If Punisher Customs was set up as a legal business entity then whatever Mr. Kinney has is kept completely separate from the business' assets. If that is done then only those assets listed under the name of Punisher Customs could be retrieved by creditors and customers of the business. Taking legal action could make everything worse because of the rules governing the locality in which Punisher Customs operates may require the seizure of assets (including your markers) to be auctioned off and paying back everyone's money at a diminished value (the phrase "pennies on the dollar" is appropriate); of course, this would not affect Mr. Kinney.
There was some nice math done earlier to show the pricing of work done by Punisher Customs and the costs of the parts; however, there was no cost supplied for any alleged labor. It is that labor cost that would move money from Punisher Customs to Mr. Kinney with which he can spend in any way he deems without any liability to return that money to the business. After all, if the business that employs you screws up and the customers demand their money back for whatever services you provided does the business try to collect back the wages it paid you to return to the customers? So long as Lee is not embezzling or illegally transferring funds he is protected from any action brought against his company.
Stepping away from this conjecture, I will state that I do not play paintball, do not understand the celebrity value & economic market of paintball goods, nor know much of the nuance of the sport. However, I do understand smear campaigns, emotional grand-standing, and complaining for the sake of complaining. Mr. Kinney and his detractors have both engaged in these behaviors; BUT, Lee is the one that shows a plan of action to correct the situation. None of Punisher Custom's detractors suggest anything different, or even any means of resolving the situation, than what Lee is allegedly already doing. Normally I'd let a topic like this go except for the fact that I've seen it twice before in the last few months with essentially the same things being said.
Instead of jumping on one side or another to argue something, how about taking that time to ask what you want that can realistically happen. Some people here have decided they just want their markers and are willing to give Punisher Customs some additional time to get their orders done; in other words giving Lee's solution the benefit of the doubt. How about those of you that are complaining? What's your solution? Obviously having the goods you paid for in your hand right now isn't a viable choice and whining about it isn't going to change that fact. You can take PC/Lee to Small Claims Court (if in the U. S. of A.) when you can arrange time off from work, make travel plans to file your claim, and make the court appearance(s). You can hire a lawyer specializing in business & tort laws to provide you with a better legal recourse. Or you can think of some other way of resolving the situation of you having spent money without a product being exhanged as promised. Oh yeah, and there's the default of giving Lee the time to do the work... which you are actually doing by complaining in various digital venues instead of doing anything else. Just PLEASE stop griping about this.
