Not defending the girl, but to me clearly the cop was out of line. If he wants to teach her a lesson for her "assault on an officer" he should just charge her with it. In the video I see a girl who is supposedly 15 who tosses her shoe towards the officer and supposedly before that called him a pig. Justifiably this is a disrespectable and immature girl but I guess this also could be explained by the fact that she is 15.

Now the cop who I assume isnt 15 or it might explain his behavior decides after having a shoe tossed at him and being called a name shoves a 15 year old girls head against the wall. This action however was not enough to show the child he was in charge. He then decides with another officers help to get her to the ground and begin punching her in the head.

Of course anybody can have anything anywhere under the correct circumstances, so yeah you gotta be careful.   County lock-up should be a transition place, not a lifer place.  And in this specific situation she had just been picked up and was in an overnight holding/intake cell, and she wasn't in with the general population.

So... are you saying that it is easier to get a shiv when you are someplace for less than 24 hours alone in a holding cell than it is when you are mixed in with a general population in a small city with food service, laundry service, maintenance service etc., all being performed by the general population, which is made up with a good percentage with hardened adults?

By the time she would be transferred to the holding cell she would have at least been searched once.

The "shiv" or "shank" argument holds no water b/c clearly the cop was just beating her up because he was pissed that she called him a "fat pig" and gave him attitude. If he was scared of her having a shank (which is doubtful he would be that scared considering he had another ADULT MALE cop with him and presumably they both had guns, tasers, mace AND handcuffs on them) then he would have made an effort to search her after she was secured, not just hold her on the ground and punch her in the back of the head twice.

Anyone that defends this behavior is pretty much just saying cops should be allowed to do whatever they deem necessary in the moment without any restrictions. The guy was being pulled over for questioning on a rape that occured in the neighborhood. He understood that he was probably going to prison for a long, long time. He had nothing to lose. When we make laws like 3 Strikes, these are the unintended consequences. This is by far the most horrific ending we could imagine in a 3 Strikes case...there are thousands of other scenarios that are not as deadly and disgusting. So yes, it is controversial. Who was the prosecutor? There is nothing in the Ohio Revised Code that kicks up assault to felonious assault based on age. Are you sure you got your facts right with that, or were you just assuming (or conjuring)?

Was there a probable cause hearing that sent your case to a grand jury and were you then tried in a court of common pleas? If no to either of these, you were never charged with felonious assault. And given all the meticulous Ohio Revised Code instructions provided to Grand Jurys, I really doubt that they would indict on that basis.

Now if you beat the guy with a bat, regardless of his age, you're talking felonious assault. Or if you knowingly gave him AIDS.

Who was the prosecutor? There is nothing in the Ohio Revised Code that kicks up assault to felonious assault based on age. Are you sure you got your facts right with that, or were you just assuming (or conjuring)?

Was there a probable cause hearing that sent your case to a grand jury and were you then tried in a court of common pleas? If no to either of these, you were never charged with felonious assault. And given all the meticulous Ohio Revised Code instructions provided to Grand Jurys, I really doubt that they would indict on that basis.

Now if you beat the guy with a bat, regardless of his age, you're talking felonious assault. Or if you knowingly gave him AIDS.

Judge Black, I believe, not positive, but think it was Black.
The night of the fight, the cops came to my door, but I was not home yet, so the next day, I got a visit from a detective who took me to jail, posted bond and was out in a few hours.
I was only 18, not much money, so I got a Public defender...(not a smart move).
During the arraignment I learned that I was being charged with Felony assault on a minor.
Pleaded not guilty and it went forward.
the next hearing I had, was to determine if I wanted a trial by jury or a judge, I wanted a jury and the lawyer wanted 1 single judge...
The charge was reduced to a simple assault after that hearing b/c the Judge, said it was not worthy of a felony..(thank God)
My idiot lawyer was going to allow the chrage, and fight it...he never even tried to get it reduced.
Anyway, the reason for the felony charge was the amount of damage to the person and he was 'minor" and I was an "adult"..he was bigger than me, hit me first, and had made threats prior to fight.
Open and shut case right?

His parents are loaded, my parents are poor...I was found guilty of assualt, no prior record, not even a speeding ticket, and I was nailed for 180 days, 170 suspended, 2 years probation, anger management courses, and restitution and court fines and fees.
The medical bills were out of control.
Plastic chin...he has a plastic piece or whatever inserted into part of his chin.
3 new teeth...he had 3 teeth knocked out and 1 that was fixed.
36 stitches.....mouth and eye

No weapon was used, had about 10 people come to court with me on my behalf, was proven in court, that he attacked me and it was proven that he had hit someone else that night before he hit me.

It is what it is, life moved on, I did my little time and followed the probation rules and he has to live with the teeth and chin thing forever...so I don't feel bad for the guy, I got my record cleared, or hidden I should say.

Plus, it was proved in court that the guy punched me first...

Oh well, at the time, I just did my time and moved on and did everything they wanted me too.

BTW if I remember right...it was a class five felony...then reducaed to a misd.

No seriously what you should have done after the guy hit you is open up channels of communications with him, see what the root cause of the punch was and why he did it. It may help to gather your friends and his friends together to use as intermediaries or League of Friends or United Friends if you will. Work some resolution that everyone can agree on, it wasn't a good idea to go it alone. Perhaps this guy would have been slapped with a condemnation or a judgement of disapproval.

Something about this story still doesn't seem right. Definately I can't prove if there's another side to Murf's tale, or even if it happened.

In general, though, second degree felony charges aren't abjudicated in county courts, and they always go through a grand jury process to common pleas courts.

And "suburban fathers" of false victims don't have the privilege of running a kangaroo court. That would be a headline story if it happened in Hazard, Kentucky, much less Cincinnati, Ohio.

Let's see: the other guy started the fight, multiple witnesses were available on Murf's behalf, the judge usurped his power by avoiding the grand jury process and reduced the charge to a misdemeanor out of a sense of justice to Murf, but then was manipulated by a rich suburbanite into unfairly convicting Murf.

Someone was on narcotics. I don't know if it was everyone involved in the Hamilton County criminal justice process, or if it was Murf.

Like I said, I'd love to hear the other side of the argument. I imagine the proportion of people who are put on trial who think they were in the wrong is close to 0.0009%.
