Homey, I haven't read Pennsylvania's definition of simple assault, but I bet it's worded very similar to Ohio's version: To cause or attempt to cause physical harm.

From the video, I couldn't tell that's what happened. Perhaps the guy was trying to take down the banner. That's not assault. That is perhaps attempted criminal damaging, but the video didn't even make that clear. Since it wasn't charged as such, it really doesn't matter anyway.

This guy filed an assault charge. I didn't see anything in the article that said any witness, including the "victim," claim that the defendent attempted to cause physical harm. And I found nothing in the article to suggest that defendent admitted to assault, which I believe you claimed was in the article.

You can try to interpret what you want about the judge's religion, and again, I wasn't at the trial and don't know anything more to this story that the few facts presented by the article's author. But if you're going to buy the spin that this is attack of Sharia Law imposed on America, then every police officer and parade onlooker in the vicinity of the incident must also have been in on the conspiracy. That would rank as paranoia.

Despite the victimhood theme the author tried to spin, he couldn't let it escape that there was no other trial witness present to corroborate the plaintiff's charge of assault. If assault was the only charge filed, assault was the only charge that could be abjudicated. That's America.

Two atheists got scolded for trying to stir up passions. Guess what? If two atheists try to jump into a St. Patrick's Day parade to mock Catholicism in Cincinnati and someone jumps up and tries to knock their banner down, the police aren't going to charge that antoginist with assault either.

I noticed the "victim," not the police, filed the charge. I can imagine the police officers' reactions when they listened to to this guy rant. If they had witnessed the incident, perhaps they would have charged the plaintiff with disorderly conduct, but I bet they were given absolutely zip probable cause at the scene to charge assault.

Homey, that's my point. I don't believe it's reasonable that the police and the onlookers joined the judge is some sort of intent to enforce Sharia Law. It's far more reasonable for me to believe that laws of the state of Pennsylvania were enforced in that courtroom.

Where did the defendent admit trying to cause physical harm? Again, assuming the law is written in Pennsylvania the same or very similar to Ohio's, that's what the case would be based upon. Interfering with a march and/or trying to tear up his banner or props isn't assault.

I don't know if you're right that the video wasn't introduced into evidence. But where on the video did you see an attempt to cause physical harm? I didn't. Apparently the police didn't, which is why they didn't press charges. Apparently the onlookers didn't.

The plaintiff made a charge requiring him to prove that the defendent caused or attempted to cause physical harm. He got no admission to that effect. He produced no corroborating witness that testified to that effect. He had a video that made both him and the defendent look silly, but showed no physical harm attack.

He might have had a case of making a charge of attempted criminal damaging. He chose to make it an assault charge. I doubt if the police were any more intent on enforcing Sharia Law when they didn't charge as the judge was when he dismissed the case.

Taking religion and/or politics out of it, judges often make philisophical statements when rendering a judgment. I cringed in Warren County last year when the presiding judge at the Marcus Isreal murder trial of Sgt. Dulle made concluding remarks that Israel would have been executed on the streets for killing a white police officer a few decades ago.

But his comments had nothing to do with the elements of that crime. In your case, how Muslims feel about the depictions of their prophet had nothing to do with the elements of assault. These judges could have been saying the sky was blue on a sunny day, and the comments would have been just as irrelevent.

The plaintiff in that case was trying for a reaction. He was a goofball. He got a reaction. Police failed to recognize it as assault. He filed his own charges. He produced no witnesses, had no admission and showed no video of an assault.

Two excited nincompoops got excited on a street. Assault Case dismissed.

And let's be honest: Wasn't this reference part of an alarmist narrative that Obama is turning our society into a Muslim society?

It's unfortunate that these officers were killed - but these were religious documents that these people hold sacred. Don't you think the books should have been shown to the Afghan officials to determine how they should best be disposed of? As it is this act of stupidity made our job in Afghanistan that much harder. The officer who authorized the burning of these books should be court martialed. This action just reaffirms my belief of the incredible lack of acumen of this country in handling geopolitical affairs going back the last 11 years or so. Sad. This performance (including the action of the last 11 years) is so bad it reminds me of the way Mike Brown handles the Bengals. Stupid is as stupid does. No wonder the US is going down the drain.

I remember years ago working downtown fixing up apartments they brought in the Great Society and Model Cities programs and fixed up apartments downtown and put welfare types in them. Unfortunately the apartments didn't stay modern very long and weren't well taken care of. Such is the case here - those people - Afghans etc are used to living now like they did 1000 years or so - you can fix up their country but it will be trashed after you leave. I rember Bechtel pulled out of Iraq because they were tearing things up faster than Bechtel could build plus it was a hot lethal war zone to boot. I predict Iraq will be trashed again soon. It's hard to change peoples living habits/way of life if they have been doing it a certain way for centuries - similar to the Model Cities program here in Cincinnati.

Bengalbeear, they burned those books because they were using those books to transmit messages. They (the muslims) already desecrated the books by writing in them so where is the outrage there?. Also, is not burning the book the proper method of disposal? This is just an excuse of those people to act out their violent disposition.

I think this is the part where I tell you to get out of Cincinnati more and inject some culture into your mind. For those who have been fortunate to travel the globe or lived in other countries or major cities understand that the majority of the Muslims they meet, work with and come across are as less of a threat than those similar in their own back ground.

I have worked with Muslims from all around the world and have never come across an angry extremist who hates America. I live in Columbus which has one of the highest Somalian populations outside of Somalia - The majority of our airport workers here are Somalian - never came across one was disrespectful or filled with hate.

Yes, if you would do some research on the subject, you will find out that the Irish we treated with less respect than the slaves in this country..when they were building the rail roads, they would send in the Irish guy to check out a dangerous situation b/c they were deemed less important.
The Irish were not allowed to use public toilets or water fountains, they were not hired for jobs and they were looked at as filthy people..

My family tree was not a part of that generation or era..it was in the early 20's when my family came here.

The interesting thing is the Republican candidates have to whore themselves out to the far wing right nut jobs to secure the primary. In doing so, they lose the moderates and the independents they need to win the general. However, you are accurate that Obama has governed toward the center. Considering Bush's spending habits, he was an economically liberal President. The problem was that he and Congress cut taxes and then raised spending.

Bush was also a conservative on social issues. More so than the country cared for.

True economic conservative republicans are going to one day face their social conservative brothers and sisters. And a third party may form because of it.

The country is growing more and more tolerant of gays, bi-sexual and trans-gender americans. That is a BAD issue to be conservative on and it only gets worse. Santorum is losing voters like a hemophiliac loses blood in a knife fight on that issue alone.

Romney is pathetic. He looked more like a leader in 2008. Now, he is just begging for votes.
