerson sue her mother for $90,000.

It's another mystery

Just like the shelter lost all of the paper work they had on Ivan Imediately after Angie's death.
I suppose the police didn't think the pic was of importance. Just as the many things that no one thought was important enough to put in the police report. Gee, I wonder what the police were trying to hide from my attorney.

I was allowed to see the report but not my attorney or the private investigator. What can you people make of that?

that the police were quite thorough in their investigation. You have a habit of "bashing" your local police at every opportunity BUT YOU will not answer simple basic questions about your proclaimed skull study of Ivan that DID NOT or COULD NOT have taken place. I also find it quite curious that you felt the need of an attorney in May,'89 when you did not file your lawsuit against your own parents (in reality your parents' insurance company with the big bucks) until May,'90. Bashing the police only makes you look all the more guilty.

I have no problem

telling the police or should I say the lead Investigator, what I thought then or what I think now. Find out who Mr. King's superior was at the time and ask him what I thought of Mr. Kings job of investigating the death of my daughter. Him and I had many talks. As for an attorney in May of 1989, lets just say that my intentions were not at all to sue my parent but the irresponsible shelter that adopted out a demon animal and knew it. Seems we have a few rescues and shelters in this state that don't seem to mind doing that.
As to the skull study, I have been over this and over this with some of you in the wd community.
If you dont want to share your info, thats not my problem..."Bashing the police only makes you look more guilty"....Guilty of what? Oh ya, by the way, when am I going to court? Many have told me the truth will come out when I'm forced into court by you or yours. Could one of you honest souls kindly give me a date that I am suppose to appear?

I seriously doubt that the "irresponsible shelter that adopted out a demon animal and knew it" is to blame either, and even your own relatives did not consider this dog to be a demon animal. Shelters do not adopt out animals that they consider to be dangerous.

So you blame the police for being incompetent and the shelter for being irresponsible, is that your story??? Where was a responsible, adult caregiver that should have met the school bus at 15 degrees below zero and why was a five year old child repeatedly left alone (read your own mother's statement in the PR)????

Incidently, Patti, I am not Gloria, but I am a mother and IMO, Child Protective Services should have filed charges of child neglect in this case.

Were there any laws in place prior to Michigan passing the current wolfdog legislation that regulated the keeping of wild and exotic animals? Or could any Michigan resident keep a lion, tiger, etc for a pet without any kind of permit, housing requirements, etc? Are there any laws currently regulating wild and exotic species besides the new law regulating the wolfdogs?
If not, I would work on writing laws that were fair-if you want an example, try obtaining a copy of laws pertaining to Pennsylvania Wildlife Dealer and/or Possession permits. These laws are reasonable and do not take away your right to own animals-the regulations were written with the safety of both the public and the animals in mind. It would better for the animal owners to propose the laws rather than have someone who is either a radical animal rights activist or dead set against the private ownership of exotics.
As for the Shambala bill, I oppose it for quite a few reasons and have already written letters to my reps and senators regarding the issue.

Dog Owners Take Command of Breed-Specific Legislation

On June 29, 2000 Michigan's Governor, John Engler, signed into law the states controversial wolf dog cross ban to take immediate effect.
This law prohibits the ownership of wolf-dog crosses within the state and places overly restrictive, costly and burdensome requirements on the owners of those already in existence.

"Grand fathered" wolf-dogs now require the purchase of annual permits, permanent microchip identification, numerous postings on their fencing and buildings stating
"A Potentially Dangerous Wolf-Dog Cross is kept on this property," sterilization, zoo like facilities,
and death certificates upon the animals passing.
Owners will no longer be allowed to buy, sell, trade,
breed or transfer their pets.

Prosecution for violations of this law may consist of heavy fines, imprisonment, community service,
and the loss of privileges to own any type of animal.
This new law is obviously an infringement of animal owner's
civil and constitutional rights.

Michigan Wolfdog Association, Inc.
and their attorney Marshall H. Tanick
(Senior partner in the Law Firm of Mansfield, Tanick & Cohen P.A.- counsel for Michigan Wolfdog Association, American Dog Owners Association, Minnesota Counsel of Dog Clubs, Canine Defense Fund,
and other organizations and individuals)
have gathered their arsenal to overturn this ordinance,
prohibit state and local ordinances that define specific breeds of dogs as dangerous and encourage laws that punish by deed not by breed.

The law has "many Constitutional infirmities," according to Marshall H. Tanick who has examined the law on behalf of Michigan Wolfdog Association, Inc.
Tanick and his firm have represented animal owners and organizations in cases around the country.

"The law as a whole is unconstitutionally vague because of the broad and inaccurate way it defines wolf dogs," Tanick said.
He also pointed to several provisions of the measure, which are subject to legal challenge, such as the provision allowing law enforcement authorities to enter private homes and seize animals they regard as wolf dogs. He also cited part of the law allowing judges to prohibit Wolfdog owners from owning any other animals.
" Under that ubsurd provision, a Wolfdog owner could be forbidden from having a
goldfish," Tanick said.
Challenging the law is important, he said, because if passed, the law might form a guide for similar legislation in other states.
"This law could be a very bad precedent unless it is set aside,"
Tanick added.
This new law, as any breed specific law, is over inclusive because it incorrectly assumes that all "wolf-dogs" are dangerous.
Mr. Tanick contends that so-called breed-specific laws, in addition to being flawed, are too broad to be enforced.

"We have examined the law and we believe that it is defective on several grounds," Mr. Tanick said.
"It is over-broad, unconstitutionally vague and has several other legal deficiencies," he said.
Mr. Tanick stated that he anticipates a lawsuit being filed "very soon,"
challenging the law as a whole and several of its individual features.

"What we need most urgently from the general public are their tax deductible cash donations," said Jane VanScoik,
President of Michigan Wolfdog Association.
"This litigation has and will continue to be very costly and funds from the general 'Animal loving' public are desperately needed," she said.
" We intend to protect the rights of all breeds of dogs with our litigation in court," said VanScoik.
"We have already seen the 'chain reaction' taking place in individual communities as other dog breeds are coming under attack.
The Government now has its foot in our doors and other breeds will quickly follow suite.
It's only a matter of time before all dogs
are out-lawed in the state of Michigan.
This is what their (animal activists) ultimate goal is." She said.

This legislation demonstrates that owners of all breeds of dogs are in immediate jeopardy for they, and their owners, may be next on the list of challenged canines.
Legislation that singles out particular dogs for harsh treatment threatens all dog owners and other animal lovers as well.
Imposing desperate treatments on "wolf-dogs" today is a dangerous precedent that could well lead to discrimination against other breeds
in the near future.

Many wolf dogs have and are used for search and rescue, leader, therapy, assistance, working, police, sledding, and loyal family pets.

There are several fully documented and registered breeds throughout the world that are recognized wolf-dog crosses, such as the Saarlooswolfhond, Timber Shepherd, Tundra Shepherd, Kishu and the Czechoslovakian Wolfdog, to name only a few.
The American Kennel Club Registered, Purebred, German Shepherd Dog, for instance, has documented, recent, pure wolf lineage.

All dogs, after all, are descendants of the wolf.

The following breeds are some that have been mentioned explicitly or by physical description in laws proposed, passed or tabled throughout the United States:

Nice site. Shambala and the wolfdog owner - BEWARE!!!

I have posted on several sites the invitation I now state again to Tippi or her appointed representative. I will be glad to debate or discuss the Shambala legislation at any time, place or location on the internet that you name, as long as I am available. I will be going on vacation for a few weeks and will be out more than in. We can come to some manner of agreement on the arraingments, I am sure.

Shambala is flawed in many areas, IF the intent is for responsible owners of exotics to be able to keep their animals in a responsible manner.

Shambala is just right as rain if the intent of Shambala is to rid the private sector and now permitted USDA folks of their animals and make these private owners PAY for the upkeep of the animals in facilites that are NOT up to or are constantly having problems with health laws and other violations of USDA/AWA regulations. I would not want one of my animals to go to a facility that was subpar - just because they have a "certificate" declaring them to be a sanctuary.

Discussion is good. Asking questions is even better. Getting answers to questions that were ASKED FOR would be even better. The ball is in Shambala's court. "WE" will get the answers before the hearings committee or from those that wrote the legislation. Silence is NOT golden in this case. "WE" are waiting for your reply. Thank you.

Thank you for opening this forum. I think we need to do all we can do to put an end to the Ban in Michigan and the SHAM bill. I posted to the Shambala forum and didn't say anything out of line. I just wanted answers to my questions. I feel as owners we have a right to know everything we can about the affects of the Bill and how we can protect our companions.
While I am here, I have another question. I was told that you would know more about the other states that are sitting on the back burner to propose bans of wolfdogs in their states. Where can I find the info on that?
I wanted to let you know that Jen and I are working on different things right now that hopefully will help you guys tremendously with overturning the ban. It will be a great help anyway. I can't say much now but that is why we are trying to find out all the organizations that are backing the Sham Bill. We especially need documentation about wether or not HSUS and/or PETA are backing the Sham Bill. I Have something in the works for financial support as well.

Hi Camille,
In answer to your question, "Yes!", Jen and I both contacted the orgs. and to no avail. Neither of us received any responds from either place. I even sent more emails trying to find out what I can about their stand on the Sham bill but haven't heard anything. I even went to the extent of using the fact that I use to be a member of the HS and had adopted animals from there in hopes to somewhat make them think that I was 100% for there org.. At that, I feel as though we can make a safe assumption that they are definitely supporting it. I would rather have it in documentation from them personally. I don't like to just assume something, but why else will they not respond. Geez.....This is starting to be like a resounding gong when it comes to these people answering questions. No Response!

Hi Camille,
In answer to your question, "Yes!", Jen and I both contacted the orgs. and to no avail. Neither of us received any responds from either place. I even sent more emails trying to find out what I can about their stand on the Sham bill but haven't heard anything. I even went to the extent of using the fact that I use to be a member of the HS and had adopted animals from there in hopes to somewhat make them think that I was 100% for there org.. (Don't get me wrong, I think it is great that they have been able to rehome animals and give them a second chance at life.) At that, With the fact that they won't respond in any way, I feel as though we can make a safe assumption that they are definitely supporting it. I would rather have it in documentation from them personally. I don't like to just assume something, but why else will they not respond. Geez.....This is starting to be like a resounding gong when it comes to these people answering questions. No Response!

More seriously, both of these pieces legislation fly in the face of many ideals which America hold precious (or many American, at any rate), one of which is the right to make informed decisions about how to live one's life, with whom, and with what. No one's well considered and responsible choices should be dictated by politicians, no less movie "stars," many, if not most, of whom are One Trick Ponies. Of course, we need laws in this country -- it's good to be able to assume that red lights mean STOP, or we'd have grid lock, but these laws are not among the ones necessary for a relatively orderly society.

POST DELETED FROM SHAMBALA FORUM, Still awaiting Tippi's response.....

Yes we showed up with out an appointment on Monday, But for WEEKS noone in
your office could answer the phone, or call us back. Once we were there
though, it was easy to tell why, we watched your secretary screen the calls
coming in. After talking with your assistant Trudy, (very nice and helpful by the
way). She told us that you would be happy to talk with us. We could wait
till after the filming. Well we talked with you for a brief moment, and your
secretay was pushing for us to come back, even after YOU told us, we could
wait. We were very patient, and had no problem waiting. We had brought a lot
of wonderful information to share with you. So after much urging by your
secretary, we scheduled an appointment for Thursday.

When we came back on Thursday, we were told you had to leave out of town on
an emergency. So we left our information with your secretary, (which I would
be suprised, if you even looked at it) and then we went for lunch in your
little town.

Well after a few minutes, guess who walks in, YOUR assistant, and guess who
tells us you did not leave out of town, and was surprised by the whole
situation. She couldn't understand why Marsha would tell us you were out of
town, when she knew you were there. She told us that she was gonna call you
and get back with us. Well.... guess who never came back!

And to tell everyone else, filming makes things look better than they are...
You only film the things you want seen. I have seen many other private
owners, that have much nicer facilities than yours. That if your act passes
will have their animals destroyed, because you feel you have the right to
tell everyone who can own what type of animal.
