Actually the court cares little about how much money he has. If he winds up on the wrong side of the case. Then fails to pay up - YOU can start to have property seized.
Sometimes since this was done via the mail/internet - You can file with your local magistrate.
Trust me I just had to sue a local automotive dealership (and won).
